Cherokee Council House Cherokee, North carolina AllG 0 4 2016 Date ORDINANCE NO. 3 \ q (2016) WHEREAS, The Charter and Governing Document for the Eastern Band of Cherokee Indians establlshes the office of the Principal Chief and Vice Chief and sets the terms for those offices; and WHEREAS, the term of office of Principal Chief and Vice Chief is currently a term of four years; and WHEREAS, there has been an expression by tribal members that term limits on the offices of the Chiefand Vice Chief would benefit tribal government and governance of the people NOW, THEREFORE, BE IT ORDAINED by the Eastern Band of Cherokee Indians in Tribal Council Assembled, at which a quorum is present that the Tribal Council of the Eastern Band of Cherokee Indians does hereby amend the Cherokee Code Chapter 161-2 (a) as follows: Sec. 161-2. -Tribal Offices. (a) The Principal Chief and Vice-Chief shall be elected and hold office for tenns of four years but shall not be eligible to hold office for more than two consecutive terms. BE IT FINALLY ORDAINED that all resolutions or ordinances inconsistent with this ordinance are rescinded, and that this ordinance shall become effective when ratified by the Principal Chief. USET SPF Resolution No. 2017 SPF:008 NATIONAL HEALTH RELATED COMMITTEE AND WORKGROUP APPOINTMENTS WHEREAS, United South and Eastern Tribes Sovereignty Protection Fund (USET SPF) is an intertribal organization comprised of twenty-six (26) federally recognized Tribal Nations; and WHEREAS, the actions taken by the USET SPF Board of Directors officially represent the intentions of each member Tribal Nation, as the Board of Directors comprises delegates from the member Tribal Nations’ leadership; and WHEREAS, the United States (U.S.) Government and each federally recognized Tribal Nation has a government-to-government relationship grounded in numerous historical, political, legal, moral, and ethical considerations; and WHEREAS, it is essential that Tribal Nations and U.S. Departments/Operating Divisions engage in open continuous, and meaningful consultation; and WHEREAS, the importance of Tribal consultation with Indian Tribal Governments was affirmed through Presidential Memoranda (1994, 2004 & 2009) and a subsequent Executive Order (2000); and WHEREAS, the U.S. Department of Health and Human Services (HHS) was the first to develop and implement a Tribal consultation process under the Presidential directives; and WHEREAS, the development of a Tribal consultation process was completed with direct involvement of Tribal Nation representatives, including USET staff; and WHEREAS, a variety of committees/workgroups have been developed to facilitate meaningful consultation with Tribal governments on issues that impact them and to promote Tribal Nation participation in the decision making process to the greatest extent possible; and WHEREAS, in December 2010, the United States recognized the rights of its First Peoples through its support of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), whose provisions and principles support and promote the purposes of this resolution; therefore, be it USET SPF Resolution No.

Hearths in caves have been dated to 23,000 B.C. at sites on the coast of Venezuela. Native people say they have always been here. The Cherokee people say that the first man and first woman, Kanati and Selu, lived at Shining Rock, near present-day Waynesville, N.C. The old people also say that the first Cherokee village was Kituwah, located around the Kituwah Mound, which was purchased in 1997 by the Eastern Band of Cherokee Indians to become once again part of tribal lands. 10,000 BC-8,000 BC Paleo-Indian Period: People were present in North Carolina throughout this period, making seasonal rounds for hunting and gathering. Continuous occupation from 12,000 BC has been documented at Williams Island near Chattanooga, Tennessee and at some Cherokee town sites in North Carolina, including Kituhwa and Ravensford.

Harrah’s Cherokee Casino Resort Goes Bowling with Brunswick As the gaming industry matures and becomes increasingly competitive, casinos are looking for expansion plans that complement existing programs and diversify offerings. It’s more important than ever for resorts to increase the length of stay, attract new demographics, and create revenue streams outside of gaming. At the same time, many tribes are looking to offer more amenities to the tribal community. To achieve those goals, Harrah’s Cherokee Casino Resort in Cherokee, NC, recently broke ground on a $13 million bowling entertainment center. It addresses the questions of how boundaries that Native Nations must work within—land, legal, and representational—impact these small business owners, how these boundaries are transformed, and how these transformations can literally and figuratively alter the landscape of a Native Nation. Within these boundaries, I discuss the EBCI governmental programs initiated specifically to encourage and aid small business owners. I then critically explore the characteristics of these businesses and business owners (products/services offered, education provided through employee training and public information, previous business experience, etc.), as well as how issues of representation and the EBCI’s casino bear upon business ownership. This work furthermore chronicles these businesses’ challenges during the Great Recession, thereby documenting the means by which these critical components of our worldwide economy buttress themselves against economic shocks.

TESTIMONY OF PRINCIPAL CHIEF PATRICK LAMBERT FOR THE EASTERN BAND OF CHEROKEE INDIANS BEFORE THE HOUSE INDIAN AND ALASKA NATIVE AFFAIRS SUBCOMMITTEE HEARING ON “THE EASTERN BAND CHEROKEE HISTORIC LANDS REACQUISITION ACT” (H.R. 3599) February 24, 2016 Chairman Young and Ranking Democrat Ruiz, I appreciate the opportunity to provide this testimony of behalf of the Eastern Band of Cherokee Indians. I want to first thank this Committee for holding a hearing on this bill and express my particular appreciation to Congressman Chuck Fleischmann, our friend from Tennessee, who introduced this bill and has championed it. I also want to thank our Representative, Mark Meadows, for his friendship, respect for the Eastern Band, and strong support for this bill. The Eastern Band of Cherokee Indians is a Tribal Nation recognized by the United States as a sovereign with inherent rights of self-government, like the several states and foreign nations. The place of the Cherokee People within the history of the United States is often told, but usually as though we are a People of the past. Our true story is one of thriving, survival, and thriving again. Before the U.S. Army forcibly removed Cherokee People along the Trail of Tears, the unified Cherokee Nation governed and occupied lands that covered several states that now include our Reservation in Western North Carolina and the State of Tennessee. The Eastern Band of Cherokee is compromised of the 15,000 or so descendants of the Cherokees who avoided forced removal on the Trail of Tears, or returned home from the Indian Territory after surviving the removal and returning to their aboriginal homelands.

Kephart to Complete the Second Appointment Which Will Expire on September 30,2017; And
RESOLUTION NO. ____ (2016 WHEREAS, Cherokee Code Section 16A-3(b) authorizes the Principal Chief of the EBCI to appoint enrolled members to the TCGE Board of Advisors, subject to the approval ofTribal Council; and WHEREAS, the provisions of Chapter 16A-3(b) require that the terms of service for the TCGE Board of Advisors be staggered to ensure that experienced individuals serve on the board at all times; and WHEREAS, Brenda Oocuma and Ray Rose were appointed by the Principal Chief of the EBCI and approved by Tribal Council, with the appointment of Brenda Oocuma to expire on September 30, 2016 and the appointment of Ray Rose to expire on September 30,2017; and WHEREAS, Brenda Oocuma and Ray Rose resigned from their positions, making it necessary for the Principal Chief to nominate two individuals to serve the remainder of their terms; and WHEREAS, Resolution 499 (2015) specifically named Barak Myers to complete the first appointment which will expire on September 30, 2016 and Angie Kephart to complete the second appointment which will expire on September 30,2017; and WHEREAS, Resolution 295 (2016) was submitted by Principal Chief Patrick Lambert for clarification purposes, however Re295 did not clarify, but actually changed the intent of Resolution 499 (2015); and WHEREAS, It is not in the best interest of all tribal members of the EBCI that may be eligible for appointments, in the future, or of any board, commission that their appointment may be jeopardized by unsubstantiated change in the intent of a resolution which could have serious adverse effects on their service.
