Mr. Fowler presented the plat, which will be the site of a 304-unit apartment complex that will be annexed into the city within two years of plat approval. The plat was a single lot, with several drainage easements to carry stormwater runoff through the lot. The plat had approved tree preservation and fee-in-lieu of parks agreements by the time of consideration at the meeting.

Commissioner Altmiller made a motion to approve the plat, with Commissioner Beach seconding. The motion passed 5-0.

G.2. Presentation on the proposed FY 2020-24 Capital Improvements Plan (CIP) for the City of Buda (City Engineer John Nett)

Mr. Nett made a presentation centered on the most recent draft of the 2020-2014 CIP. The Commissioners asked several questions regarding projects as well as the status of the roadway impact fee study but did not take action. Mr. Nett and Deputy City Manager Micah Grau encouraged the Commissioners to contact city staff regarding any questions they have regarding the document prior to its consideration by City Council.

G.3. Update report and possible action on the Texas 86th Regular Legislative Session and the issues affecting the City of Buda (Deputy City Manager Micah Grau)

Mr. Grau updated the Commissioners of the City’s legislative agenda prior to the legislative session and the results of the session in areas most affecting Buda. The biggest changes covered were in the area of taxation, bond elections, flood relief funding, building materials, plat approval timelines, franchise fee consolidation, plumbing licensing, public comments at public meetings, and other items. The Commissioners did not take any action.

H. STAFF REPORTS

1. Report on the Activities of Other Boards and Commissions Senior Planner David Fowler updated the Commission of the activities of Historic Preservation Commission, Library Commission, Parks Commission, Sustainability Commission the Main Street Advisory Board and City Council.

SUBJECT: DELIBERATION AND POSSIBLE ACTION IN REGARD TO A SPECIFIC USE PERMIT FOR A GROCERY, MARKET IN THE FORM DISTRICT 5H (F5H) ZONING DISTRICT FOR THE PROPERTY KNOWN AS BUDA MILL AND GRAIN DEVELOPMENT DISTRICT, LOT 1, CITY OF BUDA, HAYS COUNTY TEXAS, COVERING +/- 8.06 ACRES. THE PROPERTY IS LOCATED AT 304 S. MAIN STREET, SUITES 103 AND 104, BUDA, TX 78610. (SUP 19-04).

1. PROJECT SUMMARY The City of Buda has received an application for a Specific Use Permit (SUP) for the subject property, located in the Buda Mill and Grain Complex, west of Main Street and south of FM 2770. The applicant has indicated that the planned use is a restaurant that will also have a small specialty grocery store included in the layout. The restaurant use is permitted, but grocery sales requires the SUP. The Market class of grocery stores is permissible in the (F5H) zoning district upon the issuance of a Specific Use Permit.

In recommending that an SUP for the premises under consideration be granted, the City Council shall determine that such uses are harmonious and adaptable to building structures and uses of abutting property and other property in the vicinity of the premises under consideration, and shall consider the following factors:

a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site; b. Adequate means of ingress and egress to public streets or approved access easements and appropriate paving widths of streets, alleys and sidewalks to accommodate traffic generated by the proposed use; c. Provisions for drainage; d. Adequate off-street parking and loading; e. Safety from fire hazard and measures for fire control; f. Protection against negative effects of noise, glare and lighting on the character of the neighborhood, protective screening and open space; g. Heights of structures; and h. Compatibility of buildings and such other measures as will secure and protect the public health, safety, and general welfare.

2. BACKGROUND/HISTORY The applicant is proposing a restaurant with a small accessory grocery store use in one suite of a commercial building located on the subject property. The proposed 7 restaurant/market would be located in the building to the east of Nate’s, located adjacent to Main Street near the northern parking lot accessible from the Buda Mill and Grain’s northernmost curb cut on Main Street. The business model of the proposed business is a restaurant that also has a grocery area, with a focus on Texas-made gourmet foods and wine. The location is further than the required 300-foot distance from a church, public or private school, or hospital, which would allow both the service of alcohol at the restaurant and the sales of alcohol in the grocery store, pending approval of the SUP.

The applicant has submitted conceptual internal layouts of the suite to be rented, as no exterior renovations would take place. As this is an SUP, the conceptual documents submitted are normally binding, in addition to any UDC regulatory updates and any conditions placed on the project. This means if the commission intends to enforce the current UDC ordinances for architecture and exterior materials, approval of the SUP must be recommended with the condition that all applicable design-related ordinances must be followed. In this case, the existing building was in conformance with city standards at the time of its approval and the building and site are still in conformance with city regulations other than minor variations in exterior materials.

The F5H zoning district is a new zoning district in the 2017 UDC. This is a form-based district designed to create nodes of high-density mixed use in Old Town Buda along Main Street. This zoning district is intended to provide the highest intensity of mixed use in the core of Old Town Buda along Main Street. The Buda Mill and Grain parcel is the southern extent of the F5H district, which extends along Main Street, terminating with the City Hall and Willie’s Joint properties. Within the Old Town area, the F5H zone adjoins the F4H and F3H zones which are designed as progressive steps down from the peak density of Main Street. The new map was designed to better reflect the city’s comprehensive plan and more efficiently place the zoning districts in order to achieve the comprehensive plan’s goals.

Prior to October 2017, the site was in the FZ2 zoning district, a floating zone district designed for downtown uses. Under this previous zoning, the allowed uses in the district were not enumerated, but there was a statement that the uses should work together to create a mixed-use environment. The creation of new zoning districts with the passage of the 2017 UDC and the change in zoning districts for the site created the need for all Grocery store types (Convenience Store, Market and Supermarket) uses to obtain Special Use Permits. The application is only for the proposed Los Olivos Market; other similar businesses in the Buda Mill and Grain complex would need to apply for separate Specific Use Permits.

The attached site plan shows the current layout of the development which will remain unchanged.

3. STAFF’S REVIEW AND ANALYSIS

The following constitutes an evaluation of the proposed SUP using the UDC’s criteria:

a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site; The project is located on Main Street and can be accessed by three different driveways—two on Main Street and one on FM 2770. There is a sidewalk along the Main Street side of the property. As with any business that serves alcohol, there is a possibility of patrons becoming intoxicated and driving, walking or riding a bicycle under the influence of alcohol. As with any business serving alcoholic beverages, monitoring the consumption of patrons will be a duty of the proposed business’s staff.

8 b. Adequate means of ingress and egress to public streets or approved access easements and appropriate paving widths of streets, alleys and sidewalks to accommodate traffic generated by the proposed use; The existing driveway accesses mentioned above would continue to be used. No changes in access or circulation are proposed. c. Provisions for drainage; The site has adequate drainage improvements and does not have any current issues with drainage. d. Adequate off-street parking and loading; The UDC has parking standards for restaurant and Grocery, Market uses as well as for the other uses that are also on the site. The standard is one parking space per 300 square feet of building area for the market and 1 space per 200 square feet for the restaurant space. Based on a conceptual floorplan the applicant has provided, out of the overall 2,876 square feet of leased space, 1,438.5 square feet each of restaurant and market space will be built. Under the current ratios, 7.19 spaces would be required for the restaurant and 4.8 would be required for the market. This would lead to an overall parking requirement of 12 spaces. The Buda Mill and Grain site plan was designed with 264 parking spaces, of which only 79.71 have been accounted for in parking minimums. Even if the remainder of the center were to develop as restaurant, which has the highest parking requirement, there would still be over 130 parking spaces provided in excess of the combined on-site parking minimums required of its component uses. e. Safety from fire hazard and measures for fire control; All building permits are reviewed for fire code compliance. The proposed Micro winery use should not have any special issues in this regard. f. Protection against negative effects of noise, glare and lighting on the character of the neighborhood, protective screening and open space; The parcel that is the site of the proposed use is within 200 feet of two residential lots, and only is within 400 feet of roughly 20 residential lots. However, most of these lots are on the opposite side of the parcel across FM 2770 from the suite that will be the site of the proposed use. As such, for these residences the proposed use should not produce the listed nuisances during day or nighttime operation hours in excess of what is already created in the Buda Mill and Grain complex. g. Heights of structures; and The maximum building height for the “General Building” type, which includes retail and office buildings, in the F5H district is 45 feet. The existing buildings include historic grain silo and barn structures that may exceed that height, but no change in the existing buildings’ height would be due to the proposed use. h. Compatibility of buildings and such other measures as will secure and protect the public health, safety, and general welfare. The 2017 UDC specifying the proposed uses and requiring an SUP for the Grocery, Market use was to ensure that the proposed use would be appropriate in creating the type of mixed use area envisioned for the F5H zoning district. The intent of the F5H district was to create a mix of uses that would activate a vibrant downtown area without disturbing nearby residential areas. In this case, the proposed use would be part of a mixed-use area with existing and newly constructed buildings designed to create a mix of uses that will attract customer traffic from both Buda and the surrounding areas. To the Northwest and east of 9 the subject property, the area transitions to single-family residential in the Old Town and Bella Vita neighborhoods. As one travels north towards Old Town Buda, that area’s higher density of historic structures begins to emerge. To the south, Main Street becomes more industrial as one approaches Robert S. Light Boulevard. The existing commercial uses on the site provide an environment in which the proposed use should not stand out as a nuisance to the surrounding community.

4. FINANCIAL IMPACT As the Buda Mill and Grain center is existing, no substantial new financial impacts or revenues would come from the subject property, other than activating the retail space and producing greater sales taxes for the city.

5. ACTION OPTIONS Approval of a special use permit is entirely discretionary based on application of the criteria. As such, staff presents the following options:

• Modify and Approve the SUP – This alternative results in the SUP being granted, but provides for modifications to address concerns.

Because the site is existing and in compliance, staff does not recommend this option.

SUBJECT: DELIBERATION AND POSSIBLE ACTION IN REGARD TO A CHANGEABLE ELECTRONIC VARIABLE MESSAGE SIGN LOCATED AT JOHNSON HIGH SCHOOL, 4260 FM 967, BUDA, TX 78610.

1. PROJECT SUMMARY

This is an application for a Changeable Electronic Variable Message Sign for the new Johnson High School. The school is located near the city’s western extreme on the north side of FM 967. The proposed sign is a brick and stone monument sign with a 12-square foot electronic message area and a 12-square foot stationary backlight panel sign. The placement of an electronic message sign outside of the parts of the Interstate Business (B-3) zoning district that are within 300 feet of Interstate 35 requires Planning and Zoning Commission approval.

2. BACKGROUND/HISTORY

Representatives of Hays ISD spoke with City staff to determine the allowable parameters of an electronic message sign prior to the opening of Johnson High School. An application for a sign was received in late July, but the application was returned for revisions after it was noted that the location of the proposed sign was within a 50’ right-of- way easement that was included on the High School’s approved plat and that one of the technical documents conflicted with the other documents submitted. The sign submission package has been revised to correct these issues for Planning and Zoning Commission consideration.

3. STAFF’S REVIEW AND ANALYSIS

The proposed sign has been submitted to comply with Subsection 4.02.06 of the Buda UDC which states the conditions under which electronic message signs may be permitted. Only one such sign is allowed per lot, the sign must be designed as a monument sign, the sign must be located more than 350 feet from any property with a residential zoning designation, and the sign must be located at least 750 feet away from a property that is a historic landmark or that is in the Historic District.

As far as the design of the sign, the electronic message area is limited to 12 square feet in area. The electronic message area counts 4 times when calculating the total sign 17 area. In the case of a 12-square foot sign, it would count as 48 square feet of sign area, to be deducted from the maximum amount allowed. Since sign sizes for commercial uses are not specified for the AG zoning district in the Buda UDC, the size maximums for monument signs in the areas in which electronic message signs are permitted apply. In the B-3 zoning district, maximum sign area is 100 square feet, the maximum sign height is 12 feet, and the maximum width is 15 feet. Monument signs are required to be set back 10 feet from the right-of-way.

Electronic message signs are permitted by right only within the Interstate-35 Business (B- 3) zoning district and within 300 feet of I-35. The proposed sign is not in the area in which this type of sign is permitted by right, as the High School is in the Agricultural (AG) zoning district and more than 300 feet from I-35. However, applicants may submit an electronic message sign for review before the Planning and Zoning Commission to gain approval for placement of this type of sign in other locations. In considering approval of a proposed electronic message sign, subsection 4.02.06.C of the Buda Unified Development Code specifies that the P&Z apply the following criteria:

1. The potential for interference with the enjoyment of the use of surrounding properties and compatibility with land uses;

2. The zoning district and the adjoining zoning districts of the property for which the Changeable Electronic Variable Message Sign is sought;

3. Whether the request is harmonious with the public interest;

4. Consistency with the purposes of this Code;

The proposed sign is under the maximum sign area for a monument sign in the default zoning district in which electronic signs are allowed. Counting the 12-square foot electronic portion four times, and the identically sized stationary panel once, a total sign area of 60 square feet is calculated. The sign structure is 9’4” wide and 8’ 2 1/4 “high, both under the maximums for monument signs in any zoning district.

The sign is proposed in a location that is not directly adjacent to any residentially-zoned areas or properties. The proposed location is 60 feet off the existing right-of-way to allow the sign to conform with city code after the additional right-of-wat of the High School plat is dedicated.

If approved, the sign is subject to the performance limits found in in Subsection 4.02.06.C, including maximum daytime and nighttime illumination levels, the requirement for display of a static message for a minimum of 6 seconds; no use of animation, flashing or video; and no display of a solid white background.

As the sign is within the allowed parameters of electronic message signs within the zoning districts in which they are permitted and meets the standards of evaluation listed in the Buda UDC, the sign may be approved as submitted.

Proceeding with the work in accordance with these instructions indicates your acknowledgment that there will be no change in the contract sum or contract time. If changes in the contract sum or contract time are warranted, the general contractor shall submit a change order request for review and approval prior to commencement of the work unless otherwise noted below.

Description:

As requested by the owner in OAC meeting 4/4/19, a ground-mounted marquee sign is to be installed as opposed to the pole-mounted marquee sign specified in section 10 14 64. Please see attached sheets showing details for the new marquee sign. Electronics and materials of the new marquee sign are to remain of the same quality as originally specified. Contractor to coordinate sign attachement with sign manufacturer requirements. Details have been revised from original ASI based on Spectrum provided preliminary dimensions. Please provide a breakdown of credits and costs for review and approval, as well as manufacturer options as Owner requested.
