As is widely known, the publication of the Journal appeared in its inaugural publication in July 2016. Thereafter, the Journal has been issued twice a year until the publication of this issue. I am indeed extremely gratified to observe that since the Journal’s appearance in July 2016, insightful articles on various interesting areas of law written by judges, lawyers, academicians as well as legal and judicial officers have been published in the Journal. It is hoped that this publication will be found useful not only by judges but also lawyers, law teachers and students. I am overwhelmed by your presence. I particularly acknowledge the presence in court of: (i) the President of the Senate, Tan Sri Dato’ Sri SA Vigneswaran; (ii) the Speaker of the House of Representatives, Dato’ Mohamad Ariff bin Md Yusof; and (iii) the Deputy Minister in the Prime Minister’s Department (Law), Tuan Mohamed Hanipa bin Maidin. I believe your attendance signifies the importance of the court as the third branch of government. The mutual respect of the separate arms of government in Malaysia is one of the great strengths of our democracy. You do the court a great honour by your presence today. President of the Court of Appeal, Mr Attorney General, President of the Malaysian Bar, President of the Advocates’ Association of Sarawak and President of the Sabah Law Society, thank you for your kind and generous words. I do not in the least pretend that they are deserved. I am grateful for the pledges of support and commitment you have each extended. Ladies and Gentlemen, It is indeed a privilege and a great honour for me to have been appointed as the first female Chief Justice of Malaysia. And with so many talented and able women in the legal profession, I am confident that I am not the first and the last female Chief Justice of Malaysia. 2 Journal of the Malaysian Judiciary July [2019] JMJ I thank those many women who have preceded me in the legal profession, who, by their integrity, ability and determination have made the passage of women who come later, so much easier. We in Malaysia are fortunate in that we have transcended the gender diversity in terms of the number of female judges in the superior courts, when compared to many other countries in the world, particularly the developed nations. It is one of the areas where we lead in the world. Although it has been achieved over a relatively short period, in the past two decades or so, our progress has been steadily improving. It is important to note that this evolution has not been engineered artificially to achieve these numbers, as a means of demonstrating that a mere gender quota has been met. On the contrary, the evolution has been a natural progression, which has come about purely on the basis of merit. It is for this reason that I said in my initial interview that I should not be defined by my gender, but by merit. However, it must be said that while it is true

ABSTRACT: It is an indubitable fact that the use of mediation as a form of dispute resolution has gained traction across the globe. More importantly, the practice of mediation has also been transformed through the establishment of several techniques for formalized mediation. This article will provide insights into one of these avenues for formalised mediation, namely, court-annexed mediation practice in Malaysia. It will first discuss the motivations that led to the introduction of such a programme. This will be followed by an analysis of the operational aspects of the practice. A matter of utmost importance concerns the role of the courts and the judiciary in court- annexed mediation and will be considered in great detail. This article will then offer suggestions on how some of the challenges that exist and are inherent in this particular method of formalised mediation could be overcome. These views are expressed with the hope that court-annexed mediation can function as an effective alternative dispute resolution mechanism under the umbrella of the Malaysian courts.

    Agong Attends Sultan Of Brunei's Golden Jubilee Royal Banquet BERNAMA 06/10/2017 BANDAR SERI BEGAWAN, Oct 6 (Bernama) -- Yang di-Pertuan Agong Sultan Muhammad V and several Malay rulers attended the royal banquet held in conjunction with Sultan of Brunei, Sultan Hassanal Bolkiah's Golden Jubilee celebration at the Nurul Iman Palace here tonight. Sultan Muhammad V arrived at the palace at 8 pm. Also present were Prime Minister Datuk Seri Najib Tun Razak and his wife, Datin Seri Rosmah Mansor. The Golden Jubilee celebration, which began officially last Tuesday, marks the 50th anniversary of Sultan Hassanal Bolkiah's accession to the throne on Oct 5, 1967. Yesterday, the Sultan and Permaisuri Raja Isteri Pengiran Anak Saleha travelled in a golden royal chariot through the streets and waved to tens of thousands of his subjects as part of the celebration. Among the Malay rulers who attended the royal banquet were Sultan Sharafuddin Idris Shah of Selangor, Sultan Nazrin Shah of Perak, Sultan Ibrahim Sultan Iskandar of Johor, Sultan Mizan Zainal Abidin of Terengganu, Pahang Regent Tengku Abdullah Sultan Ahmad Shah and Raja Muda of Perlis Tuanku Syed Faizuddin Putra Tuanku Syed Sirajuddin. Also present were Penang Governor Tun Abdul Rahman Abas, Sarawak Governor Tun Abdul Taib Mahmud, and Chief Minister of Sabah Tan Sri Musa Aman. Other country leaders who were also invited to the royal banquet were Indonesian President Joko Widodo, Myanmar leader Aung San Suu Kyi, Philippine president Rodrigo Duterte, Singapore Prime Minister Lee Hsien Loong and Thailand Prime Minister General Prayut Cha-O-Cha. The event ended at around 10.30 pm.

The 1st respondent (‘Dr Milton’) was then a Visiting Consultant Obstetrician & Gynaecologist at the same hospital while the 2nd respondent was the Malaysian Medical Council (‘MMC’). Pursuant to a complaint by Dr Milton, the MMC charged Dr Lourdes with infamous conduct in a professional respect. An inquiry was carried out and, by a majority, the MMC found that Dr Lourdes had no case to answer. Dr Milton was dissatisfied with the outcome of the inquiry and proceeded to institute judicial review proceedings for an order of certiorari against the MMC’s majority decision. Dr Milton additionally sought a declaration that Dr Lourdes was guilty of the charge against him and that the MMC be ordered to hear his plea in mitigation and for the imposition of an appropriate sentence.

Assalamualaikum Warahmatullahi Wabarakatuh. Kebebasan Institusi Kehakiman adalah asas kepada setiap sistem undang-undang di dunia, termasuk Malaysia. Justeru, proses yang mana Hakim dilantik hendaklah bersih, telus dan bertanggungjawab. Ini adalah antara alasan utama Suruhanjaya Pelantikan Kehakiman (Suruhanjaya) ditubuhkan; iaitu untuk mengukuhkan dan meningkatkan integriti institusi kehakiman dan memenuhi kehendak dan aspirasi rakyat untuk melihat ketelusan dan keadilan dalam sistem kehakiman Malaysia dipatuhi. Pembentangan Laporan Tahunan Suruhanjaya Pelantikan Kehakiman ini bukanlah sekadar memenuhi kehendak seksyen 31 Akta Suruhanjaya Pelantikan Kehakiman (Akta 695) tetapi untuk menunjukkan bahawa dalam menjalankan fungsi-fungsi statutorinya, Suruhanjaya ini mendukung kebebasan berterusan institusi kehakiman dan secara lanjutan, prinsip the rule of law. Dengan itu, saya dengan sukacitanya mengalu-alukan pembentangan Laporan Tahunan Suruhanjaya Pelantikan Kehakiman Tahun 2019.
