The regular meeting of the Planning & Zoning Commission was held on the aforementioned date and time in the Council Chambers of City Hall, located at 405 Jefferson Street in Washington, MO.

1) The meeting was called to order, Pledge of Allegiance, and the following roll call was taken:

2) Approval of Minutes from March 11, 2019-Motion made to approve, seconded and passed without dissent.

3) Case No. 19-0403-Applicant is requesting to rezone lots 1, 2 &3 of Mt. Carmel from R-lA, Single Family Residential to R-lC, Single Family Attached

Sal Maniaci-The applicant is requesting to rezone Lots 1, 2, and 3 of Mount Carmel Estates from R-1 A Single Family Residential to R-lC Single Family attached to build three duplexes and add 3 units to the subdivision in its entirety. There are currently 12 lots in the subdivision all of which are single family homes. The three lots in question are the first and only lots that access the west side of Carmel Lane. Due to the existing layoht 'of the subdivision these lots do not directly adjoin any other homes in the subdivision. The request does slightly increase the density of the subdivision, however, the use is still classified as Single Family Residential and staff believes would not detriment the subdivision as a whole once fully developed.

Staff recommends approval of the request to rezone Lots 1, 2, and 3 of Mount Carmel Estates from R-lA Single Family Residential to R-1 C Single Family Attached. After a short discussion, motion was made, seconded and passed without dissent.

Analysis: The applicant is wishing to construct an addition at 1807 E. 5th Street and operate an indoor gun range. City Council recently amended City Code to allow indoor gun granges as a special use on Commercial properties. The property, zoned C-2, requires such permit.

The site plan shows a 60x60 expansion for the proposed use and is not proposing to remove any parking with the expansion. The subject property is located on a portion of 5th Street that has a mixture of uses that range from residential to light industrial. Given that the property directly behind the expansion is commercial and that the proposed use will be conducted completely indoors screened from neighboring properties staff does not believe it will be a detriment to the area.

A parking plan will be required prior to occupancy to ensure they meet the minimum standards.

Recommendation: Staff recommends approval of the Special Use Permit to operate an indoor gun range at 1807 E 5th Street.

Re: Vacation ofE. Rose Lane Right of Way

Planning and Zoning Commission Members:

City Staff received a request to vacate or portion of Right of Way of East Rose lane just northeast of A.Roy Drive. (See Attached Exhibit) This portion of East Rose Lane is unconstructed with no public improvements in place.

Given that Highway 100 is a limited access road in this location and that Wal-Mart owns a strip of ground between the Schroepfers and A. Roy Drive, City Staff believes that this piece of right­ of-way is the most plausible place to construct future access if the land to the west is ever developed. Staff is recommending denial of the requested vacation because of this.

Please be advised that this firm represents Marilyn M. Schroepfer, Marvin J. Schroepfer, Richard J. Schroepfer, Bernard A Schroepfer and Charles C. Schroepfer concerning real property located in the City of Washington. It has come to my clients' attention that there is an old title encumbrance that impacts their property. This property has been in the Schroepfer family since 1917. My clients became the owners of this property in 1988 pursuant to the vesting deed attached hereto as "Exhibit 1."

On March 5, 1870, the property in question was deeded from Casper Howermann to the City of Washington. A copy of the deed transferring this property, now known as E. Rose Lane, to the City of Washington is attached hereto as "Exhibit 2." Turning north from Highway 100, A Roy Drive turns into E. Rose Lane as the road curves back to the West. The original deed as described in "Exhibit 2," also included part of my client's property that turns back to the East, approximately where my client's driveway is located. This strip of land essentially "dead ends," at my client's property and is overgrown with large trees and other improvements. I have attached an aerial photograph as "Exhibit 3," for your reference to show this area. I have also attached an aerial of the same area depicted in "Exhibit 3," in color and without the depicted roadway so that you can clearly see the vegetation and structures over this area as "Exhibit 4."

My client's request is that the City of Washington vacate the portion ofE. Rose lane lying East of A Roy Drive, so that the deed from 1870 no longer encumbers my client's property. My client and I would be more than happy to address this issue with the Board of Alderman at a City Council meeting if, after your review, you feel that would be the easiest way to resolve this issue. Planning and Zoning Commission Members:

There recently have been inquiries to City Staff on the requirements to open and operate a homeless shelter in Washington. The closest definition that exists is Hotel/Motel, which is permitted in the C-2 and C-3 zoning districts without any type of special use permit. This was the information given to applicants interested in operating this type of facility.

Our current zoning matrix, which lists all permitted and special uses, is derived from the North American Industry Classification System (NAICS), so City Staff is proposing an amendment that would add the NAICS definition for Temporary Shelters to the City's zoning code. It reads as follows:

Establishments primarily engaged in providing (1) short-term emergency shelter for victims of domestic violence, sexual assault, or child abuse and/or (2) temporary residential shelter for homeless individuals or families, runaway youth, and patients and families caught in medical crises. These establishments may operate their own shelters or may subsidize housing using existing homes, apartments, hotels, or motels.

In order to allow property owners, The Planning and Zoning Commission, and City Council to properly assess and comment on a use of this nature, we are proposing that Temporary I Emergency Shelters, as defined above, be listed as a special use in all M-1 and M-2 zone districts only.

Analysis: The applicant is requesting to rezone 4 and 10 Franklin Avenue from C-1 Light Commercial to C-2 General Commercial. Franklin Avenue, more commonly known as Highway 47, is a major thoroughfare in Washington with a number of commercial uses along this specific portion. The applicant is wishing to 'up-zone' to the next commercial district that allows more generalized commercial uses.

Given its location along and access to Highway 47 and its proximity to other commercial uses, staff believes the requested zoning is appropriate for the area. Any future development proposed on either property will be subject to all zoning and site plan requirements of City Code. Parking, stormwater, screening, fire access, etc. will all be evaluated prior to any development.

Recommendation: Staff recommends approval of the request to rezone 4 and 10 Franklin Avenue from C-1 Light Commercial to C-2 General Commercial.

*A protest petition with signatures of 34% of land owners within 185 has been submitted and attached triggering a super majority to approve at City Council

*Multiple letters of support have been submitted and attached in favor of a temporary/ homeless shelter, which is the intended use listed on the application.

A City Council Vote. The City Council shall vote on the amendment based on the following conditions:

1 . All rezoning actions shall require a favorable vote of a majority of the full membership of the City Council, except as provided below.

2. Rezoning shall require a favorable vote by at least two-thirds (2/3) of a majority of the full membership of the City Council if the City Planning Commission recommends against the rezoning.

3.
