Accordingly, for many years, the Church has been politically active, serving as the nurturing ground for several African-American politicians. Indeed, many of the country’s early African-American legislators were themselves mem- bers of the clergy of the various denominations that constituted the African-American Church. In 1934, Congress amended the Internal Revenue Code to pro- hibit tax-exempt entities—including churches and other houses of worship—from allowing lobbying to constitute a “substantial part” of their activities. In 1954, Congress further amended the Code to place an absolute prohibition on political campaigning by these tax-exempt organizations. While these amendments did not specifically target churches and other houses of worship, they have had a chilling effect on efforts by these entities to fulfill their mission. This chilling effect is felt most acutely by the African-American Church, a church estab- lished to preach the Gospel and engage in activities which would im- prove socio-economic conditions for the nation’s African-Americans. Brunson* Since the enactment of the modern federal income tax, churches have been exempt from taxation. But that exemption is neither necessary nor inevitable. In fact, at the end of the 1860s, the Bureau of Internal Revenue decided that tithing received by the Mormon church was taxable under the Civil War income tax. At the time, Mormons distrusted the federal government and the federal government, in turn, distrusted the Mormons. The question of taxation was a small part of a larger legal and existential battle between the Mormons and the government. This Article situates the question of the taxability of tithing in the broader legal and relational conflict. INTRODUCTION Churches and other religious organizations have enjoyed the benefits of tax exemption in this country since the late nineteenth century. During this time, many American churches have grown, flourished, and garnered both wealth from and favor in society. Tax exemption has become "big business." A study conducted in 1996 concluded that nearly half the country's population donates to a church or other place of worship in any given month.1 A similar study in 2000 showed an increase; now over half (fifty-four percent) of all adults donate to churches in a typical month. 2 When considering donations over an entire year, the figure climbs to seventy-five percent.3 In fact, the majority of all donations made in the United States are directed toward churches and religious causes. According to the American Association of Fund-Raising Counsel Trust for Philanthropy, in 1998 Americans contributed $174.52 billion to charities, directing the lion's share ($76.06 billion), as always, toward religious entities. 4 Many of these donations are undoubtedly made as a result of the preferential tax treatment afforded the gifts.5 While tax-exempt status has long benefited American churches and religious institutions, given the development of modern case law and a changing attitude toward the role that religion plays in American life, churches may not continue to enjoy the benefits of tax exemption. The government generally respected religious freedom in law and in practice. There was no change in the status of respect for religious freedom by the government during the reporting period. The government showed intolerance toward those who commented on sociopolitical matters, including religious groups. There were some reports of societal abuses or discrimination based on religious affiliation, belief, or practice. The U.S. government discusses religious freedom with the government as part of its overall policy to promote human rights. Section I. Religious Demography The country has an area of 49,998 square miles and a population of 5.7 million. More than 80 percent of the population belongs to Christian groups. Roman Catholicism remains the dominant religion. According to the 2005 census by the government's Nicaraguan Institute of Statistics and Census, 58.5 percent of the population was Catholic and 21.6 percent was evangelical Protestant, a category that included Assemblies of God, Pentecostals, Mennonites, and Baptists. An April 2010 public opinion survey from independent private polling firms indicated that 56.2 percent of the population was Catholic and 24.9 percent was evangelical. Both Catholic and evangelical leaders viewed these results as inaccurate.
