The study of commercial law can be divided into four basic ca- tegories: (a) individuals (natural persons); (b) objects of commerce; (c) legal instruments and (d) administrative and legal procedures. Business relations bet- ween individuals and business entities requires significant legal documentation, including atypical or nonstandard business contracts. A central feature of all business transactions is the “legal entity”, used by organizations worldwide to conduct business. In order for many businesses to carry out routine activities, they must have many of the same legal rights and responsibilities as natural persons. In a word, these entities require “legal personhood”. Which leads us to the question of Legitimation. The most widely used legal instruments are nons- tandardized business contracts. In essense, this is the delineation of contracting parties as entities with well-defined rights and obligations. This authority de- pends, in turn, on the legitimacy of the “personhood” of the contracting parties, which is often a point of dispute in business relations. Regardless of whether one accepts the use of terms “legal entity” and “legal personhood”, they often give rise to immeasurable and diverse conflicts domestically, regional and at global level. This had led to efforts to improve the rules of the International Chamber of Commerce and improve legal models that provide guidance to di- verse nations. -

Philosophy of Science and Philosophy of Chemistry Jaap van Brakel Abstract: In this paper I assess the relation between philosophy of chemistry and (general) philosophy of science, focusing on those themes in the philoso- phy of chemistry that may bring about major revisions or extensions of cur- rent philosophy of science. Three themes can claim to make a unique contri- bution to philosophy of science: first, the variety of materials in the (natural and artificial) world; second, extending the world by making new stuff; and, third, specific features of the relations between chemistry and physics. Introduction Chemistry is unique and distinguishes itself from all other sciences, with respect to three broad issues: • A (variety of) stuff perspective, requiring conceptual analysis of the notion of stuff or material (Sections 4 and 5). • A making stuff perspective: the transformation of stuff by chemical reaction or phase transition (Section 6). • The pivotal role of the relations between chemistry and physics in connection with the question how everything fits together (Section 7). All themes in the philosophy of chemistry can be classified in one of these three clusters or make contributions to general philosophy of science that, as yet , are not particularly different from similar contributions from other sci- ences (Section 3). I do not exclude the possibility of there being more than three clusters of philosophical issues unique to philosophy of chemistry, but I am not aware of any as yet. Moreover, highlighting the issues discussed in Sections 5-7 does not mean that issues reviewed in Section 3 are less im- portant in revising the philosophy of science. -

A Symposium: Morality Reconsidered David Hume and the Origin of Modern Rationalism Donald Livingston Emory University In “How Desperate Should We Be?” Claes Ryn argues that “morality” in modern societies is generally understood to be a form of moral rationalism, a matter of applying preconceived moral principles to particular situations in much the same way one talks of “pure” and “applied” geometry. Ryn finds a num- ber of pernicious consequences to follow from this rationalist model of morals. First, the purity of the principles, untainted by the particularities of tradition, creates a great distance between what the principles demand and what is possible in actual experience. The iridescent beauty and demands of the moral ideal distract the mind from what is before experience.1 The practical barriers to idealistically demanded change are oc- cluded from perception, and what realistically can and ought to be done is dismissed as insufficient. And “moral indignation is deemed sufficient”2 to carry the day in disputes over policy. Further, the destruction wrought by misplaced idealistic change is not acknowledged to be the result of bad policy but is ascribed to insufficient effort or to wicked persons or groups who have derailed it. Maxwell launched a ferocious attack on B.C. van Fraassen's view of science called Con- structive Empiricism (CE). This attack has been totally ignored. Must we con- clude from this silence that no defence is possible against the attack and that a fortiori Maxwell has buried CE once and for all, or is the attack too obviously flawed as not to merit exposure? We believe that neither is the case and hope that a careful dissection of Maxwell's reasoning will make this clear. This dis- section includes an analysis of Maxwell's `aberrance-argument' (omnipresent in his many writings) for the contentious claim that science implicitly and per- manently accepts a substantial, metaphysical thesis about the universe. This claim generally has been ignored too, for more than a quarter of a century. Our con- clusions will be that, first, Maxwell's attacks on CE can be beaten off; secondly, his `aberrance-arguments' do not establish what Maxwell believes they estab- lish; but, thirdly, we can draw a number of valuable lessons from these attacks about the nature of science and of the libertarian nature of CE. In his most important writing in this field called "Politics", Aristotle classified authority in the form of two main parts: the correct authority and moose authority. In this sense, correct forms of government are 1.basileus, 2.aristocracy and 3.politeia. These forms of government are based on the common good. Bad or moose forms of government are those that are based on the property of an individual or small governmental structures and they are: 1.tiranny, 2.oligarchy and 3.democracy. Also, Aristotle's political thinking is not separate from the ethical principles so he states that the government should be reflected in the true virtue that is "law" or the "golden mean". CHAPTER FIVE THE PHENOMENOLOGY AND ‘FORMATIONS OF CONSCIOUSNESS’ It is this self-construing method alone which enables philosophy to be an objective, demonstrated science. (Hegel 1812) Immanuel Kant was born in 1724, and published “Religion within the limits of Reason” at the age of 70, at about the same time as the young Hegel was writing his speculations on building a folk religion at the seminary in Tübingen and Robespierre was engaged in his ultimately fatal practical experiment in a religion of Reason. Kant was a huge figure. Hegel and all his young philosopher friends were Kantians. But Kant’s system posed as many problems as it solved; to be a Kantian at that time was to be a participant in the project which Kant had initiated, the development of a philosophical system to fulfill the aims of the Enlightenment; and that generally meant critique of Kant. We need to look at just a couple of aspects of Kant’s philosophy which will help us understand Hegel’s approach. “I freely admit,” said Kant , “it was David Hume ’s remark [that Reason could not prove necessity or causality in Nature] that first, many years ago, interrupted my dogmatic slumber and gave a completely differ- ent direction to my enquiries in the field of speculative philosophy” (Kant 1997). Hume’s “Treatise on Human Nature” had been published while Kant was still very young, continuing a line of empiricists and their rationalist critics, whose concern was how knowledge and ideas originate from sensation. Hume was a skeptic; he demonstrated that causality could not be deduced from experience. -

The Relation of History of Science in the Structure of Scientific
The Relation of History of Science to Philosophy of Science in The Structure of Scientiªc Revolutions and Kuhn’s later philosophical work Vasso Kindi University of Athens In this essay I argue that Kuhn’s account of science, as it was articulated in The Structure of Scientiªc Revolutions, was mainly defended on philosophical rather than historical grounds. I thus lend support to Kuhn’s later claim that his model can be derived from ªrst principles. I propose a transcendental reading of his work and I suggest that Kuhn uses historical examples as anti-essentialist Wittgensteinian “reminders” that expose a variegated land- scape in the development of science. T. S. Kuhn was a physicist who became a historian, but who also wrote a book, the Structure of Scientiªc Revolutions (1970),1 that proved seminal in philosophy of science. In that book, unlike what was typical in philosophy of science before the so-called historical turn, there are quite a few refer- ences to particular cases from the history of science. After the Structure, and all the praise and controversy that it evoked, Kuhn published Black- Body Theory and Quantum Discontinuity (1987), a book of history of science. The question that repeatedly arose was: what is the relation of Kuhn’s phi- losophy of science to the history of science? He was asked, for example, whether the Black-Body book exhibited the pattern of development that was elaborated in the Structure. His commentators wanted to know whether the facts pertaining to quantum theory provided conªrmation for his philosophical model, whether they could serve as a testing ground, but also, whether his account of these particular facts was shaped by his philo- sophical model.
