We urge you to protect this deduction—a unique and cherished incentive for Americans to invest directly in important community needs. The nonprofit sector plays a central role in the social and economic vitality of the Commonwealth of Massachusetts. Our organizations educate and keep the citizenry healthy; care for the most vulnerable populations; and preserve the state’s cherished historical, cultural and environmental resources. Nonprofits employ 16.7% of the workforce, or nearly 500,000 Massachusetts residents, and are responsible for $250 billion in annual revenues. Congress codified the strong American tradition of giving back to our communities in the tax code nearly a century ago, when it provided for deductions on charitable contributions in the Revenue Act of 1917. -

Congressional offices are overwhelmed with the significant increase in volume and the diversity of delivery methods used by advocate organizations. On the other hand, citizens and the advocacy community have been frustrated by the myriad of technological tools utilized by offices to authenticate that actual constituents are sending messages, yet result in technological and “user interface” obstacles to communications. -

New Congress, Same “Committee Tax” How the parties pressured legislative leaders to raise huge sums of campaign cash during the 116th Congress — and are poised to do so again this year By Amisa Ratliff One of the open secrets of Washington is that both the Democratic and Republican parties strong-arm influential legislators to raise astronomical amounts of campaign cash. Referred to as paying “party dues,” lawmakers are pressured to transfer huge sums from their campaigns and affiliated PACs to the parties as well as spend countless hours “dialing for dollars” to raise six- and seven-figure amounts for the parties, often by soliciting corporations, labor unions, and other special interests that have business before Congress. Most Corrupt: Representative Maxine Waters
MOST CORRUPT: REPRESENTATIVE MAXINE WATERS Representative Maxine Waters (D-CA) is an eleven-term member of Congress, representing California’s 35th congressional district. She is a senior member of the House Financial Services Committee. Rep. Waters’ ethics issues stem from a meeting she arranged between officials at the Department of Treasury and OneUnited Bank, a bank with which she has financial ties. In August 2010, an investigative subcommittee of the House Ethics Committee issued a Statement of Alleged Violation charging Rep. Waters with three counts of violating House rules and ethics regulations in connection with her actions regarding OneUnited. Later that year, however, the committee indefinitely postponed a scheduled ethics trial, citing the discovery of new evidence.1 In addition, news reports raised other questions about the conduct of the committee and its investigators during the Waters investigation, prompting an internal investigation that is still ongoing.2 Rep. Waters was included in CREW’s 2005 and 2006 congressional corruption reports for unrelated matters, and in CREW’s 2009 congressional corruption report for her actions regarding OneUnited.3 Intervention Between OneUnited and Treasury Officials Rep. Waters has close financial ties to OneUnited Bank, one of the largest black-owned banks in the country.4 In March 2004, she and her husband, Sidney Williams, each separately bought OneUnited stock worth between $250,001 and $500,000.5 Additionally, Mr. Williams maintained separate holdings at OneUnited worth between $250,001 and $500,000. In September 2004, Rep. We appreciate the Committee holding the hearing on this important matter. Our coalition represents every part of the U.S. economy including manufacturers, farmers and agribusinesses, retailers, technology companies, service suppliers, natural gas and oil companies, importers, exporters, and other supply chain stakeholders. Collectively, we support tens of millions of American jobs through our vast supply chains. We agree that our trading partners must abide by global trade rules, but the Administration must also pursue its trade policies in a manner that best serves the American economy. Accordingly, we support the Administration’s efforts to address China’s unfair trading practices, including intellectual property violations, forced technology transfer, market-distorting subsidies, and more. We also appreciate the progress made by the “Phase One” agreement with China and the lifting of a small number of tariffs on Chinese imports. Nevertheless, we object to the unconventional and unpredictable methods the Administration has used – and Congress has allowed – to achieve those goals. The Section 301 tariffs have sown uncertainty in the world’s economy and mistrust with trading partners. -

The Breadth of Congress’s Authority to Access Information in Our Scheme of Separated Powers Overview Congress’s broad investigatory powers are constrained both by the structural limitations imposed by our constitutional system of separated and balanced powers and by the individual rights guaranteed by the Bill of Rights. Thus, the president, subordinate officials, and individuals called as witnesses can assert various privileges, which enable them to resist or limit the scope of congressional inquiries. These privileges, however, are also limited. The Supreme Court has recognized the president’s constitutionally based privilege to protect the confidentiality of documents or other information that reflects presidential decision-making and deliberations. This presidential executive privilege, however, is qualified. Congress and other appropriate investigative entities may overcome the privilege by a sufficient showing of need and the inability to obtain the information elsewhere. Moreover, neither the Constitution nor the courts have provided a special exemption protecting the confidentiality of national security or foreign affairs information. But self-imposed congressional constraints on information access in these sensitive areas have raised serious institutional and practical concerns as to the current effectiveness of oversight of executive actions in these areas. With regard to individual rights, the Supreme Court has recognized that individuals subject to congressional inquiries are protected by the First, Fourth, and Fifth Amendments, though in many important respects those rights may be qualified by Congress’s constitutionally rooted investigatory authority.
