VETERINARY MEDICINE BUILDING The Vice President, Business Administration, reported for the information of the Board, the filing of a request with the Commissioner of Administration for an allocation of $100,000 from the Higher Education Facilities Contingent Account to supplement the appropriation made by the 1965 Legislature in the amount of $900,000 to construct and equip a veterinary medicine building.

LEGISLATIVE BUILDING REQUESTS Dean Rodney A. Briggs, University of Minnesota, Morris and Dean Sherwood 0. Berg, Institute of Agriculture reviewed the Ten-Year Building Program for the University of Minnesota, Morris and the West Central School and Station. Voted further to approve the principle of 25% equity funding of dormitory construction on the Morris Campus. This gift is in the form of a cancellation of the University's promissory note dated December 13, 1963 and payable December 13, 1966. The President reported for the information of the Board, the completion of cataloguing of a significant addition to the Kerlan Collection in the University Library which was received from the estate of the late Dr. Irvin Kerlan.

If accepted, the gift would become effective on July 1, 1966, and the MacPhail College of Music would cease to exist as a corporate enterprise offering music instruc- tion and degree programs after September 1, 1966. The functions and activi- ties now being carried on by the MacPhail School Division will continue initially under the same faculty at the same location. CONSTITUTION AND BY-LAWS-MEDICAL SCIENCES Voted, at the request of the faculty of the College of Medical Sciences and the Dean of the College and on the recommenda- tion of the Vice President, Business Administration, the Vice President, Academic Administration, and the President, to ap- prove the Constitution and By-Laws of the College of Medical Sciences with the understanding that the methods of liaison be- tween the College and groups outside the University should be incorporated in an amendment to these documents either separ- ately or as a part of the By-Laws, Article 111, Section C2, Educa- tional Policy Committee and with the further understanding that the By-Laws, Article 111, Section E, Advisory Council and sub- sequent references would be changed to read "Faculty Advisory Council" for purposes of clarity. Voted further to amend the wording in the Statement of Policy and Implementing Resolution Concerning Private Consul- tation Practice in the College of Medical Sciences adopted on June 15, 1963 and September 20, 1963 to be in harmony with the wording of the above Constitution and By-Laws as follows: 1. The penultimate sentence in the final paragraph of the Statement of Policy should read, "Expenditures from accounts established for the support of college-wide activities will be administered by the dean with the advice of the Committee on Private Practice Activity." 2. The second sentence of paragraph 4 of the Implementing Resolu- tion should read: "Four additional members of the faculty of clini- cal departments shall be elected by the vote of the Executive Fac- ulty of the clinical departments of the Medical School. CONSTITUTION-COLLEGE OF LIBERAL ARTS Voted, at the request of the faculty of the College of Liberal Arts and the Dean of the College and on the recommendation of the Vice President, Academic Administration, and the President, to approve the Constitution of the College of Liberal Arts with the understanding that the Dean of the College will submit a statement of the purpose or mission of the College to the Board at a subsequent meeting. EMPLOYEES UNION The Vice President, Business Administration, reported the receipt of a summons and complaint filed in District Court against the Regents by the University of Minnesota Employees Union, an unincorporated labor association, Alois Klick and Ernest Degraff as Plaintiffs. Regent Mayo, Chairman of the Labor Committee reported that the Labor Committee and Regent Montague had considered the above matter at a meeting of the committee held on March 10, 1966. At the request of the chairman, Regent Montague made the following statement: "Members of the Board have been furnished copies of the Summons and Complaint in the recent action by the University of Minnesota Em- ployees Union and certain individual employees against the Regents in connection with the life insurance, hospital and medical benefits problem. At the last Session of the Legislature, the University representatives stron ly urged that the Legislature include University employees and make suita%le provision for carrying out this plan. The Bills in both the House and the Senate, as introduced, specifically excluded all employees of the University nor were they included in the Bill as passed. The language of the Act makes clear that it is applicable only to "Regular En~ployeesin the Classified Service of the State Civil Service and Paid on the State Pay- roll." The title to the Act is similarly limited. It is therefore clear that the Legislature did not intend to include and did not include University em- ployees in the Act. I am sure that at the next Session of the Legislature we will review our efforts to have the University employees included in the State plan. Even the provision in the Act for permitting the Administrative Board to include additional members clearly contemplates that this be done without expense to the State, that is, at the expense of the additional employees included. The employees in this case, however, attempt to secure judgment of the court that the University must install this service despite the refusal of the Legislature to include the University. I think it advisable that the University employ counsel to defend this case. I also think there may be some questions that may arise that would require consideration by a special committee. I therefore move that the Administration be authorized to employ special counsel to appear for the University in the case. I further move that an ad hoc committee be appointed by the Chairman to keep in touch with the counsel thus em- ployed and with power to act for the Board." Voted, on the recommendation of the Labor Committee and Regent Montague, to authorize the appropriate administrative oflicers to retain special counsel to appear for the University in the above case. Voted further to instruct the Chairman to appoint an ad hoc committee to keep in touch with the counsel retained with the understanding that the committee will have the power to act for the Board in this matter. The Chairman appointed the following to serve on the ad hoc committee concerning the legal action brought by the Univer- sity of Minnesota Employees Union: Regents Gainey, Hartl, Hess, Hughes, Mayo, Montague, and Silha.
