Prevention and Protection from Huma Trafficking

Accomplishments

1. Provide brief information comparing actual accomplishments with the goals and objectives established for the period. Accomplishments

At the beginning of the project, GPS could successfully prepare for the recruitment of the staffs, TOT training and organizing of the awareness raising trainings in the refugee camps.

In July and August 2017, GPS could recruit the staffs, bought the office accessories and started to communicate with the local CSOs from , Northern to be able to organize the Human Trafficking Prevention TOT training and to be able to help the court cases. GPS contacted with Northern Shan State Women Organization Network – WON, Ta’ang Women Organization – TWO, Tai Youth Organization – TYO, Kachin Women Association Thailand - KWAT and Northern Shan Kachin Youths to be able to organize the Human Trafficking Prevention TOT training in Lashio. The director went to Lashio from 1st August to 4th August 2017 and met with these organizations. These organizations could help recruit the trainees and in logistic.

When contacting to Equality , the trainers from them will be available only in October 2017. So GPS decided to hire the TOT trainer from Mawk Kon Organization based in Eastern Shan State which is also the grantee of PRLP. They first said they will be available at the last week of August 2017. So GPS set the date for TOT in the last week of August 2017 but later they said they will be available on at the last week of September since they will have to prepare for the Anti-Human Trafficking Day on 13th September 2017. So GPS contacted with WON (Women Organization Network) and set the dates for the TOT training to be from 11th September to 16th September 2017. After that, GPS has planned to organize two Human Trafficking Prevention Trainings in Ta’ang camp from 23rd to 25th September 2017. Now GPS could organized the TOT training successfully from 15th September to 20th September 2017. Although it was previously planned to organize it from 11th Sept to 16th Sept 2017, TOT trainer from Northern Shan State-WON had the minor operation so it had to be postponed to 15-20 Sept 2017. There was the Prevention of Human Trafficking and Legal TOT Training from 15th Sept to 20th Sept 2017 in the Training Hall of Northern Shan State Women Organization Network (NSS-WON) office, Lashio, Northern Shan State.

Participants There were 20 participants in this training. 6 Ta’ag invited by Ta’ang Women Organization - TWO 5 Kachin invited by NET 4 Shan and 1 Barman invited by Tai Youth Organization - TYO 2 Shan, 1 Lisu and 1 Lahu invited by Northern Shan State WON All the participants were youths between the age of 20 and 30 and had at least High School Education. About half were from the local CSOs and all of them were activists in the regions.

TOT Trainers

From 15th to 17th, the TOT trainer from WON took care of the training. On other days, a trainer who used to work in Oxfam’s gender department, the legal officer of GPS and the project coordinators of GPS were facilitating the trainings. The project In-charge was there and also helped the training. At the end of the TOT training, 6 trainers for three communities (Shan, Kachin and Ta’ang) could be selected and a draft module for the Human Trafficking Prevention and Legal training to be organized in the camps.

Court Representation

For the Court Representation for the Human Trafficking case, in mid-August, Northern Shan State Women Organization Network brought a case. In which over 10 kids from Hseni Township were brought by a woman to China for work in 2016 and they were home in 2017 but they did not get any salaries from the Chinese boss. When they asked to the boss, he said the woman took all the salaries already. When asked, the woman said she did not know anything. So the kids and their parents wanted to prosecute the broker woman. GPS decided it will need more detail information. So GPS planned to talk about it on the monitoring trip of the Assistant Project Coordinator (Legal) in September 2017. From 18th Sept to 19th Sept 2017, the assistant coordinator (Legal) went to Lashio, Northern Shan State as the monitoring trip. She met with the above clients in Lashio and discussed about this case. She met them twice and they agreed that the assistant coordinator will develop the case and open it on 26th September 2017 and the project coordinator will have to take care of it with the clients. But after developing all documents needed, when the coordinator called to the clients to go on the process, the clients said that their relatives have been involved in this case and because of their request, they decided not to go on the case. Although the coordinator kept encouraging them to do, they also kept refusing.

GPS’s Assistant Coordinator (Legal) talked with the local lawyers and one of the lawyers has brought Human Trafficking case to GPS. So the Assistant Coordinator (Legal) talked with the responsible Police Officer for the case. In this case, a girl was trafficked to China by two traffickers. The case was already filed on 17th October 2017.

GPS started to talk with the Thinking Classroom Foundation – TCF and Democratic Education Corner – DEC for the Critical Thinking training. After that, GPS and DEC set the training date to be from 1st to 3rd October 2017.

In September, October and November 2017, GPS could organize the critical thinking training for its staffs. It was from 1st September to 3rd September 2017 in GPS main office. The trainer was from Democratic Education Corner – DEC and used to be with TCF (Thinking Classroom Foundation). There were 25 participants in it and 9 were women.

There were 6 Human Trafficking Prevention trainings in three refugee camps of Northern Shan State. There were 2 trainings in Gonegyan camps (Ta’ang Camps), Township, Northern Shan State from 22nd September to 24th September 2017; 2 trainings in Monesee camps (Kachin Camps), , Northern Shan State from 11th October to 13th October 2017. 2 trainings in Zutaung camp (Kachin Camps), Kutkai Township, Northern Shan State from 16th October to 18th October 2017. There were 180 participants in these trainings and 129 were females; 51 were males. Respective ethnic trainers took care of the trainings.

In December 2017 and January, February 2018, there were 6 Human Trafficking Prevention trainings in three refugee camps of Northern Shan State. There were 2 trainings in Miyulay camps (Ta’ang Camps), Kutkai Township, Northern Shan State from 20th – 22nd Oct 2017; 2 trainings in Nay Won Ni camp (Ta’ang Camp), Namhkam Township, Northern Shan State from 24th – 26th October 2017. 2 trainings in KBC camp (Kachin Camps), Kutkai Township, Northern Shan State from 30th October to 1st November 2017. There were 180 participants in these trainings and 135 were females; 45 were males. Respective ethnic trainers took care of the trainings.

In March, April and May 2018, there were 6 Human Trafficking Prevention trainings in three refugee camps of Northern Shan State. There were 2 trainings in Khantein Shan Camp, Hseni Township, Northern Shan State from 14th – 16th March 2018; 2 trainings in Kaunglauk Sauk Shan Camp, Hseni Township, Northern Shan State from 18th – 20th March 2018; 2 trainings in Kaungkaw Shan Camp, Hseni Township, Northern Shan State from 22nd – 24th March 2018. There were 180 participants in these trainings and 127 were females; 53were males. Respective ethnic trainers (Shan) took care of the trainings.

In June 2018, GPS went to the Northern Shan State as the last monitoring trip in which, GPS more focused on the follow up activities of the trainees of the Anti-human trafficking trainings and also monitored about the court representation cases.

Findings

If applicable, the Grantee shall immediately notify PRLP of developments that have a significant impact on the award-supported activities. Notification should be given in the case of problems, delays, or adverse conditions which materially impair the ability to meet the objectives of the award. This notification shall include a statement of the action taken or contemplated, and any assistance needed to resolve the situation.

Findings

- When talking with the local CSOs, GPS had to realize that they need more Human Trafficking Prevention Training in the villages of the areas more than in the Refugee Camps. The reason they told us was the human trafficking problems have been huge in their areas since decades ago. And they also said they need more support in providing safe-houses including health (Mental & Physical) care, reunion with the families and vocational trainings. - Another problems GPS saw was the busy schedules of the TOT trainers so GPS could not organize the TOT training in the Milestone B period. - Since the survivors of the Human Trafficking were so afraid so they did not want to prosecute the Human Traffickers. Some did not want to disclose their disappointing experiences. So to find the Human Case to provide the court representation was hard at first. - In the camp trainings, almost all the time the first language used was their native language. - They were very interested in the training topic, Human Trafficking Prevention issue but not very much in legal matters. - After they realized about what the Human Trafficking is, they expressed that they had many Human Trafficking Problems but they did not dare to file the cases because of the fear. - The evaluation forms and the Pre-test, Post-test were so difficult for them because of the language barriers and their education level. - The Anti-human trafficking polices have asked help from GPS to help their court representation cases.

- The officers from Social Welfare Department have also asked help from GPS for their safe- house. - Above authorities were very willing to cooperate with GPS. . - The trainees were a bit frustrated about the training period. They thought it was short.

Sustainability

GPS staffs had got the knowledge about the human trafficking trainings and the pretty good modules for the trainings. GPS had also got the local ethnic trainers for the anti-human trafficking. So whenever there was the need of the local people, GPS was ready to send its trainers to them to provide the training. GPS still had the project to provide the civic education to the refugees in the Northern Shan State and had other project in which there was the plan to provide the kinds of trainings. So GPS could include some knowledge about the human trafficking in these trainings. The alumni of the anti-human trafficking trainings and the local ethnic trainers could help their neighbors who were in danger of human trafficking.

GPS could have the good relation with the Anti-trafficking Police and DSW. GPS also could have the good lawyers who could help in the court representations for the victims of human trafficking. Whenever there were some needs of the local people about the human trafficking, GPS could approach the authorities to help the victims of human trafficking.

To reduce the number of Human Trafficking victims in Myanmar. The people must have the basic knowledge about the Human Trafficking so that they themselves can avoid the risks and they can help the victims of the Human Trafficking.

According to this project, GPS could provide a TOT about the Human Trafficking in which 20 trainers from three ethnic communities could be generated. They have become ready to be the trainers to distribute the knowledge about the Human Trafficking in their respective communities. Among them, GPS could select 6 trainers for its coming Awareness Raising Trainings about Human Trafficking, 2 from each ethnic, Shan, Kachin and Ta’ang.

After that, GPS could provide 18 Awareness Raising Trainings about Human Trafficking in 9 refugee camps in Northern Shan State, 3 camps from each ethnic and 2 trainings in each camp. So the refugees who were mainly the grass-root people from the very remote rural areas could have the knowledge about what the human trafficking is, what legal protection they could get when they were trafficked and the relation between Human Rights and the Human Trafficking.

GPS could provide the knowledge about human trafficking to 391 women and 149 men from the refugees camps in Northern Shan State. They realized what the real human trafficking were and they dared to speak out about their experiences about the human trafficking by themselves or their neighbors. But they still had the fear to report these cases to the respective authorities although GPS encouraged them to do so.

They had the fear because in some cases, their relatives were involved in the process although they did not take any money. Actually their relatives were just trying to help the victims to get jobs in other countries, in this case, China. But they thought that their relatives would be in trouble along with the traffickers if they report the case to the police. Although GPS explained them that their relatives could be free of prosecution if they did not take any money from the process, they were still worried. But, in reality, in some cases, some innocent people also had to be prosecuted because of the mismanagement of the police.

They also had the fear because in many cases, the powerful people, from government or local armed groups were involved in the process. That was the huge obstacle for them to report the cases. That was beyond the reach of GPS and GPS just talked about this issues when meeting with the local Anti-human trafficking police.

The big challenge of providing the trainings in the camps was the arm-conflict situation in the area. GPS had to be very cautious about it in the whole project period. GPS had to organize the trainings when there was a bit peaceful situation in the area. GPS had to wait for a long time to provide the rest 6 trainings after providing the first 12 trainings because of the battles broken out again in the area. Actually, there were some battles near the camps even when GPS was providing the trainings. There was the bombing in Lashio in the project period.

Luckily, there were not the GPS staffs at this time. But just after it, GPS had to go to the area for the monitoring.

GPS could also help 10 court representation cases regarding the human trafficking. All beneficiaries were women and there were 13 women. In all cases, the women were sold out to China for unofficial marriage, 3 were from the area; 5 were from Rakhaing State and 6 from Yangon Region. The Chinese men just married them just to get the male kids and after delivering the kids, they were sold out to other Chinese men. In almost all cases, not all the traffickers were arrested, some were arrested and some were still fleeing. Among the cases, one was finished with the sentence to the trafficker to be imprisoned for 10 years.

By running this project, GPS could meet with many authorities who were from Anti-human trafficking sectors and Department of Social Welfare and could establish the good relation with them. But in Muse, Northern Shan State, there was a bit argument between the Anti- human trafficking police department and the District Court. So there was a bit difficulties for the lawyers in representation at court. But it had become fine at the end. When one of the GPS staff went to one village where the female victim lived and to take her agreement to represent her case, there was battle broken out near this village and this staff was trapped there for three days.

Nang Moe Kham who had to be the trainer in the Ta’ang camps told GPS that, “This kind of training is very good and necessary for the local people because they have to rely on going and working in China and there were a lot of human traffickers at the China-Burma border. What I want to suggest is that GPS should provide this kind of training not only in the camps but also in the villages of Northern Shan State because the grass-root people in this area were very poor and have not the proper knowledge about the migration and human trafficking although they have to go and work in China.”

Ma Lu Lu Saung from Monesee Kachin Camp said that, “This training is very good for me. I had to know what the human trafficking really is. According to my experience from my village, there have been many human trafficking cases in my villages. I will share the knowledge got from the training to them. But I am not very sure they will be able to report their cases to the police. Anyway, I will try to encourage them. If we need help, I will contact GPS and please help us.”

Ma Tin Tin Latt, who was about to be trafficked to China and GPS is helping her court representation case, told GPS that “My friend and I are so surprised that your organization is about to help us. We thought our case is very small so nobody will care about and help. Let me say “Thank You”. Actually, we really didn’t know we were about to be trafficked until the police stopped us. On the other hand, we are very poor so we had to follow this lady.”
