SUMMARY OF LEGISLATION BAILIWICK OF JERSEY 1 January–30 April 2016

1. LAWS ADOPTED BY THE STATES (a) Planning and Building (Amendment No 7) (Jersey) Law 201- (P.142/2015—adopted in 3rd reading, 19.1.16) This Law renames the Planning Applications Committee as the Planning Committee and makes miscellaneous other amendments in relation to planning and building procedures. (b) Road Works and Events (Jersey) Law 201- (P.152/2015—adopted in 3rd reading, 20.1.16) This Law establishes a cohesive system for the purpose of regulating road works and events involving highway authorities, utility companies and persons organizing events affecting road use. (c) Debt Remission (Individuals) (Jersey) Law 201- (P.153/2015—adopted in 3rd reading, 2.2.16) This Law allows a debt remission order to be made in specified cases where an individual’s debts do not exceed £20,000. (d) Dogs (Amendment No 4) (Jersey) Law 201- (P.157/2015—adopted in 3rd reading, 2.2.16) This Law gives police officers the power to seize any dog believed to be dangerously out of control and creates a new offence against such a dog’s owner. (e) Financial Regulation (Miscellaneous Provisions No 3) (Jersey) 201- (P.162/2015—adopted in 3rd reading, 23.2.16) This Law makes amendments relating to revocation of registrations on request, the withdrawal of directions, the definitions relating to shareholding, the provision of reports by professionals and the widening of the scope of communication afforded protection when disclosed. (f) Children’s Property and Tuteurs (Jersey) Law 201- (P.156/2015—adopted in 3rd reading, 12.4.16) This Law makes provision for the appointment and duties of tuteurs and empowers the Royal Court to give directions regarding a minor’s property, whether or not a tuteur has been appointed in relation to the property. (g) Aircraft Registration (Amendment) (Jersey) Law 201- (P.7/2016—adopted in 3rd reading, 12.4.16)

This Law makes provision so that the restrictions on an aircraft becoming registered will also apply to the continuation of the registration of the aircraft. (h) Animal Health (Jersey) Law 201- (P.17/2016—adopted in 3rd reading, 12.4.16) This Law establishes a new framework for the control of diseases in animals and birds. (i) Intellectual Property (Plant Varieties) (Jersey) Law 201- (P.20/2016—adopted in 3rd reading, 12.4.16) This Law establishes a scheme for the registration of new plant varieties which is required for compliance with the World Trade Organization agreement on Trade-Related Aspects of Intellectual Property Rights and the Acts of the International Union for the Protection of New Varieties of Plants. (j) Draft Extradition (Amendment) (Jersey) Law 201- (P.26/2016—adopted in 3rd reading, 26.4.16) This Law amends the Extradition (Jersey) Law 2004 so as to bring it in line with changes made by the United Kingdom to its legislation concerning extradition.

3. APPOINTED DAY ACTS (a) Dentistry (Jersey) Law 2015 (Appointed Day) Act 2016 (R&O.22/2016—in force 23.2.16) Whole Law brought into force on 24th February 2016.

4. REGULATIONS MADE BY THE STATES (a) Policing of Roads (Amendment No 9) (Jersey) Regulations 2016 (R&O.5/2016—in force 26.1.16) These Regulations allow the Connétables to appoint authorized persons to enforce the Policing of Roads (Jersey) Regulations 1959 by making it an offence for any person to fail to give his or her name and address if asked by an authorized person who believes the person has contravened those Regulations. (b) Health and Safety (Management in Construction) (Jersey) Regulations 2016 (R&O.13/2016—in force 1.10.16) These Regulations set out detailed requirements for ensuring health and safety in the construction industry by requiring risks to be systematically identified and controlled. (c) Taxation (Implementation) (International Tax Compliance) (United States of America) (Amendment) (Jersey) Regulations 2016 (R&O.23/2016—in force 1.3.16) These Regulations introduce civil penalties in place of the existing criminal offences for breach of the Taxation (Implementation) (International Tax Compliance) (United States of America) (Jersey) Regulations 2014 which they amend. (d) Taxation (Implementation) (International Tax Compliance) (United Kingdom) (Amendment) (Jersey) Regulations 2016 (R&O.24/2016—in force 1.3.16) These Regulations introduce civil penalties in place of the existing criminal offences for breach of the Taxation (Implementation) (International Tax Compliance) (United Kingdom) (Jersey) Regulations 2014 and amend those Regulations to take account of the requirements of the Taxation (Implementation) (International Tax Compliance) (Common Reporting Standard) (Jersey) Regulations 2016. (e) EU Legislation (Veterinary Checks—Imports from Third Countries) (Jersey) Regulations 2016 (R&O.32/2016—in force 22.4.16) These Regulations implement Council Directive 91/496/EEC of 15 July 1991 laying down the principles governing the organization of

veterinary checks on animals entering the Community from third countries. These Regulations do not apply to family pets transported for non-commercial purposes. (f) EU Legislation (Veterinary and Zootechnical Checks—Trade with Member States) (Jersey) Regulations 2016 (R&O.33/2016—in force 22.4.16) These Regulations implement Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in live animals and certain animal products with a view to the completion of the internal market. (g) Pet Travel Scheme (Amendment No 2) (Jersey) Regulations 2016 (R&O.41/2016—in force 19.4.16) These Regulations give further effect to Regulation (EU) No 576/2013 of 12 June 2013 on the non-commercial movement of pet animals in particular by making it an offence for any person to bring into Jersey a dog, cat or ferret in breach of the EU Regulation. (h) EU Legislation (Aquatic Animal Health) (Jersey) Regulations 2016 (R&O.42/2016—in force 26.4.16 except Regulation 3(1) in force 24.5.16 and Regulation 10(1) in force 12.7.16) These Regulations replace the Fish Health (Jersey) Regulations 1999 to implement Council Directive 2006/88/EC and related EU legislation by imposing restrictions on placing aquaculture animals on the market, making certain diseases notifiable and providing designated areas around suspected outbreaks of disease. (i) Education (Provided Schools—Amendment of Law) (Jersey) Regulations 2016 (R&O.49/2016—in force 31.8.16) These Regulations amend the Education (Jersey) Law 1999 to change the name of Preparatory School to “Jersey College Preparatory School” and delete the entry relating to St. James’ School from the list of provided schools in that Law. (j) Protection of Children (Nicotine Inhaling Products) (Jersey) Regulations 2016 (R&O.50/2016—in force 3.5.16) These Regulations prohibit the supply of nicotine inhaling products (including “e-cigarettes”), and their component parts to persons under the age of 18 years. 5. BAILIWICK OF GUERNSEY 1 January–30 April 2016 A. GUERNSEY 1. LAWS APPROVED BY THE STATES OF DELIBERATION (a) Firearms (Guernsey) (Amendment) Law 2016 (Billet d’État No I of 2016. Approved 26.01.16) This Law amends the Firearms (Guernsey) Law 1998 by creating a number of additional prohibitions on the possession of, and new offences relating to, firearms and imitation firearms. The Law also inserts provisions into the 1998 Law which create additional powers for the police and the courts when dealing with firearms offences and investigations into alleged offences. (b) Social Insurance (Guernsey) (Amendment) Law 2016 (Billet d’État No I of 2016. Approved 26.01.16. In force 04.04.16) This Law amends the definition of pensionable age for the purposes of the Social Insurance (Guernsey) Law 1978 and the Health Service (Benefit) Ordinance 1990. The amendment provides for a graduated increase in pensionable age from 65 years (in respect of persons born before 1 January 1955) to 70 years (in respect of persons born on or after 1 March 1979). (c) Population Management (Guernsey) Law 2016 (Billet d’État No VI of 2016. Approved 02.03.16) This Law repeals the Housing (Control of Occupation) Guernsey Law 1994 and the Right to Work (Limitation and Proof) (Guernsey) Law 1990 and related legislation and creates a population management regime to replace the housing control and right to work regimes. Part 1 of the Law establishes the office of the Administrator of Population Management and sets out a hierarchy of strategic objectives and population policies of the States, and of the Committee for Home Affairs, of which the office holder must take account when exercising his or her functions under the Law. Subsequent Parts of the Law define Permanent Residents, Established Residents and Open Market Residents; make provision in respect of the issue, variation and revocation of Resident Certificates and Resident Permits; define the various classes of Employment Permits and make provision in respect of their grant, variation and revocation; create offences relating to unlawful residence and employment; provide for the imposition of discretionary financial penalties; set out extensive transitional and saving provisions; and make other incidental and consequential provision, including appropriate provisions for appeals.

(d) Open Market Housing Register (Guernsey) Law 2016 (Billet d’État No VI of 2016. Approved 02.03.16) This Law makes provision for the administration of the Open Market Housing Register by the Committee for the Environment and Infrastructure through the enactment of provisions similar to those in Part IV of the Housing (Control of Occupation) Guernsey Law 1994. It also provides for the prescription of a maximum number of dwellings in Part D of that Register; for the temporary maintenance of the inscription of properties that would otherwise be subject to deletion; for the issue of compliance notices; and makes other incidental and consequential provision, including appropriate provisions for appeals against decisions of the administering Committee. (e) Succession to the Crown (Bailiwick of Guernsey) Law 2016 (Billet d’État No VI of 2016. Approved 02.03.16) This Law provides, for the avoidance of any doubt, for the rules governing succession to the Crown in respect of the Bailiwick of Guernsey to be determined in accordance with the law of the United Kingdom relating to succession to the Crown. The Law is intended to ensure that the effect of legislation enacted by Parliament ending the male primogeniture rule (the Crown Succession Act 2013) is reflected in the laws of the Bailiwick. (f) Inheritance (Amendment) (Guernsey) Law 2016 (Billet d’État No VI of 2016. Approved 02.03.16) This Law amends the Inheritance (Guernsey) Law 2011 to provide that parties to a same-sex marriage, which fulfils other criteria such that it would be recognised under Guernsey law if it had been entered into by a man and a woman, will be treated as spouses for the purposes of the Inheritance (Guernsey) Law 2011. (g) Arbitration (Guernsey) Law 2016 (Billet d’État No VI of 2016. Approved 02.03.16) This Law introduces new provision relating to arbitration agreements and proceedings based upon the English Arbitration Act 1996. It repeals current statutory provision relating to arbitration with the exception of that Part of the Arbitration (Guernsey) Law 1982 relating to the enforcement of certain foreign arbitration awards. (h) Designation of Officers (Bailiwick of Guernsey) Law 2016 (Billet d’État No VI of 2016. Approved 02.03.16) This Law empowers the Head of Law Enforcement (who is both the Chief Officer of Police and the Chief Revenue Officer) to designate customs officers and immigration officers as having the powers and privileges of police officers, police officers and immigration officers as having the powers of customs officers, and police officers as having the powers of immigration officers.

(i) Financial Services Commission (Bailiwick of Guernsey) (Amendment) Law 2016 (Billet d’État No VIII of 2016. Approved 02.03.16) This Law makes amendments to the discretionary financial penalties regime set out in s 11D of the Financial Services Commission (Bailiwick of Guernsey) Law 1987.

2. ORDINANCES APPROVED BY THE STATES OF DELIBERATION (a) Control of Trade in Endangered Species etc (Bailiwick of Guernsey) Ordinance 2016 (Billet d’État No I of 2016. Approved 26.01.16—in force on a day to be appointed by Order) This Ordinance replaces the current regime for regulation of the import and export of trade in endangered species (live animals and plants) and products derived from the same, under the import and export legislation applying in Guernsey and . The current import and export controls implemented the Convention on International Trade in Endangered Species (CITES) in the Bailiwick of Guernsey, the UK’s ratification of which was extended to the Bailiwick in 1976. (b) Single Euro Payments Area (Guernsey) Ordinance 2016 (Billet d’État No I of 2016. Approved 26.01.16—in force 27.01.16) This Ordinance is made under ss 1 and 4 of the European Communities (Implementation) (Bailiwick of Guernsey) Law 1994 and implements those provisions of EU/EEA legislation necessary to enable Guernsey to meet the requirements for third country participation in the Single Euro Payments Area. (c) Maternity Leave and Adoption Leave (Guernsey) Ordinance 2016 (Billet d’État No I of 2016. Approved 26.01.16—in force 01.04.16) This Ordinance introduces statutory maternity and adoption leave to Guernsey, and creates associated rights and obligations. (d) Registered Plant Breeders’ Rights (Bailiwick of Guernsey) (Amendment) Ordinance 2016 (Billet d’État No I of 2016. Approved 26.01.16—in force 26.01.16) This Ordinance is made under the Intellectual Property (Enabling Provisions) (Bailiwick of Guernsey) Law 2004. Section 18(7) of the Registered Plant Breeders’ Rights (Bailiwick of Guernsey) Ordinance 2007, also made under that Law, enables the Commerce and Employment Department to make regulations prescribing the information which is to be provided by proprietors of plant breeders’ rights and by farmers and seed processors in respect of farm-saved seed. This Ordinance amends the 2007 Ordinance so as to provide that failure to comply with such regulations is an offence.

(e) Housing (Control of Occupation) (Amendment of Housing Register) Ordinance 2016 (Billet d’État No I of 2016. Approved 26.01.16—in force 01.02.16) This Ordinance is made under the Housing (Control of Occupation) (Guernsey) Law 1994 and authorises the Housing Department to inscribe in Part A of the Housing Register three apartments on the site known as La Salerie Inn Apartments, La Salerie, Saint Peter Port. (f) Income Tax (Guernsey) (Approval of Agreement with Bulgaria) Ordinance 2016 (Billet d’État No I of 2016. Approved 26.01.16—in force 27.01.16) This Ordinance specifies, as an approved international agreement, an agreement providing for the obtaining, furnishing and exchanging of information in relation to tax, made for the purposes of the Income Tax (Guernsey) Law 1975. The agreement specified was made between the States of Guernsey and the Government of the Republic of Bulgaria, signed on 20 May 2015 and 11 June 2015 on behalf of Bulgaria and Guernsey respectively. (g) Milk (Control) (Guernsey) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 01.03.16) This Ordinance is made under the Milk and Milk Products (Guernsey) Law 1955. It repeals and replaces the Milk (Control) (Guernsey) Ordinance 1958 and the Milk (Control) (Guernsey) Ordinance 1967. Amongst other things it provides for a wider definition of milk, updates provisions relating to the supply of milk by farmers to the Dairy to reflect current practices, implements comprehensive prohibitions controlling the distribution, purchase, sale and supply of milk produced in Guernsey and of imported milk and creates a registration system under which distributors with current commercial distribution agreements with the Commerce and Employment Department are registered by the Department. (h) States Reform Law 2015 (Commencement) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 16.02.16) This Ordinance commences the States Reform Law 2015 (see Chapter A1(c) of the summary of legislation for Guernsey for the period 1 September 2015–31 December 2015). Section 1(1) brings most provisions of that Law into force on 16 February 2016. Section 1(2) brings the remainder of the provisions of the Law into force on 1 May 2016, which is the day on which Guernsey’s new States is constituted following the April 2016 General Election. (i) Organisation of States’ Affairs (Transfer of Functions) Ordinance 2016

(Billet d’État No III of 2016. Approved 16.02.16—in force 01.05.16) This Ordinance is made under the Public Functions (Transfer and Performance) (Bailiwick of Guernsey) Law 1991 and transfers the statutory functions of the departments of the States, and of the relevant Ministers and Deputy Ministers of those departments, to the newly constituted committees of the States, and the relevant Presidents and Deputy Presidents of the committees concerned, on 1 May 2016. (j) Environmental Pollution (Designation of Waste Disposal Authority) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 01.05.16) This Ordinance is made under the Environmental Pollution (Guernsey) Law 2004 and designates the States’ Trading Supervisory Board as the Waste Disposal Authority and repeals the current provision, made under that power, designating the Public Services Department as the Waste Disposal Authority. (k) Land Planning and Development (Strategic Land Planning) (Amendment) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 01.05.16) This Ordinance made under the Land Planning and Development (Guernsey) Law 2005 makes amendments to the Land Planning and Development (Guernsey) Law 2005. In particular it implements new arrangements for the Strategic Land Use Plan. (l) Compulsory Acquisition of Land (Guernsey) (Fees and Amendment) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 18.02.16) This Ordinance is made under the Compulsory Acquisition of Land (Guernsey) Law 1949 and makes amendments to that Law and prescribes the fees charged in respect of proceedings before the arbitrators and the umpire in the event that an assessment of compensation is required further to a compulsory purchase order made under the Law. (m) Motor Taxation (First Registration Duty) (Guernsey) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 01.05.16) This Ordinance is made under the Motor Taxation and Licensing (Guernsey) Law 1987 and establishes an obligation to pay motor tax upon the first registration of a motor vehicle (“first registration duty”).

(n) Mental Health (Transfer of Patients) (Guernsey and Alderney) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 17.02.16) This Ordinance clarifies that orders made under the Mental Health (Bailiwick of Guernsey) Law 2010 cease to have effect where the patient is transferred to another country or territory, unless the patient is subject to a restriction order and is being transferred to a jurisdiction outside the British Islands. In addition, the Ordinance expands the definition of “liable to be detained” for the purposes of the 2010 Law to include forensic orders made by a criminal court under Part IX. (o) Income Tax (Guernsey) (Approval of Agreement with British Virgin Islands, Cayman Islands, South Korea and ) Ordinance 2016 (Billet d’État No III of 2016. Approved 16.02.16—in force 24.02.16) This Ordinance specifies the agreements providing for the obtaining, furnishing and exchanging of information in relation to tax, made for the purposes of the Income Tax (Guernsey) Law 1975. The agreements specified are as follows— (a) An agreement made between the States of Guernsey and the Government of the Cayman Islands, and signed on 10 September 2015 and 8 October 2015 respectively. The agreement is a Protocol to a Tax Information Exchange Agreement previously made between the States of Guernsey and the Government of the Cayman Islands in July 2011. (b) An agreement and a Protocol made between the States of Guernsey and the Government of the Republic of Korea and signed on 23 September 2015. (c) An agreement made between the States of Guernsey and the Government of the British Virgin Islands, and signed on 8 October 2015 and 5 November 2015 respectively. The agreement is a Protocol to a Tax Information Exchange Agreement previously made between the States of Guernsey and the Government of the British Virgin Islands in April 2013, and amended in November and December 2014. (d) An agreement made between the States of Guernsey and the Government of the Kingdom of Spain signed on 10 November 2015. (p) Air Navigation (Bailiwick of Guernsey) (Amendment) Ordinance 2016 (Billet d’État No VI of 2016. Approved 02.03.16—in force 08.03.16) This Ordinance is made under the Air Navigation (Bailiwick of Guernsey) Law 2012 and amends the Law to provide for the issue of air operator’s certificates. It enables further provision in relation to the issue of certificates to be made by regulations. It also makes

minor ancillary amendments to the Law to widen the possible range of aircraft registration marks. (q) Aviation Registry (Guernsey) (Amendment) Ordinance 2016 (Billet d’État No VI of 2016. Approved 02.03.16—in force 08.03.16) This Ordinance is made under the Aviation Registry (Guernsey) Law 2013 and amends the Law by repealing s 18 which prohibits Guernsey registered aircraft from being used for the purpose of commercial air transport. It makes minor ancillary changes to the Law to allow the manner in which registration marks are displayed to be amended by regulation and to support the Registry practice in relation to the non-transferability of special marks. It also makes minor amendments to the Aircraft Registry (Interests in Aircraft) (Guernsey) Ordinance 2015 which are necessary for typographical consistency and to enable the Ordinance to be amended by regulations in order to give further effect to the Cape Town Convention (the Convention on International Interests in Mobile Equipment as modified). (r) Housing (Control of Occupation) (Amendment of Housing Register) (No 2) Ordinance 2016 (Billet d’État No VI of 2016. Approved 02.03.16—in force 15.03.16) This Ordinance is made under the Housing (Control of Occupation) (Guernsey) Law 1994 and authorises the Housing Department to inscribe in Part A of the Housing Register seven dwellings on the site known as Royal Terrace, Glategny Esplanade, Saint Peter Port.

C. SARK 1. LAWS APPROVED BY THE CHIEF PLEAS OF SARK (a) Children (Sark) Law 2016 (Approved 20.01.16) This Law makes provision for “private law” rights relating to parents and their children. Amongst other things it defines “parental responsibility”, makes provision for the appointment of guardians, creates a range of orders that can be made by the Court of the Seneschal in relation to children, confers powers on the Royal Court and provides for appeals from decisions made by courts under the Law. Part VI of the Law makes provision for the parentage of children born further to assisted reproduction or surrogacy (b) Financial Services Commission (Bailiwick of Guernsey) (Amendment) Law 2016 (Approved 06.04.16) This Law was approved by the States of Deliberation of Guernsey on 02.03.16 (see Chapter A1(g) above). (c) Succession to the Crown (Bailiwick of Guernsey) Law 2016 (Approved 06.04.16) This Law was approved by the States of Deliberation of Guernsey on 02.03.16 (see Chapter A1(e) above) and the States of Alderney on 20.04.16 (see Chapter B1(a) above). (d) Reform (Sark) (Amendment) Law 2016 (Approved 06.04.16) This Law makes a number of amendments to the Reform (Sark) Law 2008. In particular it creates a Remuneration Panel with power to determine the remuneration attaching to the offices of the Seneschal and Lieutenant Seneschal, creates the offices of Speaker, Deputy Speaker, Assistant Deputy Prevot and Assistant Deputy , makes additional provision in relation to elections to the Chief Pleas, enables the Chief Pleas to determine the number of Conseillers who shall constitute the Douzaine and amends the provisions of the 2008 Law relating to the Budget and accounts of the Chief Pleas.
