Sivochek as its new attorney. The newly appointed attorney now wishes to supplement the record made by his predecessor. Specifically, the newly appointed attorney wants to introduce the following evidence that bears on the issue of likelihood of confusion that is the basis for the Examining Attorney’s refusal to register the trademark subject to this proceeding: 1. An excerpt from the American Heritage Dictionary of the English Language, showing the definition of the word “TOUR” (URL: https://www.ahdictionary.com/word/search.html?q=tour; Accessed: December 5, 2018; Exhibit 1); 2. Search results from the U.S. Patent and Trademark Office’s databases (“TESS”) showing active third party registrations in International Class 39 for trademarks that include the wording “TOUR” (URL: http://tmsearch.uspto.gov/; Accessed: December 5, 2018; Exhibit 2); 3. Copies of select registration certificates for third party trademarks that include the wording “TOUR” (URL: http://tsdr.uspto.gov/; Accessed and Downloaded: December 5, 2018; Exhibit 3). 4. Search results from the U.S. Patent and Trademark Office’s databases (“TESS”) showing active registrations for certain trademarks that incorporate the wording “CTOUR” (URL: http://tmsearch.uspto.gov/; Accessed: December 5, 2018; Exhibit 4); 5. Copies of select registration certificates for trademarks incorporating the wording “CTOUR” (URL: http://tsdr.uspto.gov/; Accessed and Downloaded: December 5, 2018; Exhibit 5); According to TMBP §1207.02, a good cause for a remand for additional evidence exists when a new attorney for the applicant has taken over the case and wishes to supplement the evidence of record. Further, Applicant asserts that fairness requires that this new evidence be considered by the Examining Attorney prior to this case being decided by the Board on appeal. Based on the foregoing and pursuant to 37 C.F.R. § 2.142(d) and TMBP §1207.02, Applicant hereby requests that action on this appeal be suspended and that the application be remanded to the Examining Attorney for consideration of the additional evidence (enclosed herewith as Exhibits 1-5). • Call for Participation
CALL FOR PARTICIPATION TENTATIVE TITLE “Florence in the World” International Festival World’s Cultural Expressions INTRODUCTION Born from the almost thirty years of activity of the Romualdo Del Bianco Foundation in Florence, the Life Beyond Tourism Travel to Dialogue Movement aims at promoting a human- centred approach to heritage enhancement and travel experience based on mutual understanding, solidarity and intercultural dialogue. The Festival calls the Institutional Members of the Life Beyond Tourism Movement (such as universities, libraries, cultural institutions) to commit in a “cultural story-telling” of their area that provides (in time of pandemic) an interpretation, presentation and enhancement of the local typical “cultural expressions” (according to the Unesco Glossary “those expressions that result from the creativity of individuals, groups and societies, and that have cultural content”), in order to recover their status of actors of the local development in respect of the place identity. Local stakeholders - with particular reference to the younger generations - will gain a new sense of belonging and visibility and will have the chance to contribute to a cohesive territorial development and - in the light of the post-pandemic recovery of the social, cultural and economic activities - to recreate an inclusive visitors’ attractiveness. Therefore, the festival is aimed at: ● engender a sense of cultural belonging and awareness in young participants, ● engage the local communities in the production of the local cultural storytelling, ● foster cohesive territorial visibility at international level and boost the image of your region as cozy and attractive for a new model of tourism, ● provide visitors with the right tools to interpret and understand your cultural identity, ● contribute to the income-generating capacity of the local cultural expressions and to the local development sustainable and resilient.
