Supported by the Ford Foundation’s ‘Pathways to Higher Education Programme’ (2009-13) Introduction Run a search on Google and one of the first results to show up would be a Wikipedia entry. So much so, that from ‘googled it’, the phrase ‘wikied it’ is catching up with students across university campuses. The Wikipedia, which is a ‘collaboratively edited, multilingual, free Internet encyclopedia’1, is hugely popular simply because of the range and extent of topics covered in a format that is now familiar to most people using the internet. It is not unknown that the ‘quick ready reference’ nature of Wikipedia makes it a popular source even for those in the higher education system-for quick information and even as a starting point for academic writing. Since there is no other source which is freely available on the internet-both in terms of access and information, the content from Wikipedia is thrown up when one runs searches on Google, Yahoo or other search engines. With Wikipedia now accessible on phones, the rate of distribution of information as well as the rate of access have gone up; such use necessitates that the content on this platform must be neutral and at the same time sensitive to the concerns of caste, gender, ethnicity, race etc. -

Islamic scholar Dr. Zakir Naik wrote an open letter to Indians called ‘Five Questions and an Appeal’ where he lamented about being targeted and labeled a ‘terror preacher’ in India. In the letter, Naik said, “Of 150 countries where I’m respected and my talks are welcomed, I’m being called a terrorist influencer in my own country. What an irony. Why now, when I’ve been doing the same thing for over 25 years?”. Naik, 51, is an Islamic preacher, who founded the Islamic Research Foundation in 1991 when he started Dawah or religious preaching. His lectures mostly revolve around how Islam is superior to all other faiths. While he claims to be an advocate of interfaith dialogue, his preaching’s’ reinforce all the stereotypes which exist against Muslims. Following reports that one of the militants of Dhaka terror attack was inspired by Naik’s misinterpretations of Islam, there are growing demand for strict action against him. In the letter, Naik asks why he has become the enemy number one for the State and Central government. “It has been over two months since the ghastly terror attack in Dhaka, and over one month since I’ve been asking myself what exactly have I done to become the enemy number one of the media as well as the State and Central Gov- ernment,” wrote Naik. × and justice. Upadhyay Associate Professor DEPARTMENT OF LAW UNIVERSITY OF KOTA KOTA (RAJ.) 2018 CHAPTER–I INTRODUCTION Every day in the newspapers of local, national and international level as well as the television of national and international channel, we read and hear the examples of complicated nature of offences of known and unknown nature. It happens in unknown places and manners and by known or unknown persons like several persons commit adultery with a woman or several persons commit gang rape with a woman or several persons join the commission of an offence or offences with an infant, insane, idiot, illusioned, intoxicated and the like. Sometimes such rape or adulterous relationship result into birth of a child. Therefore, a complicated question arises as to the paternity of the child because it is an age old maxim that “maternity is certainty and paternity is uncertainty”.1 In such matter, in earlier times, super human or super natural means and methods of power used to resolve such issue. But later on these started creating more complications than to resolve the issues. Hence, human being turned towards scientific manner and methods to solve such parentage, heritage, lineage, succession and crime’s issues. The advent of Forensic Science made a revolution in this regard and in the ambit of forensic science, DNA (Deoxyribo Nucleic Acid) test stands on the top. -

ISSN 2455-4782 MEDIA TRIAL: AN IMPEDIMENT IN FAIR TRIAL Authored by: Nitesh Tripathi * Research Scholar ______________________________________________________________________________ ABSTRACT In today’s time, high decibel journalism is in vogue in news channel debates. It doesn’t matter whether the panelist is making sound arguments; the only thing that matters is how much louder he can shout. And it is not just about television debates trying to garner TRPs. Media organizations, be it print, electronic or new media, in order to gain more audience bother less about credibility of source and instead try to sensationalize news which is done even at the cost of distortion of facts. This is evident from the number of outstanding cases of defamation media organizations have against them in court. In a case before the Judiciary, the media gives its own verdict and thus shapes public opinion. This in turn compromises with the decision of the judiciary and sometimes they have to give in under popular public sentiments and pressure. This was observed in the case of Afzal Guru where evidence was only circumstantial, and there was no evidence that he belonged to any terrorist organization. It is in this context Israel’s Prime Minister Benjamin Netanyahu once said “It doesn't matter if justice is on your side. You have to depict your position as just.” This statement goes on to show how much powerful media is and how quickly it can create a perception in people’s mind. They can make someone Hero and within no time can turn them into villain. In extreme cases such as that of Khurshid Anwar, the victim took even his own life. -
