STATUTORY INSTRUMENTS 2009 No. 532 LOCAL GOVERNMENT, ENGLAND The Tewkesbury (Related Alterations) Order 2009 Made - - - - 6th March 2009 Coming into force in accordance with article 1(2) and (3) Under section 9(6) of the Local Government and Rating Act 1997(a) (“the 1997 Act”) Tewkesbury Borough Council(b) made proposals to the Electoral Commission for the related alteration of the boundaries of county electoral divisions and district wards within the Council’s area. The Electoral Commission have decided to give effect to the proposals and in exercise of the powers conferred by section 14(1A) of the 1997 Act(c) make the following Order: Citation and commencement 1.—(1) This Order may be cited as the Tewkesbury (Related Alterations) Order 2009. (2) This Order, with the exception of article 4, comes into force— (a) for the purpose of proceedings preliminary or relating to the elections of councillors for county electoral divisions, on the day after that on which it is made; (b) for all other purposes, on the ordinary day of election of councillors in 2009. (3) Article 4 comes into force— (a) for the purpose of proceedings preliminary or relating to the elections of councillors for district wards, on 15th October 2010; (b) for all other purposes, on the ordinary day of election of councillors in 2011. Interpretation 2. In this Order— “ordinary day of election of councillors” has the meaning given by section 37 of the Representation of the People Act 1983(d); and “the 2007 Order” means the Tewkesbury (Parishes) Order 2007(e). (a) 1997 c.29. (b) The non-metropolitan district of Tewkesbury has the status of a borough. (c) Section 14(1A) is in force in consequence of article 2(d) of, and paragraph 1(1)(b) of the Schedule to, the Local Government and Public Involvement in Health Act 2007 (Commencement No. 3, Transitional and Saving Provisions and Commencement No.2 (Amendment)) Order 2007 (S.I. 2007/337 (C.13)). (d) 1983 c.2, section 37 has been amended by section 18(2) of the Representation of the People Act 1985 (c.50), section 17 of the Greater London Authority Act l999 (c.29) and section 60 of the Local Government and Public Involvement in Health Act 2007 (c.28). (e) S.I. 2007/3577. Related alterations of county electoral division boundaries 3.—(1) Each area described in column 1 of Table 1 of the Schedule to this Order ceases to be part of the county electoral division named in column 2 of that Table and becomes part of the county electoral division named in column 3 of that Table. (2) In this article “county electoral division” means an electoral division established by the County of Gloucestershire (Electoral Changes) Order 2004(a). Related alterations of district ward boundaries 4.—(1) Each area described in column 1 of Table 2 of the Schedule to this Order ceases to be part of the district ward named in column 2 of that Table and becomes part of the district ward named in column 3 of that Table. (2) In this article “district ward” means a ward established by the Borough of Tewkesbury (Electoral Changes) Order 2001(b). These alterations are related to parish boundary changes made by the Tewkesbury (Parishes) Order 2007. The Borough of Tewkesbury (Parish Electoral Arrangements) Order 2008 also gave effect to proposals made by the Council to the Electoral Commission. The new boundaries apply in respect of county elections to be held on and after the ordinary day of election of councillors in 2009 and district elections to be held on and after the ordinary day of election of councillors in 2011. Article 3 alters Ashchurch, Cleeve and Oxenton Hill, Brockworth, Churchdown Brookfield, Cleeve, Severn Vale and Tewkesbury county electoral divisions. Article 4 alters Badgeworth, Brockworth, Churchdown Brookfield, Cleeve Grange, Cleeve Hill, Cleeve St Michael’s, Coombe Hill, Hucclecote, Isbourne, Oxenton Hill, Shurdington, Tewkesbury Prior’s Park and Winchcombe district wards. 5.
