EMERGENCY MANAGEMENT ACT 2005 (WA) Sections 67, 70 and 72A NEW SOUTH WALES AND QUEENSLAND OUTBREAK REVOCATION DIRECTIONS The World Health Organization declared COVID-19 a pandemic on 11 March 2020. On 15 March 2020, the Minister for Emergency Services declared a state of emergency with effect from 12 a.m. on 16 March 2020 in respect of the pandemic caused by COVID-19 pursuant to section 56 of the Emergency Management Act 2005 (WA) (Act). The state of emergency applies to the State of WesternAustralia. I, Colin John Blanch, Acting Commissioner of Police and State Emergency Coordinator, now give the following directions, pursuant to my powers under sections 67, 70 and 72A of the Act. PREAMBLE 1. The purpose of these directions is to revoke the directions described in paragraph 4 and to preserve the operation of those directions in certain circumstances. CITATION 2. These directions may be referred to as the New South Wales and Queensland Outbreak Revocation Directions. COMMENCEMENT 3. These directions come into effect at 12.01 am on 25 January 2021. REVOCATION AND CONTINUING OBLIGATIONS 4. The followingdirections are revoked: (a) the New South Wales Outbreak Response Directions (No 3); and (b) the Controlled Border for WesternAustralia Directions Modification Directions; and . (c) the New South Wales Outbreak Response (Yongah Hill Immigration Detainees) Directions; and (d) the Queensland Outbreak Response Directions; and (e) the Queensland Outbreak Recently Arrived Travellers Self-Quarantine and Presentation for Testing Directions (No 2); 1 5. Despite paragraph 4, a person must continue to comply with any requirement which still applied to the person under any of the directions set out in paragraphs 4 (a) to (e) (revoked directions) immediately before thesedirections came into effect,to the same extent that the person would have to comply with them if the revoked directions had not been revoked, and, for the avoidance of doubt, if a person fails to comply with a requirement that applied to them under the revoked directions, the person may commit an offence under the Act. Example: A person who entered Western Australia prior to 12.01am on 25 January 2021 and had been in New South Wales or Queensland in the 14 days prior to entering Western Australia must continue to comply with any requirements that applied to them immediately prior to these directions being made.
