Carl O’Brien has a number of in today’s Irish Times on inspection reports that have found that asylum seekers live in dismal conditions in direct provision centres. This of course will be of no surprise to the Department of Justice (and Equality……) or the current Minister for Justice, Mr Alan Shatter TD. In fact, it is of no surprise to the political In The News system as a whole, given the extensive reports from non-governmental organisations and the Ombudsman and the Ombudsman for Children. Institutions of the state know and have known for quite a bit of time about significant systemic problems with the system of direct provision. Nothing is being done about this. What many in human rights organisations suspect (or are afraid to admit openly) is that Irish society knows full well about the system of direct provision, the vast majority of the population could not care less. In fact, the vast majority may even want a harsher system (at least if thejournal.ie commentators had their way). Politicians in the Dáil have said to me, over the years that their work on direct provision is costing them support. Not just a few votes here and there, but very noticeable support. Nevertheless, some TDs (from the government parties and opposition parties) continue to highlight the major problems with the system of direct provision. In the Seanad, Senator Jillian van Turnhout raises the issue of direct provision continuously. Concerns raised about direct provision since 2001 have included: the lack of any legal basis for the system of direct provision, the reports of poor food quality, infestations, cramped living conditions, individuals institutionalised in direct provision for several years. It might be helpful to put in place a timeline, so we can see just how much the legal and political systems and Irish society as a whole know of these problems with direct provision. Depressingly, as before, Irish society ignores, punishes and demonizes ‘problematic’ populations. Report Card 2013 called on the Government to clarify its intentions by making clear commitments to Traveller and Migrant children in the forthcoming National Children and Young People’s Policy Framework and its associated implementation mechanisms. To ensure an improvement in next year’s Report Card the Government must make specific commitments and demonstrate that it has taken concrete actions to improve the lives of these children. ‘Inequalities in Family Life’ was a new section in the Report Card series in 2013 and gets a ‘D+’ grade. While the grade awarded reflects the lack of real action taken in 2013 it also reflects the Government’s promise to enact the Children and Family Relationships Bill in 2014. This legislation will represent a progressive step to address some of the inequalities faced by children of unmarried parents, in particular children of cohabiting or civil partnered parents to whom a commitment has been given in the Programme for Government. These legislative reforms will also tackle difficult issues which have come before the courts and currently are not reflected in statute such as assisted human reproduction, surrogacy and the diverse make-up of contemporary family units. Children’s Rights Alliance Report Card 2014 | 122 6.1 Traveller Children Grade E Government Commitment Progress The Programme for Government commits to promoting Very limited greater co-ordination and integration of delivery of services to the Traveller community across Government, using available resources more effectively to deliver on principles of social inclusion, particularly in the area of Traveller education. What’s happening? A Sub-Group has been established to consider recognition of Traveller ethnicity. The Joint Oireachtas Committee on Justice, Defence and Equality has held consultations on Traveller ethnicity and is due to report back to the Dáil. At Ireland’s hearing for the UN Universal Periodic Review (UPR) in October 2011, the Minister for Justice and Equality, Alan Shatter TD, announced that the Government was ‘seriously considering’ recognition of Travellers as an ethnic minority group.692 In March 2012, Ireland did not take the opportunity to grant Travellers ethnic minority status when it formally rejected a recommendation as part of the UPR process.693 During the UPR process, the State did, however, accept recommendations on protecting vulnerable groups from discrimination, including the social inclusion and integration of Travellers. In 2012, the National Traveller Monitoring and Advisory Committee (NTMAC) established a sub-group specifically to consider the issue of Traveller ethnicity.694 Following on from this, a conference was held on 27 September 2012 which heard submissions from a number of interested parties. Children’s Rights Alliance Report Card 2014 | 123 The Joint Committee on Justice and Equality held a number of discussions on the issue of Traveller ethnicity, where relevant stakeholders made written and oral submissions calling for the Travellers to be recognised as an ethnic minority.697 The Committee is due to prepare a report to the Dáil after considering these submissions. Currently there is no timeframe for when this report will be finalised. Recognition of Traveller ethnicity would require public authorities and policymakers to ensure that the identity and culture of Travellers is respected in matters affecting them. It would also ensure that Travellers would be afforded protection under the EU Race Directive. Recognition of the ethnic minority status of Travellers would open a new dialogue as to how the State interacts with Travellers into the future. Comment The section on ‘Traveller Children’ gets an ‘E’ grade in Report Card 2014, to reflect little or no meaningful action to improve the lives of Traveller children.     Statement by Alan Shatter, former Minister for Justice, Equality and Defence (2011-2014) on publication of the O'Higgins Commission Report Shatter welcomes Report's findings I want to thank Mr Justice Kevin O'Higgins and his team for the manner in which the Commission's investigation was conducted, their careful and thorough approach to establish the truth and to ensure the application of fair procedures. I welcome that the O'Higgins Commission, having conducted an independent sworn statutory Commission of Investigation, has concluded that, when Minister for Justice, I took "very seriously" the complaints and allegations of 23rd January 2012, made by Sgt Maurice McCabe through the Confidential Recipient and that there were "compelling considerations" which justified my response to them. (These are detailed in Para 13.123 & 124 of the Commission's Report). Contrary to the Guerin Report's assertion that I failed "to heed the voice" of Sgt McCabe, I also welcome that the O'Higgins Commission found that I had "very substantial concerns" about Sgt McCabes' complaints and that at all times I dealt "professionally", "promptly", "reasonably" and "appropriately" with them. Moreover, contrary to the Guerin Report, the O'Higgins Commission also found that I was "intimately" aware of the relevant applicable legislation, as were officials in the Department of Justice. The O'Higgins Commission also rejects the contention of Sgt McCabe, given credence in the Guerin Report, that in my initially seeking a report from the Garda Commissioner on the serious allegations made by Sgt McCabe I was asking the Commissioner to "investigate himself". The Commission concludes that my doing so was "an obvious, prudent and sensible thing to do" and had I "acted otherwise" I would have been "open to justified criticism".

I address three central questions. First, why has the executive become the most powerful and predominant branch of each state? Second, what does its predominant status tell us about the conceptual nature of the political executive in these, and similar, constitutional systems? Third, is the predominant status of the political executive a normatively positive or negative feature of these political systems? These questions are important by virtue of the fact the political executive is the centre of public power in the contemporary state, despite the fact historical and formal legal accounts of executive power are modest - a pale reflection of the executive’s current predominant status.

Working Papers 12/2014 Driving penal reform Mary Rogan, Head of Law and Assistant Head of the School of Languages, Law and Society, Dublin Institute of Technology, Chairperson of the Irish Penal Reform Trust Abstract For organisations and individuals involved in penal reform, influencing policy can be frustrating, slow and enigmatic. Models of penal change can provide guidance regarding the drivers of and influences on penal policy, and analysing the policy process can offer both theoretical insights and practical lessons for penal reform groups. This paper seeks to add to the growing literature on policymaking by exploring the example of the Republic of Ireland, which is in the process of changing its penal policy from one which prioritised penal expansion to one which advocates a decarceration strategy. The particular experience of Ireland since 2011 indicates a number of learning points for penal reformers, including the importance of grasping the opportunity presented by a change of government, establishing links with all parties, and, in some cases, providing a research function for politicians in order to create the best chance of having policy positions included in political commitments. The paper also explores the influence of international and domestic mechanisms for the protection of human rights on penal change, as well as the actions of senior prison officials. The case of Ireland shows that policies emphasising penal expansionism can be reversed through a combination of a favourable, or at least distracted, political culture, energetic individuals, and NGOs willing to work constructively with policymakers.

This difficult question has provided fertile material for numerous class discussions in courses on jurisprudence and legal theory. How “Irish” is Irish law? This is also an important question for anyone embarking on an examination of the history of Irish legal scholarship. The entire concept of “Irish legal scholarship” can never be entirely divorced from inevitable questions of identity. What is so unique about the subject-matter of this scholarship and what does an Irish perspective on it really mean? These questions raise inevitable philosophical challenges of defining a concept of “Irishness” that transcends different traditions and backgrounds. There are also serious difficulties that have been handed down by Irish legal history. How realistic is it to speak of “Irish law” when so much of this law has its origins outside the island of Ireland? In 1922 Hugh Kennedy, who would soon become the first Attorney General of the Irish Free State and later the first Chief Justice of the Supreme Court, wrote the following words with respect to the system of law that had provided the focus of his life’s work: “The great body of law, institutions and forms, called the ‘English Common Law’… is not in Ireland a Common Law at all. It is an alien structure imposed by statute, an exotic from which a cutting has been artificially fostered in Ireland but which has not taken root or become acclimatised in any real sense … The institutions, forms and ceremonials of the English Common Law have never been absorbed by the Irish People or become in any true sense their own.

Deputy Enda Kenny: We cannot have a sound economy without small businesses. Three years ago, 800,000 people worked in the small business sector, in tourism, services and manufac- turing. That number has declined to 700,000 and on current projections is likely to further decrease to 600,000 next year. The banking strategy set out by the Government has failed in so far as small businesses are concerned. The Taoiseach said that we will write whatever cheques are necessary. Those cheques have thus far amounted to €74 billion in taxpayers’ money. When the guarantee scheme was introduced, the Minister for Finance stated that the Government is deeply embed- ded in the banking sector and, as such, would bring leverage to it.
