  • How the Dormant Commerce Clause Limits the Twenty- First Amendment
PRUNING DIRECT SHIPPING BARRIERS FOR OPTIMAL YIELD: HOW THE DORMANT COMMERCE CLAUSE LIMITS THE TWENTY- FIRST AMENDMENT I. INTRODUCTION Prior to 2005, all wine connoisseurs told the same story at dinner.1 While vacationing in Napa Valley, a couple from New York falls head- over-heels in love with a particular bottle of wine. The couple has never seen the bottle in New York retail stores, nor will they, because as it turns out, the winery is the exclusive distributor of this rare boutique wine. They buy the bottle, but it breaks in transit to New York. At- tempting to re-purchase the bottle online, the couple learns that New York only permits wineries with in-state retail outlets to ship wine through the mail.2 Certainly, New York promotes the direct shipment3 of wine, just not from the many wineries residing outside its border.4 This particular statutory conundrum was not unique to New York, as many states5 maintained similar regulatory systems designed to insulate 1 See, e.g., Robert L. Project Approach Due to late contracting and budget issues with the state this project started later than originally planned. In the spring of 2010 MCMA worked with Foster Printing to print advertising pieces for their campaign. Once the Farmers Market Season started press releases were sent out to 4 area newspapers who ran ads along with information about their website, vendors and various information aspects about the campaign. Later in the spring advertisements were placed on radio and television stations. The MCMA made the most of speaking opportunities to various community groups and organizations on the benefits of buying fresh, local produce. Rutledge and Micah C. Daniels WHO'S SELLING THE NEXT ROUND: WINES, STATE LINES, THE TWENTY-FIRST AMENDMENT AND THE COMMERCE CLAUSE 1homas E. Rutledge* Micah C. Daniels** Once again the Supreme Courr has waded into the bog that is the confluence of the 1\~~enty-.first Amendment and !he Commerce Clause, and from rhere issued a forceful decision on the relation'l'hip of these two provisions, holding that the 1\venty-first Amendment does not immunize from Commerce Clause scruth~y state action that discriminates against interstate trade in alcoholic beverages. Herein lve revieH·' the v.rorkings of the "dormant" Commerce Clause, then turn our attention lO a more detailed revieu' of the Supreme Court's jurispn1dence on the relationship of the Twenty-first Amendment to the balance of the Constitution. Our focus from there shifts to the various systems in place in the several states regulating interstate wine shipments, the various Commerce Clause challenges made to those laws, and the recent mling in Granholm v. Heald. We then consider the constitutionality of certain Kentud:y ::;tarutes regulating wine sales, concluding they are constitutional~v infirm.
