VOPPER Erik Ugland* & Christina Mazzeo** Abstract: This Article addresses a fluid and increasingly salient category of cases involving the First Amendment right to publish information that was hacked, stolen, or illegally leaked by someone else. Twenty years ago, in Bartnicki v. Vopper, the Supreme Court appeared to give broad constitutional cover to journalists and other publishers in these situations, but Justice Stevens’s inexact opinion for the Court and Justice Breyer’s muddling concurrence left the boundaries unclear. The Bartnicki framework is now implicated in dozens of new cases— from the extradition and prosecution of Julian Assange, to Donald Trump’s threatened suit of The New York Times over his tax records, to the civil suits spawned by the hack of DNC servers—so there is a pressing need for clarity. -

Fall 08 A Bird is Known By its Flight An exploration of the geostrategic relationship between the United States and Uzbekistan since the War on Terror Michelle Blau A thesis submitted to Auckland University of Technology in fulfilment of the requirements for the degree of MPhil. Faculty of Culture and Society. August 2015 Abstract: This thesis is a qualitative case study using process tracing to explore how the need for cooperation on the War on Terror in Afghanistan affected US Government criticism of human rights abuses committed by its ally, Uzbekistan. This thesis is a contribution to the foreign policy discourse on the tension between defense and human rights in Central Asia over the past decade. The case study will demonstrate that the US was willing to remain a passive observer of human rights violations in Uzbekistan, provided the Government of Uzbekistan would cooperate with US geopolitical interests in the War on Terror. The traditional assumption of foreign policy being produced by a unified government acting as a single state has been replaced by a competition of divergent organizations acting upon the interests of their bureaus. During the War on Terror, there was a palpable tension between the different factions of US foreign affairs, and the US Government’s actions were clearly reflective of these diverse interests rather than a unitary actor. Different parts of the US Government jockeyed for influence on foreign policy, with human rights concerns overshadowed by defense interests. The US legislature withheld payments to Uzbekistan in response to concerns over human rights abuses, but the Department of Defense and other senior Bush administration officials continued to seek ways to partner with the Government of Uzbekistan. -

The Relations between Central Asian States and United States, China and Russian within the Framework of the Shanghai Cooperation Organization Ezeli Azarkan * Abstract This paper will examine the development of United States (U.S.), Chinese and Russian presence in Central Asia since the 1990s and the Central Asian states’ response to their actions. Also, it will discuss whether the Central Asian states joined the The Shanghai Cooperation Organization (SCO) merely to appease their powerful neighbors China and Russia or whether these small states have had an impact on the SCO, its agenda and direction . Introduction The purpose of this paper is to study further the interests and relations of the Central Asian states with the major powers seeking influence in the region – China, Russia and the United States, to explore whether the relationship of the Central Asian states with Russia and China prevent them from developing into true democratic states, with free and fair elections, rule of law, basic human rights and freedoms, and whether the SCO agenda in Central Asia complements or contradicts U.S. policy in the region. It may appear that the Central Asian states, which are comparatively small and poor, are merely bandwagoning with the much more powerful members: China and Russia. Indeed, as geopolitics and geo-economics play a role in the triangle of Russia, China, and U.S. relations, the Central Asian states have certain bargaining power and have been balancing the three major powers effectively. For this report, “homegrown” describes terrorist activity or plots perpetrated within the United States or abroad by American citizens, legal permanent residents, or visitors radicalized largely within the United States. The term “jihadist” describes radicalized individuals using Islam as an ideological and/or religious justification for their belief in the establishment of a global caliphate, or jurisdiction governed by a Muslim civil and religious leader known as a caliph. The term “violent jihadist” characterizes jihadists who have made the jump to illegally supporting, plotting, or directly engaging in violent terrorist activity. The report also discusses the radicalization process and the forces driving violent extremist activity. It analyzes post-9/11 domestic jihadist terrorism and describes law enforcement and intelligence efforts to combat terrorism and the challenges associated with those efforts. Appendix A provides details about each of the post-9/11 homegrown jihadist terrorist plots and attacks. There is an “executive summary” at the beginning that summarizes the report’s findings.
