Cantonal Court in Tuzia with the Council represented by the judge Dzanic Rozalija as president of the Council, judge Filipovic Ljiljana as a member of the Council, juror Duspara Marko, Durakovic Bosiljka and Kovac Salema as members of the Council, with presence of Sehomerovic Ziba as recording secretary, in the criminal subject against accused Ilic Drago from Bijeljina because of the criminal act - war crime against civilian population - from the article 142 pt. 1 taken from the KZ SFRJ ( criminal law of the Socialist Federal Republic of Yugoslavia) and criminal act - war crime against Prisoners of War - from the article 144 taken from the KZ SFRJ, according to the indictment of the Cantonal Prosecuto?s office in Tuzla no: KT: 726/94 from 31.07.1996 after oral and main public trial with presence of accused Ilic Drago and his defender Kalabic Dusan, lawyer from Sarajevo and Deputy Cantonal Prosecutor from Tuzla Sukalic Alija, held on 31.10.1997. decided and proclaimed: VERDICT ACCUSED ILIC DRAGO, son of father Zivojin and mother Petra Cvjetkovic. born on 06.10.1952 in Donja Potpec, Srebrenik municipality, permanently settled in Bijeijina, street Svetozara Corovica no.30, nationality Serb, citizen of Bosnia and Herzegovina, literate, occupation-qualified driver, married, father of two children, military service completed in 1972 in Titograd, has criminal record, kept in the custody in Tuzla Regional Prison from 03.02.1996 and is -I GUILTY because he was, from the beginning of October 1992 to beginning of 1994 in the time of the International armed conflict and partial occupation of BiH, one of two military policemen on the internal security in the Camp Batkovic near Bijeljina, on the part of the occupied area of RBiH acting against the regulations of the IV Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12.08.1949, the III Geneva Convention relative to the Treatment of Prisoners of War of 12.08.1949, about the protection of the victims of the international armed conflicts (Protocol I) and law regulations and customs of the war, so he 1) took part many times in the ill-treatments of the detained civilians with sticks, fists, slaps and feet without any reasons as were: Bakic Ilijas, Kurjak Osman, Kuraj Abdurahman, Halilovic Salko alias Dzonson, Duric Izudin, Omerbegovic Zahir, Isanovic Hasim, Music Camil, Maljisevic Mujo, Konjic Huso, Konjic Hans, Kuijancic Ibran, Hadziavdic Nusret and mis-treated other detainees, ordering them to line up and watch when he, together with military policemen, beat one detainee tied against the fence because he tried to escape l so, breaking the rules of the International Law during the war time towards the civilian population he did inhuman acts by making them suffer, caused violation of the corporal integrity, using the deterrent measures and terror 2) was beating detained BiH Army soldiers with a stick and the wooden part of the pistol on the different parts of the body as were: Jasarevic Senahid, Dizdarevic Osman, Mehmedovic Senad and mis-treated other BiH Army soldiers ordering them to line up and watch when a detained civilian was beaten up with sticks, fists, feet and other things due to the attempt of escaping so, breaking the rules of the International Law during the war towards the Prisoners of War he did inhuman acts by making them suffer and caused violation of the corporal integrity and under point 1 he did a criminal act - war crime against civilian population, from the article 142, pt. I taken from the KZ SFRJ, and under point 2 criminal act - war crime against prisoners of war, from the article 144 taken from the KZ SFRJ so the Court, on the base of the articles 5, 38, 41, 48 taken from the KZ SFRJ STATES I For the criminal act - war crime against civilian population - from the article 142, Pt 1 taken from the KZ SFRJ, give a sentence for imprisonment of 5 (five) years II For the criminal act - war crime against Prisoners of War - from the article 144, taken from the KZ SFRJ, give a sentence for imprisonment of 5 (five) years so the court on the base of the article 48, § 1 and 2, pt.3 taken from the KZ SFRJ SENTENCES HIM TO THE SOLE IMPRISONMENT OF 7 (SEVEN) YEARS. On the base of the article 50 taken from the KZ SFRJ for the accused one, the time spent in the custody in the Regional Prison in Tuzia will be counted, namely from 03.02.1996 till 17.04.1996 and from 17.04.1996 till 01.10.1996 in the Regional Prison in Sarajevo, and from the 01.10.1996 onwards in the Regional Prison in Tuzla. On the base of article 98, § 1 taken from the ZKP (the Law about the Criminal Charge), the accused person is obliged to pay the expenses for the Criminal Charges in amount of 467 KM (DM), and pay a flat rate in amount of 20 KM..
