LLANELLI AND AMMANFORD) (WAITING RESTRICTION AND STREET PARKING PLACES) CONSOLIDATION (VARIATION No. 2) ORDER 2007 The Carmarthenshire County Council in exercise of their powers under Section 1(1), 2(1) to (3) and 4(2) of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (which said Act is hereinafter referred to as "the Act of 1984") as amended and the Road Traffic Act 199 Land of all other powers them enabling and after consultation with the Chief Officer of Police in accordance with Part In of Schedule 9 to the Act of 1984 and with the Road Traffic Act 1991, here by make the following Order:- 1. The County of Carmarthenshire (With The Exception of Carmarthen, Llanelli and Ammanford) (Waiting Restriction And Street Parking Places) Consolidation Order 2004 ("the Consolidation Order") is hereby varied by the attachment thereto of the plans attached to this Order which has the effect of imposing on such parts of the road identified and for the periods i,dentified in the plans attached to this Order: (a) prohibition of waiting at any time (b) revocation of waiting restrictions (c) limited waiting between the hours of 8.00 a.m., and 6.00 p.m. on any day except Sunday for a longer period than one hour, or if a period of less than one hour has elapsed since the termination during the said hours of the last period of waiting (if any) by that vehicle on the same side of road, and (d) prohibition of waiting at any time on mart days only in accordance with the provisions of the Consolidation Order. 2. The effect of this Order will be to amend The County of Carmarthenshire (With the Exception of Carmarthen, Llanelli and Ammanford) (Waiting Restrictions and Street Parking Places) Consolidation Order 2004 (“the Consolidation Order”) (which provides for decriminalised enforcement of contraventions of waiting prohibitions and restrictions) by substituting the plans annexed thereto denoting Areas AW56, BQ190, BQ191, BX214, CJ212, CJ213, CM41, CM42, CN41, CN42, CU211, DD176, DI127, DI128, DJ127 and EX80 with the plans annexed to the Order. The consequence of the amendment will: 1. Prohibit waiting at any time on the sides of the roads specified in Schedule 1 to this Notice. 2. To revoke “The County of Carmarthenshire (With the Exception of Carmarthen, Llanelli and Ammanford) (Waiting Restrictions and Street Parking Places) Consolidation Order 2004 insofar as it relates to the sides of road specified in Schedule 2 to this Notice. 3. Limit waiting to one hour return prohibited within one hour between the hours of 8.00 a.m. and 6.00 p.m. on any day except Sunday on the sides of roads specified in Schedule 3 to this Notice. 4. Prohibit waiting at any time on mart days only on the sides of road specified in Schedule 4 to this Notice. and will replace the existing prohibitions and restrictions (if any) that affect the parts of the roads referred to above The provisions for the usual exemptions contained in the consolidation Order will apply in relation to the roads referred to above. These include the right for passengers to board or alight from a vehicle, for the loading and unloading of goods, for the carrying out of building operations and other works, for the performance of statutory powers or duties, and to enable a vehicle to take in petrol, oil, water or air from any garage situated adjacent to such parts of the roads affected by the proposed restriction. In addition, the Consolidated Order contains where applicable the usual parking concessions for disabled persons in accordance with the Blue Badge Scheme. Any person who desires to question the validity of this Order or of any provision contained in it on the grounds that it is not within the powers conferred by the Act or on the grounds that any requirement of the Act or of any instrument made under it has not been complied with in relation to the Order, may, within six weeks of the date on which the Order was made, apply to the High Court for this purpose.
