1 Executive Summary

1.1 Project Description

The Asian Development Bank (ADB) financed Integrated Development of Key Townships in

Central Liaoning Project (loan number: 2901-CN, hereinafter referred to as the "project") consists

of sewage management and improvement, Fuxin (Sihe Town) District Heating Network,

environmentally sustainable urban infrastructure development and a sub-project package of

consulting services, training and capacity construction. This project has a total investment of US$

395.3 million, including the ADB loans US$ 150 million. The sub-project implementation units

are shown in Table 1-1.

1.2 Resettlement Policy and Framework

The project land acquisition and resettlement (LAR) is implemented based on PRC’s and local governments’ relevant laws, regulations and policies, and requirements of Asian Development Bank (ADB) involuntary resettlement. The laws and regulations include: (i) State Council Document 28 of No. 31: State Council Decision to Deepen Reform and Strictly Enforce Land Administration (October, 2004); (ii) Implementation Stipulations of Land Administration Law of PRC (1998); (iii) Land Administration Law of Liaoning Province; (iv) Liaoning Guidelines for Implementation of the Urban House Demolition Management Regulation of the PRC; and (v) local relevant laws and regulations.

The LAR purpose is to improve affected people (AP) s’ living standard which is at least not lower due to land acquisition. The principles of the compensation and entitlements established for the Project are as follows: (i) compensation and entitlements provided must be adequate to allow APs to at least maintain their pre-project living standard, with the prospect of improvement; (ii) compensation and entitlements provided are based on market value or replacement value and must be adequate; (iii) the area and duration of temporary land occupation should be reduced to the minimum; (iv) lands occupied and structures or attachments built after the deadline regulated by local government will not be compensated; (v) adequate compensation should be provided to the APs timely; (vi) all the APs should be adequately informed about compensation rates and standards, livelihood and income restoration plans and project progress; and (vii) close monitoring and timely actions should be carried out to identify and resolve any problems.

1.3 Land Acquisition

Tthe actual completed land acquisition was 372.36 mu, which was 31.66% of those anticipated in the RPs, as listed in Table 1-2. The reason for the reduction of land acquisition: land acquisition involved in Xinmin, Heishan, and Gaizhou Infrastructure Projects were all transferred out of the project scope.

1.4 House Demolition

The actual completed house demolition was a total of 21,375.58 m2 of 199 households, which was 50.8% of those anticipated in the RPs, and they were all settled, listed in Table 1-3. The decrease in house demolition was due to the reduction of house demolition caused by project adjustments in the Xinmin Subproject and Heishan Subproject.

1.5 Relocation of Affected Enterprises

There are a total of planned 27 enterprises affected by the project, of which 12 units has been finished with 4150.18 m2 housing removal area. The affected units have been compensated, and the employees are working as normal. The decrease in the area of house demolition was due to Xinmin Subproject and Gaizhou Subproject transferred out of this project. The relocation is shown in Table 1-4.

1.6 Execution of Policies

Land acquisition and house demolition that have been completed by each subproject all execute the standard of RP. Its total compensation amount is higher than that in the RP, although several compensation standards have been adjusted. See Table 1-5.

CNY 138,460,700 of resettlement compensation had been paid for the Project, which took up 62.9% of the total. Payment amount under each project component is listed in Table 1-6.

1.8 Monitoring and Evaluation

Shanghai Yiji Construction Consultant Co., Ltd. carries out External Resettlement Monitoring and Evaluation for the project. A total of 12 Resettlement Monitoring Reports have been completed.

1.9 Conclusions

(1) Resettlement agencies at all levels attach great importance to land acquisition and resettlement.

(2) Each sub-project office has a sound organizational structure, and agencies engaged in resettlement compensation and resettlement have experience in land acquisition and resettlement. The unit responsible for land acquisition and demolition is responsible for land acquisition and demolition.

(3) Local compensation policies have been implemented for each subproject. Implementation policies are consistent with ADB's social security policies. The implementation of compensation standards is not lower than the resettlement plan (update) standards. The affected people are satisfied with this.

(4) The resettlement compensation for each subproject adopts two methods: monetary compensation and property rights swap, and fully respects the wishes of resettlers. This method is in line with local reality and the wishes of most people.

(5) The government has formulated assistance measures for vulnerable groups. The targeted poverty alleviation policies of the counties (cities) where each project is located have benefited the disadvantaged groups. They have all been lifted out of poverty and are consolidating.

(6) The survey of sample households shows that the income level of households affected by land acquisition has improved significantly. The per capita disposable income of the people affected by the Shenbei Subproject in 2016 was 14,445 yuan, and by 2018, the per capita disposable income was 16,620 yuan, an increase of 15%. The per capita disposable income of the sample households in Heishan County was 17,750 yuan in 2014, and per capita disposable income was 23,962 yuan in 2018, an increase of 35%. The per capita disposable income of the sample households in Huanren County increased from 10,411 in 2014 to 15,530 yuan in 2018, an increase of 49.1%. The quality of the resettlement houses has improved significantly, and the affected people are satisfied with the restoration of production and living standards.

(7) The ADB loan project has been put into operation, and land acquisition and house relocation have been completed. The production and living standards of households affected by land acquisition and house relocation have been completely restored.

(8) Land acquisition is a prerequisite for the construction of urban projects. Land acquisition needs to be done well in advance, and the earlier acquisition been taken, the more initiative been held.

(9) Establish an authoritative and efficient resettlement command system can ensure that the resettlement goals are achieved on schedule.

(10) Establish a clear system of resettlement supervision and reward. Establish an appeal system for immigrant petitions. Establish a strong atmosphere publicity work system.

(11) Projects involving land acquisition in infrastructure projects in Xinmin City, Heishan County, and Gaizhou City are all transferred out of the project scope. Reduced land acquisition and house demolition.

(12) The resettlers who originally planned to need land acquisition and demolition are notified in advance that they were no longer be demolished due to the adjustment of the project.

(13) Fuxin subproject: The construction of heating supply facility will lead to closure of 15 small boilers with 15 labors to be affected. Currently, and the 15 affected workers have their jobs with no salary changes.

2 Shenbei New District Subproject

2.1 Changes of the project scope

Shenbei Subproject makes a wide-range adjustment proposal. The project construction content and impact changes are shown in Tables 2-1 and 2-2.

2.2 Project implementation

Xinchengzi Town is included in the project. The new sewage treatment plant will cover an area of 1.12 Ha, which belongs to the third village of Xinchengbao village of the town, and above which there are 9 greenhouses.

Xinchengzi sewage treatment plant has enlarged the construction scale to 25,000 tons/day. The land pre-trial was completed in June 2017. Negotiated with the village for many times, totally 4 households, and evaluation was completed in June 2017, as well as negotiating with the affected persons. Land acquisition agreement has signed in April 2018, with the compensation cost of 2.2569 million yuan for 4 HHs.Only the greenhouses are affected.

The original project of the ADB Loan Shenbei District Center Township Comprehensive Development Project - Qingshuitai Road sub-project included the new / transformation of 47 roads, with a total length of 27,043 meters; 2 new bridge. The design content is changed to 7 road sections of Qingshuitai and 14 road sections of Xinchengzi, with a total length of 16.23 kilometers. and the renewing of the road does not involve land acquisition and demolition.

2.3 Land acquisition and greenhouse demolition

The project has occupied construction land 16.8 mu, and the land ownership is the collective land of the third village of Xinchengbao village of the town. The land requisitioned by the project affects 4 households in the third village of the third village of Xinchengbao village of the town (rented land, non-village personnel), a total of 13 people. The demolition of 4 residential sheds was completed, with a total of 280 square meters of care rooms, 7,000 square meters of flower sheds, and 10.5 acres of flowers. The total compensation for the demolition of residents' greenhouses is 2,256,916 yuan, as shown in Table 2-3.

2.4 Resettlement Policy

Land acquisition and house demolition have implemented the standards in the resettlement plan approved by ADB, as shown in Table 2-4 and Table 2-5.

2.5 Income Restoration

Part of the income of the 4 affected households (foreign tenants) originally came from planting flowers in greenhouses. After the greenhouse was demolished in 2018, 4 households chose to work elsewhere.

When the greenhouse was demolished in 2018, 4 affected people were investigated. Investigation results: The shed of the affected people has been demolished, and the affected people no longer plant flowers. With compensation, their per capita disposable income in 2016 was 14,445 yuan, and by 2018, they were 16,620 yuan. The income level of the affected people has not been affected by the demolition and is in line with ADB's social security policy.

2.6 Budget and Fund for Resettlement

The sewage treatment sub-project of the ecological center town of Shenbei New District paid a total of 3.184 million yuan (92.70625 million yuan in land acquisition costs and 2.257 million yuan in greenhouse demolition costs). The land acquisition and greenhouse demolition costs accounted for 64.0% of the total resettlement budget of 4.972 million yuan.

2.7 Public Participation and Information Disclosure

Many negotiations were made in the process of signing the compensation agreement for the greenhouses in the sewage treatment plant, and an agreement was signed. Full consultation has also been made in the land acquisition process of the sewage treatment plant. No complaints and appeals. For participation and information disclosure, see Table 2-6.

2.8 Conclusions

The PMO has communicated well with the affected people. In recent years, affected people are willing to relocate due to urban development. There are many employment opportunities in Shenbei New District. No income reduction due to land acquisition. Because the land occupied is collectively owned, the compensation is collectively owned. The village collective stock company is established, and the villagers are shareholders. The sewage treatment plant has obtained the People's Republic of China's certification of immovable property rights. The per capita disposable income of the affected people increased from 14,445 yuan before land acquisition to 16,620 yuan in 2018.

3 Xinmin Infrastructure Subproject

3.1 Changes of the project scope

In the original resettlement plan, the labor committee in Xicheng Street, Taiping Community, and Beiding Committee, Shaoguo, Dongjiao Community in Dongcheng Street, and the Xinjian village in Liaobin Street, which needed land acquisition and house demolition are no longer need to due to program adjustments. Eighteen enterprises including Liaohe Spring Factory in three sub-districts will no longer be relocated. Six stores, including Wang Lianyou, will no longer be relocated. Those who no longer relocate due to the adjustment of the scheme have been notified in advance, and the affected people have prepared for this.The project construction content and impact changes are shown in Tables 3-1 and 3-2.

3.2 Project implementation

Tiebei Drainage and Pavement Restoration Project. Restore the digged road 30,510 m2. At present, 10,033m rainwater pipes and 126,000m sewage pipeline have been finished. No land acquisition problems. The project has totally finished in September 2016.

20 Roads, including Liaohe Avenue Rebuilt Project, and all the projects have been completed by the end of Oct. 2015. There are many users parking their farm machineries on the Nongji Road. They found another place to park to cooperate with the construction unit. They will park as usual once the construction is over. The whole project is progressing smoothly.

The Flyover Construction on the Gongren Street. There used to have a funeral parlour on the site. The enterprise occupied the collective-land by itself. The land is wasteland. The enterprise will go on operation 100m away from the original site, and the employees still work for it. Project acceptance has been completed.

The Nanjiao Drainage Pumping Station covers an area of 3,200 m2 and the land is forest land.At present, the PMO has cleared the relationship between the State-owned Xinmin Machinery Forest Farm and Liaoning Jilong Real Estate Development Co., Ltd. Agreement was signed, and the compensation fee was CNY 600,000.

Tiebei Drainage Pumping Station covers an area of 3,100 m2. The land is general agricultural land, and the land ownership belongs to collective land of Dongjiao Village of Dongcheng Street. Liaoning Jilong Real Estate Development Co., Ltd. has signed a land compensation agreement with the original land contractor and the compensation fee is CNY 500,000. The reconstruction of 16 roads including Xinshi Street has been completed.

Land acquisition: The project had occupied 6.59 mu land of Hougangzi village in Dongcheng, including forest land 3.59 mu, which was 31.38% of the planned 21 mu. The standard resettlement plan for land acquisition is 30,000 yuan / mu, and the actual compensation rate is 50,000 yuan / mu.The compensation standard is the result of negotiation.

3.3 Affected Vulnerable Groups

The original immigration plan affected 11 vulnerable HHs, including eight HHs of urban poor, two households of elders alone; and one HH that has disabled family’ member. Due to the adjustment of the project plan, these people were no longer affected by the project. In recent years, Xinmin City ’s poverty alleviation policies have been implemented. The 11 affected HHs have been assisted in accordance with Xinmin City ’s poverty alleviation policies, and they are all out of poverty.

3.4 Enterprises Relocation

There was a business operating funeral supplies on the original site. The enterprise occupied the collective land of Dongjiao Village by itself. The land is wasteland. No land use agreement was signed. The house was demolished in August 2015. Compensation was given during demolition. According to the plan, the funeral homes near the roads need to be relocated, and the demolished companies operating funeral supplies will be relocated along with the funeral homes.

3.5 Fund for Resettlement

Funds for land acquisition and resettlement are raised by Xinmin City Financial Bureau. Xinmin Subproject has paid CNY 1.6 million yuan in total for land acquisition and relocation, which accounts for 1.931% of the total resettlement budget CNY 83,647,700 yuan.

3.6 Complaints and Appeals

3.7 Conclusions

(1) Xinmin subproject adjusted a lot. The projects containing LAR were all adjusted out, so there are little LAR issues.

(2) The coordination of land use for the Nanjiao Drainage Pumping Station and Tiebei Drainage Pumping Station was successful, reflecting the importance of government’s pay attention to.

4 Heishan Infrastructure Subproject

4.1 Changes of the project scope

The project construction content and impact changes are shown in Tables 4-1 and 4-2.

4.2 Project implementation

The subproject hs-c04 package has completed acquisition for 24 HHs, and 68.57 mu land. The acquired land belongs to the third group and the fourth group of Nanguan village, which occupies almost the same land. The land compensation standard is 120,000 CNY/mu, in which 70,000 CNY/mu for the APs and the rest 50,000 CNY/mu for the collective. The compensation payments are directly put into the APs’ accounts. 24 HHs have received the compensation payments. All satisfy with the compensation policy. Land revenue accounted for around 30% of the APs’ total revenue. These APs worked before land acquisition, and after land acquisition, they still work, so there is no effect on their income.

25 HHs have been demolished with 102 APs. The compensation basic standard is 2,600 CNY/ m2 to 2,800 CNY/m2, adding to the bonus of 3,200 CNY/m2. 24 HHs chose monetary compensation because they have other houses. 1 HH chose property rights exchange for 77.64 m2 in the Nanhu Xiangxieli community.

Nursing homes of Heishan Town has been demolished for 330 m2. Only a part of the nursing homes has been demolished, so it does not affect the normal use. The staff work as usual. Their salary is 1,200 CNY(2015). All is as normal.

The Auto Repair Plant and Xinbao Auto Repair Plant which are needed to be demolished in the RP no longer exist when the construction started. Instead, it has become a chicken farm. So the chicken farm has been demolished 704 m2. Now the chicken farm is no longer in business, and its owner has signed the agreement and gained the compensation.

The clothing company has been demolished for 96 m2, and it continues to run its business elsewhere. Feng Guihua Food Wholesale Department has been demolished for 90.04 m2, and it

continues to run its business elsewhere. Cao Zhongqiu Fruits Wholesale Department has been demolished for 128 m2.

The demolition of units affected 30 people, mostly in the nursing homes, while these APs all work as usual, whose incomes have not been affected a lot.

The land compensation payments are obviously higher than that in the RP. The APs housing compensation is basically as the same as that in the RP. The compensation for the units’ houses is 3,000 CNY/ m2 to 3,300 CNY/ m2, which slightly lower than the standard 3,800 CNY/ m2 in the RP. However, the land compensation is 120,000 CNY/ m2, higher than 30,000 CNY/ m2 in the RP. Each unit all agreed with the compensation standard, and has signed the housing demolition agreement, and finished the housing demolition.

The New Industrial Avenue is adjusted to the paths like Kuangguang Road etc,. The reason for adjustment is that in the eastern of the New Industrial Avenue is all the farm land, which means it is still under development.

4.3 The actual impacts of the project compared to the plan

1.Land Acquisition

The total land acquisition of this subproject is 68.57 mu, including 55.15 mu of farmland, 10.13 mu of construction land. The actual land acquisition is 68.57 mu, which is 27.57% of the planned amount. The reason for the change was the cancellation of Industrial Avenue. See Table 4-3 for comparison of land acquisition and plans. The acquired land is collective land of Nanguan Village, see Table 4-4.

3. Enterprises

Chicken farms, clothing companies, Feng Guihua's small food wholesale department, and Cao Zhongqiu fruit wholesale were added. The automatic repair shop and the new Baosheng automatic repair shop were cancelled. See Table 4-8 for the actual and planned impacts of the affected enterprises. The project affects the enterprises in Nanguan Village as shown in Table 4-9.

4.4 Situation of affected vulnerable groups and ethnic minorities

Among the affected people in the project, 4 households are defined as the vulnerable groups of the project, all of which are rural population. During the project implementation period, these vulnerable groups enjoyed the poverty reduction policies of the Chinese government,and they have all been lifted out of poverty.

4.5 Relocation Policy

1.Policy for Land Acquisition

The land acquisition compensation standard is higher than the resettlement plan, reaching 120,000 yuan / mu, of which 70,000 yuan / mu is to the affected households, and 50,000 yuan / mu is to the village, and the affected people are satisfied.Table 4-10 shows the compensation standard of this land acquisition progress.

4.6 Income Restoration

24 households and 96 persons need to be expropriated. Because these people's agricultural income before land acquisition is not their main source of income. The five people who do business have an average monthly income of 4,000 yuan; the two people in the fruit store have an average monthly income of 4,500 yuan; the two people in government public welfare positions have an average monthly income of 3,800 yuan; the 62 people employed by the enterprise have an average salary income of 4,000 yuan. 58 people purchased endowment insurance. The per capita disposable income of the sample households in 2014 was 17,750 yuan, and the per capita disposable income in 2019 was 23,962 yuan, which increased by 35%.A sample survey of 6 households showed that 4 households were satisfied with the land requisition and demolition, accounting for 66.7%, and the less satisfied 2 households accounted for 33.7%. Affected people have stable employment positions, and their production and living standards have not decreased, meeting the requirements of ADB's social security policies.

4.7 House Relocation

The houses of the affected people have been compensated and resettled. Actually 25 households were demolished, of which 24 households had other houses, so they chose monetary compensation and chose to buy their own houses. One household chose to exchange property rights, and this household also built an area of 77.64 square meters. The community that chose to exchange property rights was resettled in Xiangxieli District, Nanhu. The person who carried out the property right exchange was called He xx, who was resettled in Xiangxieli District, Nanhu, with an area of 77.64 m2. In 2015, the price of the resettlement house was 2,800 / m2, and the house price was 217,392 yuan. The area of the old house of He xx is 63.6 square meters, the compensation standard is 2,800 yuan / square meter, and the total compensation is 187,418 yuan. He xx added another 29,974 yuan, and obtained a new house with a resettlement area of 77.64 square meters, which is 14.04 square meters larger than the old one, and the quality of the house is better than the old one. The resettlement community is located in the Xiangxieli District,200 meters from Heishan County Second Kindergarten, 500 meters from the elementary school, 100 meters from the market, and 200 meters from Renhe Hospital. He xx was originally 2.1 km away from work, now he is 1.7 km away from work. He xx expressed satisfaction.

Anyone who chooses monetary compensation for old house compensation can afford a new house. The sampling results are shown in Table 4-13.

In the sample survey of the demolished households, 6 households (24%) were satisfied with the resettlement situation, 4 households (66.7%) were basically satisfied with the resettlement situation, and 2 households (33.3%).

4.8 Enterprises and Employee Relocation

The project will affect 5 enterprises and 45 employees. Chicken farms no longer exist. The remaining affected employees are in normal employment. The monthly salary level is higher than that at the time of demolition, and their lives are stable. See Table 4-14 for resettlement of enterprises and employees.

4.9 Fund for Resettlement

The fund for land acquisition and resettlement is raised by Heishan County Financial Bureau. Heishan subproject has already paid 23.01112 million CNY for land acquisition and house demolition, making up 35.63% of the total budget of 64.576 million CNY.

4.10 Public Participation and Information Disclosure

The public communication and surveys have last for more than 2 months, and each household has been communicated face-to-face for 5 to 6 times in their house until they signed the agreement.

4.11 Complains and Appeals

Problems in the progress of land acquisition and resettlement are summarized in Table 4-15.

4.12 Support for vulnerable groups

Vulnerable groups include five-guarantee households in various villages, subsistence allowance families living below the poverty line, disabled families, and female headed households. There are 4 vulnerable families in the affected area. The relocated households have improved their living environment. From the original bungalow to a building, the quality of the house has greatly improved, and their living environment has a greater impact than before. In recent years, the poverty reduction policy of Heishan County has been put in place. The four affected households have been assisted in accordance with the poverty reduction policy of Xinmin City, and they have all been lifted out of poverty.

4.13 Conclusions

The land acquisition APs are all employed. Sample surveys show that the sample household's per capita disposable income in 2014 was 17,750 yuan, and the per capita disposable income in 2019 was 23,962 yuan, which increased by 35%. The house is located in the Xiangxieli Community of Nanhu. One household purchased an apartment in Huixinjiayuan Community. All affected people have resumed production and living, income levels have improved, and house quality has improved. The affected people are satisfied with the compensation.

5 Gaizhou Infrastructure Subproject

5.1 Changes of the project scope

GZC03 Package. The drainage way for the Honghuayu road and roadway reconstruction project turns into open channel instead of culverts. Meanwhile, 28 roadways are added to rebuild. Because part of Beichen road occupies the basic agriculture farmland protection area, the original design of the

two-side mountains along Beichen road would affect the ecology a lot. Now, the remaining funds for the uncompleted part of Beichen road are used for the rebuilding of relevant infrastructures in Gaizhou city, including roads (as well as alleys), pavements, drain lines, dredging, landscaping, lighting, traffic lights and so on. The followings are shown the details.

The entire green treatment and partly-rebuilt of 6 roads: Hongqi avenue, Hada road, Yong’an road, Shifu road, Changzheng avenue and Xinfu road; the entirely-rebuilt of the pavements; the rebuilt of Sizhong road; the roadway-rebuilt of 19 alleys. The total length of the roads is 23,103.503m; the green area of roadways is 311,192.437m2, the rebuilt area of which is 38,159.04m2, and the pavement rebuilt area is 114,545 m2, including drainage, lighting, traffic lights etc.

The project affects two enterprises. Before compiling the resettlement plan in 2013, land acquisition and demolition for the two enterprises have been completed.

5.3 Conscientious investigation for two enterprises Before the preparation of the resettlement plan, the land acquisition, demolition and relocation of the two enterprises had been completed, and therefore, this report is mainly responsible for the Conscientious Investigation Report.

(1) Procedure of Land Acquisition and Relocation

On March 9th 2010, Resettlement Office of Gaizhou City issued the Closure Announcement of Land Acquisition and Resettlement (attachment 1). Since the announcement was issued, between March 2010 and March 2012, the Resettlement Office negotiated with the affected HH (people) one by one; after the negotiation:

 Signed compensation agreement with Xinfa Gleithrette Factory (Attachment 2) on March 27th 2012, paid CNY 1 million, and the rested CNY 0.202 million was paid in December 2014 after the company was relocated and resettled. The demolition and relocation of the company was completed in April 2012.

 Signed compensation agreement and supplementary agreement with the responsible person as Ma Xudong from Xingtai Plastic Factory (Attachment) on September 29th 2013, and paid CNY 3.2 million on September 30th 2013. The demolition and relocation of the factory was completed in October 2013. Since the agreement was signed with Ma Xudong, the Property Right Certificate of Ma Xudong as the owner of the Plastic Factory was provided in Attachment 5.

(2) Compensation of the Enterprises Affected by Demolition and Relocation

The actual compensation was negotiated between the Owner and the APs, and the compensation standard is higher than the policy standard:

 The compensation of Xinfa Gleithrette Factory should be CNY 1.0245 million according to the policy, and the actual compensation is CNY 1.202 million, increased by 17.3%.

 The compensation of Xingtai Plastic Factory should be CNY 2.26465 million according to the policy, and the actual compensation is CNY 3.2 million, increased by 41.3%.

(3) Resettlement Situation of the Affected Enterprises and Staff

The production of Xingtai Plastic Factory was suspended many years, there will not be resettlement problems for the staff, after fully compensated, the demolition and relocation can be implemented.

Since not long after the announcement of land acquisition and resettlement was issued, Xinfa Gleithrette Factory had started the preparation of the relocation and reconstruction of new workshops, and the new workshops were constructed under the back mountain of Shanxi Village Xicheng Street Office Gaizhou City, the total occupy area is 1,575m2, and the area main building is 630m2. The scale of the new factory is bigger than the original one, and restored the production in December 2013. Except for the 4 staff found their new jobs, the rest 6 staff continued to work in the factory. During the

suspension, the factory was paid with suspension compensation, the workers joined in demolition and relocation, so the income of whom was not affected.

5.4 Complaints and appeals The affected enterprises and staff obtained full compensation and resettlement, during the land acquisition, demolition and relocation, the demolition and relocation party fully negotiated with the APs, the demands of the APs were basically satisfied, and there were not complaints and problems.

5.5 Legal Framework (1) Besides the ADB guarantee policy and national laws, the land acquisition and relocation of the project complied with (i) Implementation Regulations of Land Administration Law of PRC in Liaoning Province (effective April 1, 2002); (ii) Notice on Implementation of Regional Integrated Land Price in Land Acquisition in Liaoning Province (No. 2 [2010] Document of Liaoning Provincial Government, effective January 7, 2010) and; (iii) Methods of Urban Area Resettlement and Reconstruction of Gaizhou City (No. [2006] 66).

(2) During the actual land acquisition, demolition and relocation, under the conditions not to violate the laws and regulations above, the compensation of the acquired assets was estimated according to the market valuation and negotiation, which fully protected the benefits of the APs.

(3) The organization to implement demotion and relocation --- Jinding Real Estate Development Company, obtained the certificated to demolish and relocate houses, the implementation procedure is legal.

5.7 Conclusions

The demolition, relocation and resettlement of Xingtai Plastic Factory and Xinfa Gleithrette Factory complied with various laws and regulations of the Chinese government, and satisfied with the requirements of ADB policies. The procedure of land acquisition, demolition and relocation is legal, and the APs was compensated reasonably and resettled properly. The land acquisition, demolition and resettlement was successfully implemented, within the scope, the conditions to continue ADB project are available.

6 Huanren Integrated Development Subproject

6.1 Project changes

The content of the Huanren Integrated Development Subproject has not changed. The procedures for the construction land of the project were handled: Land approval certification was obtained in 15th Aug. 2014, and the approval number is (2014) No.20.License of Construction Projects Planning was obtained in 22nd Sep. 2014, and the approval number is 210522201400001.

6.2 Land Acquisition

There are 203.77 mu of land acquired in this subproject, including 150.07 mu of farmland, 19.75 mu of construction land, and 33.95 mu of state-owned land. The comparison between the actual land acquisition and the plan is summarized in Table 6-1. The summary of households affected by land acquisition is listed on Table 6-2. Land acquisition of the project affects 82 HHs, 249 persons and has been completed 195.2%. See Table 6-3 for the comparison between the affected households of the actual project land acquisition and the plan.

6.4 Income Restoration

According to the resettlement plan, 80% of land compensation will be paid to the affected persons to restore their income and livelihood, which have gained the permit from both the project

implement agencies and the village committee. The rest 20% of land compensation will be reserved by the village collective with the purpose to improve agricultural production and the welfare of entire villagers. No land readjustment will be implemented. The survey shows that the income recovery of the affected people is the income from working. The per capita disposable income of the sample households in Huanren County increased from 10,411 yuan in 2014 to 15,530 yuan in 2019, an increase of 49.1%. The main source of income for the affected people is income from labor, with a monthly salary of 3,000 to 5,000 yuan. County streets organize training to increase employment skills. Every family participates in social security. See Table 6-7 for the ways to recover income.

Twelve households were sampled, accounting for 14.6% of the affected households. The 8 households satisfied with the land acquisition accounted for 66.7%, and the less satisfied 4 households accounted for 33.7%. The affected people have stable employment positions, and their production and living standards have not decreased,meeting the requirements of ADB's social security policy.

6.5 House Relocation

1.Policy Implementation

Resettlement method: property right exchange, monetary compensation

Policy: throughout property exchange of certificated houses, people whose house has been acquired can replace their original houses with new ones inside having the exactly same area commercial residential buildings, but they can only choose houses in the 2nd, 3rd or 4th floor of that building. If someone wants to select the house in other floors, he should pay extra money or get a refund based on the price of chosen house in that floor. Comparing with that of demolished houses, the exceeded area of resettled house should be paid by the marketing housing price, based on the criterion set by price department, and property area of houses involved are determined by property department once their construction was complete.

Monetary compensation standard: Property rights area: 3,000 yuan / m2. The relocation fee is 400 yuan / household.

2.Resettlement sites and resettlement methods

The present resettlement sites are Huijinghuayuan Community and Tiantai Garden Community, Lishuiyinwan II and Lipeng III. The house price is around 4,480 yuan/m2. In terms of resettlement, a total of 57 households chose to exchange property rights, accounting for 33.5%, and 113 households chose monetary compensation, accounting for 66.5%. See Table 6-8 for resettlement methods.

The comprehensive compensation standard for money houses is 5,117.8 yuan / square meter, while the real estate market price is 4,800 yuan / square meter. The comprehensive compensation price is higher than the real estate market price during the same period, which is in line with ADB's replacement price policy.

A survey was conducted on 37 households (21.76%). 24 households were satisfied with the compensation, accounting for 64.8%. The 12 households were basically satisfied, accounting for 32.4%. Two households were dissatisfied, accounting for 5.4%. Dissatisfied people think that the compensation rate is too low and the compensation rate needs to be increased.

6.6 Fund for Resettlement

The fund for land acquisition and resettlement is raised by Huanren County Financial Bureau. At present, the funds collected for land acquisition and resettlement do meet the resettlement requirement of this subproject. The subproject has paid 95.147 million CNY for land acquisition and house

demolition, accounting for 192.8% of the total budgeted cost of land acquisition and resettlement of 49.498 million CNY.

6.7 Public Participation and Information Disclosure

Implementation agencies laid much emphasis on public participation during the progress of converting survey and land acquisition. They have repeatedly held conferences to promote the policy for land acquisition and house demolition in this subproject.

In November, 2014, the group of resettlement specialists visited the project area to investigate the progress of resettlement, as well as interviewed the APs and grass-roots cadres to be debriefed about their attitude and opinions towards the resettlement work.

It has laid great emphasis on public participation during the progress of land acquisition and house demolition. Generally, in the period before land acquired and compensation agreement been signed, the director visited the affected households to take their suggestions in every two days. Women also gave some of the suggestions, like the problem of their children’s education. They also wanted to live near their original home in the future and wish for a higher standard of compensation. Some reasonable requirements had been met during this period of resettlement.

Some complaints and appeals during land acquisition and demolition were resolved during the progress.

6.8 Assistance to Vulnerable Groups

There are 44 Manchu HHs among all the affected households. They live in the same community or village. These people are unexceptionally mixed with the Han. All the Manchu HHs will receive the same safeguard provisions as Han people and will be given priorities during resettlement and income rehabilitation.

Monitoring results indicate that every vulnerable groups affected have been given sufficient and necessary assistance. In recent years, the Manchu and Han nationalities have been treated equally. Monitoring shows that the production and living standards of the affected people have improved.

6.9 Conclusions

Hengren County attaches great importance to land acquisition and house demolition. Funding is in place. The demolition work is heavy and the task is heavy. The complaints and appeals that occurred during the process of land acquisition and house demolition were all resolved according to

legal issues. The households affected by land acquisition have stable income. The per capita disposable income of the sample households in Huanren County increased from 10,411yuan in 2014 to 15,530 yuan in 2019, an increase of 49.1%.

7.2 Project Implementation

The contents include (1) widen and upgrade North Binhe Road, which is the main road connecting 3 districts and Benxi Steel Plant; and (2) rebuild the Caitun bridge. The FSR has been approved on 17th June 2016 by Provincial Development and Reform Commission.

1. North Binhe Road

North Binhe Road lies in Xihui Lake District of Benxi, and at the northern of Taizi River. It is the main traffic road connecting Caitun district and Xihu district from east and west. The designed width of the road is 20m, and the designed speed is 40 km/h, and is two-way four-line. Its total length is 2.6 km. The project has completed the tender, and ADB has approved. PMO has submitted to the municipal government a request for Approval for the coordination of demolition for part of Bengang’s factory within the range of ADB-loan Benhebei Road project on 4 January 2018. Table 7-3 shows the summary of agreement signed:

2. Caitun Bridge

Caitun Bridge is the current bridge. Its northern side connects Xihu Caitun district, and its southern side connects South Binhe Road and Benxi Railway Station. It is the main traffic road across the Taizi River from South and North. Remove and rebuild the crossroad (North Binhe Road from the western Caitun Bridge and Nan Caitun Road) from the eastern old Caitun Bridge, and be vertical to the Taizi River. The new bridge is 481.2 m long with 26m width. The old bridge has been removed. The new bridge has been completed for operation.

2. Housing Demolition

House demolition sees in Table 7-5. The project affects 20 employees, and these employees continue to be employed with a monthly income of 4,500 yuan. Their production and living standards have not been affected by the demolition.

8 Fuxin City (Sihe Town) Central heating pipe network

The construction, which will be operated along the ex-road, only occupies the temporary land for roads in this subproject, and no land acquisition and house demolition are required. 3 small boilers have been removed, which affected 3 workers who are still employed now. These 3 people were employed in real estate companies. The monthly salary when demolishing the small boiler in 2017 was 2,800 yuan / month, and the monthly salary income in 2019 was 4,000 yuan. Their income levels have not decreased.
