States Minutes 25Th September 1984 THE STATES assembled on Tuesday, 25th September, 1984 at 10.15 a.m. under the Presidency of the Bailiff, Sir Frank Ereaut. _____ All members were present with the exception of – Senator Richard Joseph Shenton – out of the Island. Letto – former member of the House. The Bailiff paid tribute to the late Mr. Maurice Letto, a former Deputy of St. Lawrence. The States observed one minute’s silence as a mark of respect. Visit of Home Secretary – Special Sitting. THE STATES were informed by the Bailiff that Her Majesty’s Secretary of State for Home Affairs, The Right Honourable Leon Brittan, Q.C., M.P., having had to postpone his visit in April, 1984, would pay an official visit to the Island on 1st and 2nd October, 1984. The States were therefore convened to meet at 10.30 a.m. on Tuesday, 2nd October, 1984, in order to welcome him. 247 Price: £2.00. STATES MINUTES 25th September, 1984. Visit of Home Secretary – filming by BBC TV Southwest. The Bailiff informed the House that BBC Television Southwest, Plymouth, had requested permission to film the visit to the States Chamber of the Right Honourable Leon Brittan, Q.C., M.P., Her Majesty’s Secretary of State for Home Affairs. THE STATES acceded to the request. Chartered Insurance Institute, Presidents – Welcome. The Bailiff, on behalf of the Members of the States, welcomed to the House the President of the Chartered Insurance Institute, Mr. Julius Neave and the Deputy President, Mr. Bernard Day. R. & O. 7316. Contingencies vote of credit – Defence Committee. THE STATES noted an Act of the Finance and Economics Committee dated 22nd August, 1984, informing the House that it had made available to the Defence Committee the sum of £7,100 from the Contingencies vote of credit for additional stores and equipment to ensure that the Island could cater adequately for passengers who might become stranded in Jersey at the harbour or airport during the rest of 1984. Agricultural Statistics for 1983. The Agriculture and Fisheries Committee by Act dated 24th July, 1984 presented to the States the Agricultural Statistics for 1983. THE STATES ordered that the said statistics be printed and distributed. Manpower Report for half-year to 30th June, 1984. R.C.22. The Establishment Committee by Act dated 29th August, 1984, presented to the States a Report on Manpower for the half year to 30th June, 1984. THE STATES ordered that the said Report be printed and distributed. Matters noted – land transactions. THE STATES noted Acts of the Finance and Economics Committee dated 22nd August, 5th September and 19th September, 1984, showing that in pursuance of Standing Orders relating to certain transactions in land, the Committee had approved – 249 STATES MINUTES 25th September, 1984. (a) as recommended by the Public Works Committee, the leasing from Mrs. Enid Amy Gautier, née Gray, of Field 1272, St. Helier, measuring 8 vergées and adjoining and cultivated in connexion with, the Parks Nursery, Warwick Farm, Mont à l’Abbé, for a period of nine years with effect from 25th December, 1984, at an annual rent of £400, with rent reviews every three years; (b) as recommended by the Harbours and Airport Committee, the leasing to Marine Management and Deliveries (Jersey) Limited (Letting No. A18) of office accommodation on the Albert Pier, Port of St. Helier, having an area of 100 square feet, for a period of three years with effect from 1st August, 1984, at an annual rent of £400, equating to a rate of £4 a square foot, the rent being based on market comparisons; (c) as recommended by the Harbours and Airport Committee, the lease to Summerday Tours Limited of storage accommodation in a bunker on the Albert Pier, Port of St. Helier (Letting No. A26a) at an annual rent of £447.12, being a rate of £2.07 a square foot; (d) as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mr. Maurice O’Connell of No. 19, Columbus Street, St. Helier, required for redevelopment purposes, for a consideration of £22,500 for the realty, with the Committee being responsible for the payment of all legal fees; (The Committee rescinded paragraph (c) of Act No. 3 of 27th June, 1984, which had been notified to the States on 31st July, 1984.) (e) as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from Mr. Leonard Charles Huish of No. 17, Columbus Street, St. Helier, required for redevelopment purposes, for a consideration of £40,000 for the realty, with the Committee being responsible for the payment of all legal fees; 250 STATES MINUTES 25th September, 1984. (f) as recommended by the Housing Committee, the granting to Mrs. Susan Margaret Marsh, née d’Abbot Doyle, of a vehicular right of way from the rear of her property, No. 20 Journeaux Street, across Journeaux Court, St. Helier, for a consideration of £1,000 and the payment by Mrs. Marsh of all legal fees; (g) as recommended by the Housing Committee, with the support of the Island Development Committee, the purchase from the Norfolk Hotel Limited of an area at the rear of No. 40 Don Road, St. Helier, shown on Drawing No. 2722/1 for a consideration of £12,000 plus £500 legal fees; (h) as recommended by the Public Works Committee, the passing of a Contrat de Bornement with Charles Le Quesne (1956) Limited and Charles Le Quesne Limited to agree the boundary line between their property and the property owned by the public at the site at Montrose, Mont Mado, St. John, with Charles Le Quesne (1956) Limited being responsible for the payment of all fees involved in the transaction; (i) as recommended by the Public Health Committee and in pursuance of an Act of the States dated 20th November, 1979, accepted the devise of the late Mrs. Eunice Jane Bailhache, née Hubert of specified properties, the assignment from Cathay Enterprises Limited to Mr. Maurice George Vowden and Mrs. Eileen Maria Vowden, née Bullman, of the head lease of No. 52 Don Street, St. Helier; (j) as recommended by the Housing Committee, with the support of the Island Development Committee, the sale to Mr. Peter Paul Foley and Mrs. Dulcie Phyllis Foley, née Le Gros, of 1,200 square feet of land shown hatched in red on Plan No. 204.25B at La Rue de la Poterie, Grouville, for the sum of £500 plus the payment of all legal expenses; 251 STATES MINUTES 25th September, 1984. (k) as recommended by the Housing Committee, the passing of a Contrat de Transaction with Mr. James Walter Bromfield and Mrs. Moyra Ann Bromfield, née Seear, to allow the building of a garage at their property, No. 8, Deloraine Close, Deloraine Road, St. Saviour, in contravention of the sale agreement, with Mr. and Mrs. Bromfield being responsible for the payment of all legal fees; (l) as recommended by the Cottage Homes Committee, the passing of a Contrat de Transaction with Mr. James Walter Bromfield and Mrs. Moyra Ann Bromfield, née Seear, of 8 Deloraine Close, St. Saviour, for the construction of an east gable wall of a garage on the party wall between Deloraine Close and the Victoria Cottage Homes, with Mr. and Mrs. Bromfield being responsible for the payment of all legal fees; (m) as recommended by the Education Committee, the leasing from Miss Eleanor Anne Forster of 12, Bel Royal Gardens, St. Lawrence, for the period from 15th July, 1984 to 3rd April, 1985 at a monthly rent of £325 to accommodate Education Service staff; (n) as recommended by the Education Committee, the leasing from Mrs. Jennifer McMullan, née Gaudin, of Nos. 1 and 2, Belle Rive Villas, Le Hocq Lane, St. Clement, for a period of three years, with effect from 1st August, 1984, at an annual rent of £2,860 for each property, to accommodate teaching staff; (o) as recommended by the Public Works Committee, the granting to the Jersey Gas Company Limited of any wayleaves that might be required in respect of the new gas main from La Collette to Don Road where the new main must traverse open ground administered by that Committee, in accordance with instructions received from the Autorisé de la Partie Publique, with the Company being responsible for the payment of all legal fees. 252 STATES MINUTES 25th September, 1984. Jersey’s huge tidal range means that the tower occupies the far point which dries out at low tide and was therefore a possible landing place for invading troops. The tower is defended by musket loopholes in the walls and a gun battery at its base. It could also provide early warning of any impending attack to sentries posted along the shore. 2 Faldouet Dolmen, St Martin This megalithic monument is also known as La Pouquelaye de Faldouët - pouquelaye meaning ‘fairy stones’ in Jersey. It is a passage grave built in the middle Neolithic period, around 4000 BC, the main stones transported here from a variety of places up to three miles away. Human remains were found here along with finds such as pottery vessels and polished stone axes. 3 Cold War Bunker, St Helier A German World War II bunker adapted for use during the Cold War as Jersey’s Civil Emergency Centre and Nuclear Monitoring Station. The building includes a large operations room and BBC studio. 4 Statue of King George V in Howard Davis Park Bronze statue of King George V wearing the robes of the Sovereign of the Garter. Watchtower, La Coupe Point, St Martin 5 On the highest point of the headland is a small watchtower built in the early 19th century and used by the Royal Navy as a lookout post during the Napoleonic wars. It is sturdily constructed of mixed stone rubble with a circular plan and domed top in brick.

    Review of birds in the Channel Islands, 1951-80 Roger Long ecords and observations on the flora and fauna in the Channel Islands Rare treated with confusing arbitrariness by British naturalists in the various branches of natural history. Botanists include the islands as part of the British Isles, mammalogists do not, and several subdivisions of entomo• logists adopt differing treatments. The BOU lists and records have always excluded the Channel Islands, but The Atlas of Breeding Birds in Britain and Ireland (1976) included them, as do all the other distribution mapping schemes currently being prepared by the Biological Records Centre at Monks Wood Experimental Station, Huntingdon. The most notable occurrences of rarities have been published in British Birds, and this review has been compiled so that the other, less spectacular—but possibly more significant—observations are available as a complement to the British and Irish records. The late Roderick Dobson, an English naturalist resident in Jersey between 1935 and 1948 and from 1958 to his death in 1979, was the author of the invaluable Birds of the Channel Islands (1952). In this, he brought together the results of his meticulous fieldwork in all the islands, and his critical interpretation of every record—published or private—that he was able to unearth, fortunately just before the turmoil of the years of German Occupation (1940-45) dispersed much of the material, perhaps for ever. I concern myself here chiefly with the changes recorded during the approxi• mately 30 years since Dobson's record closed. Species considered to have shown little change in status over those years are not listed.

There are some poems by local From the Constable poets to celebrate Liberation and some stories from St Saviour residents who were in Jersey when the Liberation forces arrived on that memorable day, 9th May 1945. It is always enlightening to read and hear of others’ stories from the Occupation and Liberation p4 of Jersey during the 1940s. Life was so very different then, from now, and it is difficult for us to imagine what life was really like for the children and adults living at that time. Giles Bois has submitted a most interesting article when St Saviour had to build a guardhouse on the south coast. The Parish was asked to help Grouville with patrolling Liberation Stories the coast looking for marauders and in 1690 both parishes were ordered to build a guardhouse at La Rocque. This article is a very good read and the historians among you will want to rush off to look for our Guardhouse! Photographs accompany the article to p11 illustrate the building in the early years and then later development. St Saviour Battle of Flowers Association is managing to keep itself alive with a picnic in St Paul’s Football Club playing field. They are also making their own paper flowers in different styles and designs; so please get in touch with the Association Secretary to help with Forever St Saviour making flowers for next year’s Battle.

    Jersey & Guernsey Law Review – June 2010 THE CUSTOMARY LAW IN RELATION TO THE FORESHORE (2) Richard Falle and John Kelleher The second part of an extended article on the customary law in relation to the foreshore. The first part of the article (June 2008 edition) focussed on the connection between continental Normandy and the Islands, through their shared custom, in relation to the law as to the foreshore. It argued that according to the custom the foreshore was presumed to be parcel of the adjacent terra firma and accordingly parcel of a maritime fief. It concluded that the Duke of Normandy had no general claim to the foreshore and, barring certain limited ducal privileges, it formed part of the seigneurial regime and its ownership lay in private hands. The second article focuses on custom and practice in Jersey from 1204 to the present day to illustrate the law and use of the foreshore. The article reviews a range of evidence from the records of individual fiefs, 13th century enquiries undertaken in Jersey on behalf of the Crown, disputes over the foreshore, the views of customary writers and use of the foreshore ranging from varech, vraic, essiage, pescheries and the collection of salt. It also examines the changing attitude of the Crown to ownership of foreshore in Jersey and the genesis of the Crown’s claim to it. It concludes with the case of Les Pas Holdings Ltd and its claim to a private title in a significant part of the St. Helier seafront.
