1.0 Introduction

1.1 Commission

1.1.1 Patrick Parsons (PP) has been appointed by Jessup Brothers Ltd (client) to produce a Phase I Site Appraisal for a proposed residential deelopet at the site ko as Rosliston Road, Burton-on- Trent.

1.2 Proposed Development

1.2.1 The current proposals indicate a residential development comprising twenty-two residential units and a block of four one-bedroom flats including associated car parking, private gardens and soft landscaping. A Proposed Development Layout Plan is included within Appendix A.

1.3 Limitations

1.3.1 This report has been prepared for the client and their appointed agents only and should not be relied upon by any third party without the written permission of Patrick Parsons. If any unauthorised third party comes into possession of this report, they rely on it at their own risk and the authors do not owe them any Duty of Care or Skill. It is based on and limited to an assessment of the information and ground conditions identified here. Patrick Parsons is not responsible for ground conditions not revealed during investigations undertaken by third parties and have reviewed the information presented in good faith.

1.4 Aim of Phase I Site Appraisal

1.4.1 The liet’s speifi euieets ee to udetake a desk ased Phase I “ite Appaisal. The principal objectives are as follows:  Obtain information about the likely soil and groundwater conditions within the area of the site.  Determine the possible ground related geotechnical and contamination hazards within the site boundaries that may affect the proposed development.  Provide preliminary development recommendations.  Provide advice on further works required for the cost-effective reduction of risks to the development and procedures likely to satisfy regulators.

1.5 Information Sources

1.5.1 This Phase I Site Appraisal is based on published geological and environmental information supplemented by an environmental data report.

2.0 Phase I Desk Study

2.1 Site Description

2.1.1 The site is located off Rosliston Road, Burton-on-Trent, and is approximately 2.2km southeast of the town centre. The grid reference for the site is SK253209 and nearest postcode is DE15 9RG. A site location plan is presented in Appendix A.

2.1.2 The site is a roughly rectangular shaped plot of land covering an area of approximately 0.52ha. The site currently comprises a used car sales pitch, a vehicle maintenance business and a car paint spraying business. An area of open scrubland is present across the east of the site.

2.1.3 At the front of the site in the area adjacent to Rosliston Road there is what appears to be the remnants of a fuel pump station and there are a number of manhole covers in two areas which are likely to be associated with an underground tank farm and an interceptor.

2.1.4 The site currently fronts onto Rosliston Road along the western boundary, with residential housing beyond. The site is bounded to the north, east and south by residential housing, a medical centre is also present along the northern boundary. Mature and semi-mature trees are present along the eastern and southern boundaries.

2.1.5 The site gently rises up from Rosliston Road towards the rear of the site and the land beyond the eastern boundary at the rear of the site is at higher elevation with retaining walls locally present.

2.1.6 A site features plan is presented in Appendix A.

2.2 Site History

2.2.1 The earliest historical mapping reviewed (1883) shows the site as a large detached house with a single storey row of outhouses to the rear, these two structures remain to present day. A second row of outhouses/possible stable block are recorded on the eastern boundary but are demolished by 1900. From 1967 a garage is shown in the west of the site. It is considered likely that underground fuel storage tanks may be/have been present at the site. A brick yard and associated clay pit is shown adjacent to the eastern boundary from the earliest mapping until 1975, when residential housing was constructed across the area; as this area is raised in relation to site it suggests that the clay pit may have been filled prior to development.

2.2.2 In the wider vicinity, the site was set within a predominantly residential/agricultural area, which has generally become increasingly residential throughout the 20th Century.

2.2.3 The historical maps reviewed are presented in Appendix B

2.3 Geology

2.3.1 The site is recorded to be underlain by the Taporley Siltstone Formation consisting of red-brown siltstones interlaminated with red-brown mudstones and grey-brown sandstones. No superficial

deposits are recorded below the site; however, given the previous development it is likely that localised deposits of made ground will be present.

2.4 Mining and Quarrying

2.4.1 The site is recorded to be within a coal mining affected area. The Coal Authority Mining Report confirms that the property is not within the likely zone of influence of any past underground workings or within the boundary of an opencast site. The Coal Authority Mining Report obtained for the site is included within Appendix C.

2.5 Hydrogeology and Hydrology

2.5.1 The underlying bedrock geology is recorded as a Secondary B Aquifer. There are no source protection zones, potable water or groundwater abstraction licences within 250m of the site boundaries.

2.5.2 There are no surface water features within 250m of the site; the site is not recorded to be within a flood zone.

2.6 Environmental Data

2.6.1 There are no active Environment Agency registered landfill sites within 1000m of the site

2.6.2 A search of the petroleum licensing records has been commissioned to determine whether the suspected underground storage tanks were used for fuel storage and what steps if any were undertaken to decommission them; the findings of the search will be issued under separate cover.

2.6.3 The environmental data report obtained for the site is presented in Appendix D. The report does not highlight any additional significant features other than those discussed in other sections of this report.

2.7 Radon

2.7.1 The site is not in an area where radon protections measures are required.

2.8 Contaminants of Concern

2.8.1 Limited thicknesses of made ground are likely to be present across the site associated with its previous usage. Petrol/diesel fuels and solvents associated with vehicle body spraying may be peset aoss the site due to the site’s previous use as a garage and vehicle body spraying workshop.

3.0 Phase I Conceptual Model

3.1.1 The preceding information has been assessed and a conceptual model produced following current relevant guidance.

3.1.2 The site is currently for car sales, vehicle maintenance and vehicle spraying, and has formerly been used as a garage. Therefore, the risk of significant soil contamination being present is considered to be moderate. It is considered that the infilled clay pit adjacent to the eastern boundary may present a ground gas risk to the site.

3.1.3 In terms of human health, the primary receptors are end-users of the proposed residential development and construction workers. The pathways include direct contact with contaminated soil and soil dust, ingestion of contaminated soil and dust, consumption of home-grown vegetables that have taken up contamination (end users only) and the indoor/outdoor inhalation of ground gas and soil vapour. Given the lack of a significant source, it is considered the risk to human health will be moderate.

3.1.4 In terms of controlled waters the primary receptor is the Secondary B Aquifer (Taporley Formation). The main pathway would be through leaching and groundwater transport. It is considered that the near surface geology will have weathered to an impermeable clay and therefore risk to controlled waters will be low.

4.0 Preliminary Recommendations

4.1 Contamination and Remediation

4.1.1 The risk of significant contamination being present at the site is considerd moderate and as such the risk posed to human health and controlled waters has been asessed as moderate/low. However, a ground investsigation will be required to confirm this assessment, the scope of which is outlined in Section 5.

4.1.2 It should be noted that the following comments are based on the findings of this desk study and should be confirmed by intrusive investigation and chemical analysis:  Capping is likely to be required across the west of the site. However, onsite soils across the east of the site may potentially be suitable for re-use;  Gas protection measures may be required;  Specialised water pipes may be required.

4.2 Geotechnical Considerations

4.2.1 It should be noted that the following comments and recommendations are based on the findings of this desk study, which may not give a true indication of actual engineering properties (i.e. stability, mass structure etc). Prior to development a ground investigation will be required to confirm the initial recommendations outlined below, the scope of which is outlined in Section 5. However, at this stage based on the desk-based information available it is considered:  The ground conditions are likely to comprise made ground to shallow depth overlying weathered bedrock of the Taporley Siltstone Formation.  Deeper made ground will locally be present following removal of the suspected underground tanks and interceptor.  The site is likely to be suitable for the use of traditional trench or strip foundations.  Near surface natural soils are likely to be cohesive in nature, therefore heave protection measures and deepening due to trees may locally be required (around the site margins). If plots are located close to existing or proposed trees piled foundations be locally be required.  The site is unlikely to be suitable for use of soakaway drainage.

5.0 Further Work and Conclusions

5.1 A Phase II ground investigation is recommended to confirm the initial recommendations outlined in this report. This should include:  A window sampling investigation to confirm ground conditions and collect samples for analysis.  Chemical analysis of soils followed by risk assessment so that the risk to human health and controlled waters can be determined.  Geotechnical and geochemical soils testing of the founding strata to assess strength and suitable grade(s) of buried concrete.

5.2 This document should be submitted to the Planning Department of the Local Authority for comment and approval.

In the event that Groundsure is prevented from performing the Services (or any part thereof) in accordance with this clause 12.6 for a period of not less than 30 days then Groundsure shall be entitled to terminate this Contract immediately on written notice to the Client. 12.8 Any notice provided shall be in writing and shall be deemed to be properly given if delivered by hand or sent by first class post, facsimile or by email to the address, facsimile number or email address of the relevant party as may have been notified by each party to the other for such purpose or in the absence of such notification the last known address. 12.9 Such notice shall be deemed to have been received on the day of delivery if delivered by hand, facsimile or email (save to the extent such day is not a working day where it shall be deemed to have been delivered on the next working day) and on the second working day after the day of posting if sent by first class post. 12.10 The Contract constitutes the entire agreement between the parties and shall supersede all previous arrangements between the parties relating to the subject matter hereof. 12.11 Each of the provisions of the Contract is severable and distinct from the others and if one or more provisions is or should become invalid, illegal or unenforceable, the validity and enforceability of the remaining provisions shall not in any way be tainted or impaired. 12.12 This Contract shall be governed by and construed in accordance with English law and any proceedings arising out of or connected with this Contract shall be subject to the exclusive jurisdiction of the English courts. 12.13 Groundsure is an executive member of the Council of Property Search Organisation (CoPSO) and has signed up to the Search Code administered by the Property Codes Compliance Board (PCCB). All Risk Screening Reports shall be supplied in accordance with the provisions of the Search Code. 12.14 If the Client or Beneficiary has a complaint about the Services, written notice should be given to the Compliance Officer at Groundsure who will respond in a timely manner. 12.15 The Client agrees that it shall, and shall procure that each Beneficiary shall, treat in confidence all Confidential Information and shall not, and shall procure that each Beneficiary shall not (i) disclose any Confidential Information to any third party other than in accordance with the terms of this Contract; and (ii) use Confidential Information for a purpose other than the exercise of its rights and obligations under this Contract. Subject to clause 6.6, nothing shall prevent the Client or any Beneficiary from disclosing Confidential Information to the extent required by law

12 General 12.1 The Mapping contained in the Services is protected by Crown copyright and must not be used for any purpose other than as part of the Services or as specifically provided in the Contract. 12.2 The Client shall be permitted to make one copy only of each Report or Mapping Order. Thereafter the Client shall be entitled to make unlimited copies of the Report or Mapping Order only in accordance with an Ordnance Survey paper map copy license available through Groundsure. 12.3 Groundsure reserves the right to amend or vary this Contract. No amendment or variation to this Contract shall be valid unless signed by an authorised representative of Groundsure. 12.4 No failure on the part of Groundsure to exercise, and no delay in exercising, any right, power or provision under this Contract shall operate as a waiver thereof. 12.5 Save as expressly provided in this Contract, no person other than the persons set out therein shall have any right under the Contract (Rights of Third Parties) Act 1999 to enforce any terms of the Contract. 12.6 The Secretary of State for Business, Innovation and Skills (“BIS”) or BIS’ successor body, as the case may be, acting through Ordnance Survey may enforce a breach of clause 6.4(vi) and clause 6.4(vii) of these terms and conditions against the Client in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999. 12.7 Groundsure shall not be liable to the Client if the provision of the Services is delayed or prevented by one or more of the following circumstances: (i) the Client or Beneficiary’s failure to provide facilities, access or information; (ii) fire, storm, flood, tempest or epidemic; (iii) Acts of God or the public enemy; (iv) riot, civil commotion or war; (v) strikes, labour disputes or industrial action; (vi) acts or regulations of any governmental or other agency; (vii) suspension or delay of services at public registries by Third Party Data Providers; (viii) changes in law; or (ix) any other reason beyond Groundsure’s reasonable control. In the event that Groundsure is prevented from performing the Services (or any part thereof) in accordance with this clause 12.6 for a period of not less than 30 days then Groundsure shall be entitled to terminate this Contract immediately on written notice to the Client.
