Ini merupakan suatu perkembangan yang amat menggalakan. ” PERUTUSAN PENGERUSI viii LAPORAN TAHUNAN 2019 PERUTUSAN PENGERUSI Tahun 2019 merupakan tahun istimewa buat SUHAKAM yang menyambut ulang tahun ke-20 pada 9 September. Buat julung kalinya juga, Laporan Tahunan SUHAKAM dibahaskan di Parlimen menjadikan ia sebagai satu penanda aras yang penting buat SUHAKAM. Dewasa ini, jelas kelihatan kepekaan dan kesedaran masyarakat berkenaan hak asasi manusia dan kedaulatan undang-undang berada pada tahap yang tinggi jika dibandingkan dengan tahun- tahun sebelumnya. Perbincangan mengenai undang-undang hak asasi manusia, dasar, kelaziman dan amalan kini dilakukan secara terbuka dan telus dalam setiap peringkat masyarakat. Ini merupakan suatu perkembangan yang amat menggalakan. Sebelum ini, perbincangan berkaitan hak asasi manusia sukar dilakukan dan hanya boleh berlaku dengan kerjasama antara kerajaan dan masyarakat sivil. Walaupun telah berdepan dengan penangguhan dalam tempoh yang panjang, hari ini kita dapat lihat usaha ke arah itu telah bermula di sebalik beberapa isu yang mungkin melambatkan penubuhan IPCMC. SUHAKAM akan terus menyokong usaha kerajaan dalam pembaharuan dasar dan undang-undang berkaitan hak asasi manusia dan terlibat dalam merangka dan mengkaji semula undang- undang berkaitan gangguan seksual, anti diskriminasi terhadap wanita, pekerjaan, pekerja domestik dan pemansuhan hukuman mati mandatori. Walaupun perkembangannya agak perlahan namun SUHAKAM amat berharap semua usaha ini dapat disegerakan. Apa yang jelas, sepanjang tahun ini, reaksi terhadap SUHAKAM dan hak asasi manusia telah berubah. SUHAKAM dianggap sebagai pihak yang mempunyai reputasi dan kredibiliti dalam bidang hak asasi manusia dalam negara dan menerima sejumlah besar memorandum dari pelbagai organisasi masyarakat sivil dan individu tentang pelanggaran hak asasi manusia. Peranan SUHAKAM dipandang serius dan diikuti secara dekat oleh pihak media dan masyarakat. Tidak dapat dinafikan bahawa sehingga kini, pelaksanaan hak asasi manusia berada pada tahap yang rendah malah bukan dalam senarai keutamaan kerajaan. Sungguhpun begitu, SUHAKAM menaruh keyakinan tinggi terhadap senarai cadangan mengenai pembaharuan undang-undang yang berkaitan hak sivil, politik dan ekonomi rakyat Malaysia serta janji untuk pelaksanaannya. Sejak penubuhannya pada tahun 1999, SUHAKAM secara konsisten mengulangi seruannya agar laporan tahunannya dibahaskan di Parlimen. Ia mengambil masa selama 20 tahun dan perubahan kerajaan untuk hal ini direalisasikan, akhirnya Laporan Tahunan SUHAKAM 2018 telah dibahaskan pada 5 Disember 2019 buat pertama kalinya, menjadikan ia sebagai penanda aras terhadap kesedaran masyarakat. Menteri di Jabatan Perdana Menteri (Undang-undang), Datuk Liew Vui Keong memulakan sesi dengan menyoroti kerja yang dilakukan oleh SUHAKAM dengan perhatian khusus kepada kerjasama SUHAKAM x LAPORAN TAHUNAN 2019 dengan pihak berkuasa agama negeri, dan Kementerian Pendidikan dalam memperkenalkan pendidikan hak asasi manusia di sekolah serta nasihat mengenai dasar/undang-undang yang berkaitan dengan isu pelarian. Menteri juga mengulas mengenai Inkuiri Awam Kehilangan Pastor Raymond Koh dan Amri Che Mat terutama mengenai dapatan inkuiri yang mana akan mendorong Malaysia ke arah meratifikasi Konvensyen Antarabangsa untuk Perlindungan Semua Orang dari Kehilangan Yang Dipaksa (ICPPED). Beliau turut membangkitkan isu berkaitan hak kanak-kanak, termasuk perkahwinan kanak-kanak, penderaan dan eksploitasi seksual yang memberikan kesan terhadap akses pendidikan, kesihatan, kesaksamaan dan tiada diskriminasi. Semestinya dan nasihat undang-undang serta perkembangan ini pengukuhan SUHAKAM bagi mematuhi membanggakan sepenuhnya Prinsip Paris. sekaligus menunjukkan bahawa Kebanyakan ahli parlimen turut SUHAKAM merupakan menyokong dan mempercayai institusi yang bahawa SUHAKAM seharusnya dihormati di peringkat mendapat sokongan penuh, dibiayai antarabangsa serta dan diperkasakan secara efektif boleh dijadikan bagi membolehkan ia memenuhi model untuk peranannya sebagai sebuah institusi diteladani hak asasi manusia kebangsaan. ” SUHAKAM xi Dalam mengiktiraf kepentingan untuk menambah baik hak kanak- kanak di Malaysia, SUHAKAM turut mengalu-alukan pelantikan Prof. Dato’ Noor Aziah Mohd. Awal sebagai Pesuruhjaya Kanak-kanak pertama Malaysia yang mana mandat dan tugas beliau adalah berdasarkan Akta SUHAKAM. Tahun ini juga tugas menyiasat aduan pelanggaran hak asasi manusia tetap menjadi fokus utama, oleh itu SUHAKAM telah menyerahkan laporan Inkuiri Awam Kehilangan Paksa Pastor Raymond Koh dan Amri Che Mat kepada kerajaan. Hasil siasatan ini seterusnya mendorong kerajaan untuk membentuk pasukan petugas khas bagi menyiasat lebih lanjut kehilangan paksa ini. Selain itu, SUHAKAM turut bekerjasama dengan sebuah badan bukan kerajaan, Fortify Rights untuk menjalankan siasatan berkenaan penemuan kubur besar di Wang Kelian, Perlis. It has a parliamentary system of government selected through regular, multiparty elections and is headed by a prime minister.     MALAYSIA 2020 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution states Islam is the “religion of the Federation; but other religions may be practiced in peace and harmony.” Federal and state governments have the power to mandate doctrine for Muslims and promote Sunni Islam above all other religious groups. Other forms of Islam are illegal. Sedition laws criminalize speech that “promotes ill will, hostility, or hatred on the grounds of religion.” The government maintains a parallel legal system, with certain civil matters for Muslims covered by sharia. The relationship between sharia and civil law remains unresolved in the legal system. Individuals diverging from the official interpretation of Islam continued to face adverse government action, including mandatory “rehabilitation” in centers that teach and enforce government-approved Islamic practices. Sources stated that there was some selective persecution of non- Muslim faiths through legal and extralegal means. In February, the human rights commission (SUHAKAM) initiated a public inquiry into the 2016 disappearance of a Christian pastor and his wife. A government-appointed panel formed in 2019 to investigate SUHAKAM’s findings on the enforced disappearances of another Christian pastor and a social activist accused of spreading Shia teachings in 2016 made little progress. In February, the wife of the second Christian pastor initiated legal action against the federal government and senior officials for failing to properly investigate her husband’s disappearance. In July, the High Court convicted a man for training members of a WhatsApp group to commit terrorist acts, including attacks on a Hindu temple and other houses of worship. The Sharia High Court pursued contempt charges against a member of parliament who stated that sharia courts discriminated against women.

While such an approach has demonstrated streaks of viability in extricating Islam from overly legalistic mores, it is epistemologically undetached from the sharia- centric paradigm that has dominated the post-colonial Muslim intellectual make-up. This article argues that proponents of Maqāṣīd al- Sharī’a in Malaysia might have overlooked the more urgent need for a morally based framework that evaluates human action not on the extent to which humans observe external law but rather on how sensitively humans connect with God in the event of legal injunctions being adhered to, ignored or transgressed. What is needed in Malaysia in addition to Maqāṣīd al-Sharī’a is Maqāṣīd al-Akhlāq, whose origins are rooted in the Islamic spiritual tradition of taṣawwuf or sufism. Menurut salah salah seorang penduduk di Kampung Batu 6, Bandariang, Jamaliah Osman, dia peka dengan isu semasa berkenaan sungai tersebut, memandangkan Sungai Rui menjadi sumber pendapatan utama selain menoreh getah. “Di hujung sungai ini ada lagi kampung-kampung lain. Mungkin orang kampung ini tak kena, jadi mungkin belah sana yang kena. “Bila ada macam (bangunan) perkilangan ke apa lepaskan air, air (jadi) keruh dan bertompok-tompok macam awan. Kita boleh nampak tompok-tompok tu.
