MALAYSIA 2019 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Malaysia is a federal constitutional monarchy. It has a parliamentary system of government selected through regular, multiparty elections and is headed by a prime minister. The king is the head of state, serves a largely ceremonial role, and has a five-year term. Sultan Muhammad V resigned as king on January 6 after serving two years; Sultan Abdullah succeeded him that month. The kingship rotates among the sultans of the nine states with hereditary rulers. In 2018 parliamentary elections, the opposition Pakatan Harapan coalition defeated the ruling Barisan Nasional coalition, resulting in the first transfer of power between coalitions since independence in 1957. Before and during the campaign, then opposition politicians and civil society organizations alleged electoral irregularities and systemic disadvantages for opposition groups due to lack of media access and malapportioned districts favoring the then ruling coalition. The Royal Malaysian Police maintain internal security and report to the Ministry of Home Affairs. State-level Islamic religious enforcement officers have authority to enforce some criminal aspects of sharia. Civilian authorities at times did not maintain effective control over security forces. Significant human rights issues included: reports of unlawful or arbitrary killings by the government or its agents; reports of torture; arbitrary detention; harsh and life-threatening prison conditions; arbitrary or unlawful interference with privacy; reports of problems with -

Asia-Pacific Social Science Review (2017) 16(3): 46–64 RESEARCH ARTICLE Migration Control in Malaysia: Shifting Toward Internal Enforcement Choo Chin Low and Khairiah Salwa Mokhtar Universiti Sains Malaysia [email protected] Abstract This article examines two aspects of migration control in Malaysia. First, it deals with the question of how the securitization of border control is tied to a wider dynamics of national interest. Based on the notions of “security versus facilities,” this article contextualizes how the institutional sites of governance are frustrated by the open-border policy and a liberal visa policy. Second, the paper argues that internal enforcement is a neglected part of the state’s migration control. As a self-proclaimed country of “zero irregular migrants,” Malaysia has relied heavily on external control: militarizing border crossings and criminalizing irregular migrants through raids, detention, and deportation. The study used a hybrid technique of data collection which integrates elite interviews, official publications, and online news media. The paper highlights a pressing need to formulate a critical approach to internal enforcement. A shift to internal control—identification, surveillance, and employer inspections—is crucial in addressing the root causes of migration, though controlling physical borders is still important. As a result, quality assurance has been the key factor in promoting globalization in Malaysia Higher Education because English is becoming more prevalent in higher learning which is promoting more opportunity for foreign students. (2020) 32 SAcLJ 458 THE COURTS AND THE ENFORCEMENT OF HUMAN RIGHTS This article examines how the Malaysian courts have dealt with substantive human rights issues in the cases that have come before them, focusing particularly on the last ten years. It highlights cases where the courts demonstrated greater willingness to review executive action and parliamentary legislation and test them against constitutional provisions that protect fundamental liberties such as the right to life, and freedom of expression, association and assembly. It also looks at cases which have taken a less flexible approach on these issues. The article also touches on the issues of access to justice, locus standi and justiciability of cases involving human rights issues before the Malaysian courts.
