THE IRON COLD OF THE MARSHALL TRILOGY ∗ MATTHEW L.M. FLETCHER This house is old. For two hundred years a woman has risen in the iron cold of the deepest hour. —Louise Erdrich1 Students of American Indian law cannot—and should not—escape from reading the three famous opinions of Chief Justice John Marshall that expounded for the first time in the halls of the United States Supreme Court the bases for federal Indian common law—the opinions we now refer to as the “Marshall Trilogy.”2 These foundational principles resonate today,3 more than eighteen decades after the Court put them into words. These three decisions, Johnson v. M’Intosh,5 Cherokee Nation v. Georgia,6 and Worcester v. Georgia,7 written in the obtuse legalese of the day,8 identified the contours of American Indian law as they remain today in the modern era. These opinions are the house in which American Indian advocates, leaders, and policymakers rise each morning—and it is a house filled with an iron cold of the deepest hour. This essay is an attempt to reexamine the Trilogy for its continuing relevance to students of modern American Indian law. The law does not re- main stagnant. The law of the Marshall Court is no longer the only word in federal Indian law.9 But the pedagogical value of the Marshall Trilogy goes far beyond the mere holdings of the cases. That is not to say the holdings are not significant—they are. But, as Justice Baldwin wrote in Cherokee Nation, the “reasons” for the holdings are more significant than the holdings themselves.10 There are seven opinions in the Trilogy, with the three main opinions authored by Chief Justice Marshall. The arguments, concepts, and notions in these opinions resonate today, about 170 years after the last of the decisions. The argumentation of these Justices incor- porates the seeds of the entire catalog of the current doctrine making up American Indian law. For a new student of federal Indian law, these three cases are a microcosm of the entire course to come. It is fitting that these three cases often are the first cases confronted in the course,17 but it is somewhat disturbing to realize how little the debates have changed over the centuries. This essay reexamines the Marshall Trilogy for the pedagogical value that reading and understanding the Trilogy may have for students of federal over Foreign Affairs, 81 TEX. L. Anthropology and history contain the most knowledge pertaining to American Indians, derived from their long traditions of scholarship focusing on American Indians. The other social sciences are far behind. Consequently our social science knowledge about American Indian peoples and their concerns is not balanced but biased by the disciplinary perspectives of anthropology and history. The likelihood that American society contains little realistic knowledge about contemporary American Indians in comparison to knowledge about traditional and historical American Indians is perhaps a function of this disciplinary imbalance.

There exists no better example of this truism than the United States Supreme Court’s ruling last summer in McGirt v. Oklahoma (and related case Sharp v. Murphy). A surprise, groundbreaking decision, McGirt held that the treaties that the United States signed with the Muscogee (Creek) Nation in 1832 and 1833 remain binding and that considerable territory in eastern Oklahoma remains, for the purposes of A2D jurisdiction, “Indian country.” As legal scholar Ronald Mann wrote, “The decision is a stunning reaffirmance of the nation’s obligations to Native Americans.”1 Associate Justice Neal Gorsuch, who wrote the majority opinion, held that until Congress formally and explicitly abolishes those agreements, the treaties remain in force. The ruling opinion was an unambiguous statement of the importance of treaties. Rather than considering them historical artifacts, treaties persist to this day as binding agree- C34DDD,23:58,DC7C22:232D ments.2 And it is worth remembering that fact nearly 150 years after Congress formally put an end to the practice of treaty-making. In March 1871 Congress ended its nearly century-old practice of formal treaty-making with Indian tribes.

Bremer* For more than a decade, controversy has raged over whether and when a U.S. state's execution of a convicted foreign national can be delayed by an International Court of Justice (ICJ) judgment under the Vienna Convention on Consular Relations (Vienna Convention). On several occasions-most recently on July 7, 201 1-the Supreme Court has declined to stay such an execution, even though the foreign national was convicted without being informed of his rights under the Vienna Convention. One doctrine raised to bar enforcement of the ICJ judgment was the last- in-time rule, which provides that when a statute and treaty conflict, the most recent instrument governs. A 2004 ICJ judgment held that the United States had violated the Vienna Convention rights of fifty-one Mexican nationals and further decreed that U.S. courts should remedy the violations by reconsidering those nationals' convictions. Such relief would have been barred, however, by the Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA), a statute enacted after the 1969 ratification of the Vienna Convention, but before the 2004 ICJ judgment. The Supreme Court suggested, though it did not conclusively decide, that AEDPA would trump the Vienna Convention under the last-in-time rule. In the Court's analysis, the Executive's decision to submit to the jurisdiction of the ICJ in the proceedings resulting in the 2004 judgment was legally irrelevant. This Article argues that the Supreme Court's suggestion is incorrect-the Executive's decision to submit a dispute to an international tribunal under a valid treaty regime is a legally cognizable expression of the "dynamic" sovereign will.
