PARADISE LOST: THE CLINTON ADMINISTRATION AND THE EROSION OF EXECUTIVE PRIVILEGE JONATHAN TuRLEY* INTRODUCTION In Paradise Lost, Milton once described a "Serbonian Bog ... [w]here Armies whole have sunk."' This illusion could have easily been taken from the immediate aftermath of the Clinton crisis. On a myriad of different fronts, the Clinton defense teams advanced sweep- ing executive privilege arguments, only to be defeated in a series of judicial opinions. This "Serbonian Bog" ultimately proved to be the greatest factor in undoing efforts to combat inquiries into the Presi- dent's conduct in the Lewinsky affair and the collateral scandals.2 More importantly, it proved to be the undoing of years of effort to protect executive privilege from risky assertions or judicial tests.' Sexist News Commentary on the Hillary Clinton and Sarah Palin
Three Networks, Two Candidates, One Problem: Sexist News Commentary During Hillary Clinton’s Presidential and Sarah Palin’s Vice-Presidential Campaigns Drue Marr | University of Nebraska – Lincoln This paper examines the political commentary of three major U.S. television news networks for their portrayal and criticism of and sexist commentary on Hillary Clinton and Sarah Palin during their 2008 presidential campaigns and Clinton’s 2016 presidential campaign. I reviewed coverage by CNN, the news source “bordering the neutral zone” (Langlois); MSNBC, the news outlet with a “slightly more lib- eral audience” (Blake); and Fox News, the “perceived as right-leaning” media outlet (Rothwell). While I originally sought to assess imbalances in criticism of these women from opposing parties on each net- work (would one woman “catch a break” on a certain network but not from others), I instead found an even display of criticism and negative portrayal based on sexist commentary across all three. This find- ing suggests a connection between openly biased and sexist news media coverage of female candidates for national political office and underrepresentation of women in congressional and presidential politics. Through negative commentary on female politicians’ appearance, family roles, and competence based on stereotypes like “emotionality,” mainstream news media play a powerful role in women’s continuing struggle to occupy the White House. It was “the most watched TV program ever.”1 That honor had long been held by the final episode of M*A*S*H, watched by 106 million more than twenty-five years ear- F2 lier. Not surprisingly CBS CEO Les Moonves was elated. “For anyone who wants to write that broadcasting is dead, 106 million people watched this program,” he crowed. “You can’t find that anywhere else.”3 Yet we are purportedly in the “post-television age.”4 At a moment in time when “the death of the thirty-second spot” is almost a foregone con- clusion, some thirty-four brands, including the U.S. Census (amid some controversy), made the decision that paying an average of $2.7 million for a thirty-second spot was a sound strategy.5 Brands purchased sixty-seven ads for a total of thirty-six minutes of advertising time. Accord- ing to the executive vice president and director of strategic planning at McCann Erickson, the Super Bowl is “less about the relevance of a message but more about the entertainment quo- tient. [Marketers] aren’t selling a product; they are creating brand buzz.”6 Another advertiser agreed. “It’s never about the Super Bowl ad itself. It’s the best online buzz for the buck.”7 Live polling to determine the most popular commercial took place on a number of sites; winners varied. -

This was a dubious enter- prise, no matter how you slice it. Whether it was illegal for the re- porters to approach the grand jurors or not, it was definitely illegal for grand jurors to leak information to reporters. In advance of the decision, Ben called his lawyers, Joe Califano and Edward Bennett Williams, to get their advice.(A[’ter leaving the Johnson administration, where he and Ben had squared ::off on ~/alter Washington and the Kerner Comnfission, Califano had joined Wil- liams’s law firm and now helped represent the Post.) In this study, beliefs and convictions are delineated by the extent to which the belief is also operationalized in policy; that is, a conviction is a belief that has been applied in a substantive manner. For example, as we will see in chapter 6 that deals with Reagan’s cognetic narrative, he had a belief that abortion was abhorrent and immoral, but he had a competing conviction that it was not a government’s role to impose limits on freedom of choice. In effect, his conviction about limited government overrode his belief about abortion from becoming a conviction. For members of the Religious Right, for whom prohibiting abortion was clearly a conviction, Reagan managed to assuage them with rhetoric, but the record shows that he did not act in a substantive manner. 2. Present were President Alan Bjerga, Secretary Myron Belkind, Treasurer Keith Hill, Membership Secretary Angela Greiling Keane, Governors Jessica Brady, Marc Wojno, Theresa Werner, John Hughes, Jennifer Sergent, Mike Soraghan, Rodrigo Valderrama, Ed Barks, Donna Leinwand (ex-officio) plus past president Rick Dunham as president of the Board of the Eric Friedheim National Journalism Library. Not attending: Vice President Mark Hamrick, Governors John Donnelly, Shawn Bullard. Staff present: Executive Director Bill McCarren, Assistant General Manager David King and Sarahanne Driggs, director of membership recruitment. The Minutes from the April 19, 2010 meeting were unanimously approved. Proposed Renovations Assistant General Manager David King briefed the Board on preliminary plans for renovations to the Reliable Source kitchen and the bathrooms on the 13th floor. He said more complete plans would be available for the Board’s meeting in May. The important goals of the renovations in the Reliable Source kitchen include increasing the levels of food safety proficiency, menu flexibility and energy efficiency. It is anticipated that all the works will begin after the Club’s closing on Friday, July 30, with a projected completion date of Monday, September 6 (Labor Day). Membership Report On the recommendation of Membership Secretary Angela Greiling Keane, the Board unanimously approved the application of 23 members (see list at end of Minutes), retired status for 1 member and a six-month hardship dues waiver for 5 members. The number of new members so far this year is 116, compared to 191 for the same period last year. -
