GREG WEEKS) The game of baseball has rarely changed since its beginnings, and its resultant ascent to the United States national pastime has done little to change the fundamentals of the sport. However, there have been significant shifts in the demographics of Major League Baseball. Latino players have seen their numbers jump up to 26.9% (2012) from single digits in the 1960s, while African-American players peaked at 18.5% two decades after desegregation, but has since fallen to the current (2012) level of 7.2%. The goal of this research project is to determine the cause for the rise in the numbers of foreign-born Latino baseball players appearing in the United States’ top baseball league. Previous historiography on the subject has suggested that U.S. neocolonial patterns led to baseball’s wild spread across parts of Latin America; consequently, these patterns contribute to the significant influx of foreign-born Latinos debuting in Major League Baseball. What has not been examined extensively is the effect economic factors have on the rise and fall of the number of players moving to Major League Baseball.

MURPHY* INTRODUCTION “How can you not be romantic about baseball?”1 Imagine a warm summer evening in Rome, Georgia. This city of just under 36,000 residents2 is home to the Rome Braves, the Class-A affiliate of the Atlanta Braves.3 State Mutual Stadium is filled to capacity as the local residents pack the stands to cheer on their hometown Braves.4 The smell of peanuts, popcorn, and hotdogs emanates throughout the stadium. A beer vendor climbs up and down the stadium steps hollering, “Ice cold beer!” Between innings, children are brought out on the field to partake in on-field promotions. After the game, these same children line up to run the bases, meet the mascot, and enjoy the postgame firework display. This minor league game brings the people of Rome, Georgia together and provides them with a common identity. Bradley Reynolds, general manager of the Double-A Mobile BayBears, highlighted the importance of minor league baseball when he said, “What keeps fans coming back isn’t baseball. If they want a better baseball game, they can see it on ESPN. This is about affordability, family fun, wholesome entertainment. That’s what makes this business unique and what makes it work.”5 Considered to be “America’s National Pastime,”6 baseball holds a special place in the hearts of many. He concluded that, “What is actu- ally being invaded here is America and its hold on its theoretical na- tional pastime. We’re not sure exactly when this happened—possi- bly while you were busy watching a Yankees-Red Sox game—but this isn’t just America’s sport anymore. It is Latin America’s sport.” While it may not have gone that far yet, the presence of Latino players in baseball, especially in Major League Baseball, has grown enormously. In 1990, the Racial and Gender Report Card recorded that 13 percent of MLB players were Latino. In the 2009 MLB Racial and Gender Report Card, 27 percent of the players were La- tino. The all-time high was 29.4 percent in 2006. Teams from South America, Mexico, and the Caribbean enter the World Baseball Classic with superstar MLB players on their ros- ters. Stark wrote, “The term, ‘baseball game,’ won’t be adequate to describe it. These games will be practically a cultural symposium— where we provide the greatest Latino players of our time a monstrous stage to demonstrate what baseball means to them, versus what baseball now means to us.” American youth have an array of sports to play besides base- ball, including soccer, basketball, football, and hockey.

Broshuis* Abstract Collective bargaining has significantly altered the landscape of labor relations in organized baseball. While its impact on the life of the major league player has garnered much discussion, its impact on the majority of professional baseball players—those toiling in the minor leagues—has re- ceived scant attention. Yet an examination of every collective bargaining agreement between players and owners since the original 1968 Basic Agree- ment reveals that collective bargaining has greatly impacted minor league players, even though the Major League Baseball Players Association does not represent them. While a few of the effects of collective bargaining on the minor league player have been positive, the last two agreements have estab- lished a dangerous trend in which the Players Association consciously con- cedes an issue with negative implications for minor leaguers in order to receive something positive for major leaguers.     Independent Professional Baseball Education Atlantic League The Atlantic League was founded in 1998 and consists of 8 teams, primarily on the East Coast of the United States. The league is a popular landing spot for former Major League baseball players who are looking to get back to affiliated baseball quickly. Typically, Atlantic League players are a little older and have previous professional playing experience. American Association / Can-Am League The American Association was founded in 2005 and consists of 12 teams in the Midwest and East Coast of the United States. The Association plays an integrated schedule with Can-Am League teams as both league share a commissioner and various front office staff. Typically, the American Association is made up of players with previous professional experience with a handful of rookies on each team. Frontier League The Frontier League was founded in 1993 and consists of 12 teams. It is the longest, continually operational independent league in professional baseball. Most teams in the Frontier League are located in the Midwest of the United States. The Frontier League is viewed as an ideal place to play for younger players with little or no professional experience. Frontier League bylaws state that each team may only have under contract a limited number of experienced players. Because of this, the Frontier League typically sends more players to affiliated baseball than any other independent professional league. The Frontier League also makes a point of signing young, exciting players with bright futures in the game as evidenced by their agreement with the California Winter League to sign players every year during the CWL season.

BJARKMAN El béisbol is the Monroe Doctrine turned into a lineup card, a remembrance of past invasions. – John Krich from El Béisbol: Travels Through the Pan-American Pastime (1989) When baseball (the spectacle) is seen restrictively as American baseball, and then when American baseball is seen narrowly as Major League Baseball (MLB), two disparate views will tend to appear. In one case, fans happily accept league expansion, soaring attendance figures, even exciting home run races as evidence that all is well in this best of all possible baseball worlds. In the other case, the same evidence can be seen as mirroring the desperate last flailing of a dying institution – or at least one on the edge of losing any recognizable character as the great American national pastime. Big league baseball’s modern-era television spectacle – featuring overpaid celebrity athletes, rock-concert stadium atmosphere, and the recent plague of steroid abuse – has labored at attracting a new free-spending generation of fans enticed more by notoriety than aesthetics, and consequently it has also succeeded in driving out older generations of devotees once attracted by the sport’s unique pastoral simplicities. Anyone assessing the business health and pop-culture status of the North American version of professional baseball must pay careful attention to the fact that better than forty percent of today’s big league rosters are now filled with athletes who claim their birthright as well as their baseball training or heritage outside of the United States.

    Athens Journal of Sports - Volume 4, Issue 4 – Pages 263-276 The H1N1 Virus and Mexican Baseball Attendance By Seth R. Gitter In 2009 the H1N1 virus severely affected many Mexican industries and decreased total GDP by as much as 0.5% according to some estimates. This study examines the relationship between the outbreak and social gathering. Using data from the Mexican National Health Service and Mexican League baseball game we find that the H1N1 outbreak reduced baseball game attendance by 15- 30% with a greater reduction in attendance where there were more reports of influenza-like illness. Furthermore, when the Mexican government used moderate social distancing measures that discouraged public gatherings, such as attending a baseball game, attendance declined an additional 20% controlling for the current infection reports. Introduction In May 2016, a group of 150 public health experts wrote an open letter to the World Health Organization (WHO) urging the postponement of the 2016 Summer Olympic Games in Rio de Janeiro out of concern for the potential to increase the spread of the Zika virus (Sun 2016). Sporting events with high attendance have the potential to spread an outbreak. The WHO and public health officials have had mixed success using public health warnings to reduce large gatherings during outbreaks such as the Severe Acute Respiratory Syndrome (SARS) in 2003 and H1N1influenza in 2009. The economic implications for these outbreaks are large, as Dixon et al (2009) estimate that a pandemic of 60 million flu infections in the US would decrease GDP by nearly 3% in one year.

INTRODUCTION Commentators have recently identified a lack of needed research con- cerning the history of sports law. More specifically, an analysis of the ori- gins of the entanglement of sports and litigation throughout history, as well as the manner by which sports have been governed by judicial law and in- ternal regulation is required. In an effort to respond to this need, this paper will trace and analyze historical litigation in the sport of professional baseball. Legal issues in sports generally revolve around three areas: contract law, antitrust law, and labor law.' In general, baseball's litigation history follows this very path while adding a few legal interpretations specific only to the game of baseball. A comprehensive case analysis will attempt to demonstrate the various challenges brought against organized baseball, the primary issues involved in the challenges, and how the results have im- pacted professional baseball. Baseball, with its lengthy professional history in the United States, pro- vides an ample volume of case review of legal concepts and their interrela- tionship with sports.
