Kevin Anderson, Head Coach of the Mississauga Aquatics Club will speak to MSSAC celebrating their 50th Anniversary as a competitive swim club and the commitment to supporting academic and athletic excellence and highlight the swimmers accomplishments in 2012 - 2013 year as well as MSSAC goals for the future. Mayor McCallion will present letters of accomplishments to the SWlmmers.

(b) Don McLean Westacres Pool

Dave Cook, President of the Applewood Acres Homeowners' Association and Jim Goodwin, Lion of the Mississauga Credit Valley Lions Club will present a cheque in the amount of $25,000 towards the construction of the Don McLean Westacres Pool in the Applewood Acres area. Mayor McCallion and Councillor Tovey will accept the cheque.

SUBJECT: Lower Driveway Boulevard Parking Bristol Road West (Ward 5)

RECOMMENDATION: That a by-law be enacted to amend By-law 555-2000, as amended, to implement lower driveway boulevard parking between the curb and sidewalk, at any time, on Bristol Road West between Swiftcurrent Trail and McLaughlin Road.

BACKGROUND: The Transportation and Works Department has received a request through Councillor Crombie's office to implement lower driveway boulevard parking on Bristol Road West between Swiftcurrent Trail and McLaughlin Road. A sidewalk is present on both sides of Bristol Road West and lower driveway boulevard parking between the curb and sidewalk is currently prohibited.

PRESENT STATUS: To determine the level of support for lower driveway boulevard parking between the curb and sidewalk, a parking questionnaire was distributed to the residents of Bristol Road West on September 18, 2013.

Seventy-seven (77) questionnaires were delivered and 22 (31 %) were returned; 18 (82%) supported the implementation oflower driveway boulevard parking and 4 (18%) were opposed. Council - 2 - October 15, 2013 ~, \La} ~~~------~~------~~~~~

Since greater than 66% of the total respondents support lower driveway boulevard parking, the Transportation and Works Department recommends implementing lower driveway boulevard parking between the curb and sidewalk, at any time, on both sides of Bristol Road West between Swificurrent Trail and McLaughlin Road.

The Ward Councillor supports the proposal for lower driveway boulevard parking.

FINANCIAL IMPACT: Costs for the sign installations can be accommodated in the 2013 ------Current Budgef

CONCLUSION: Based on the results of the questionnaire, the Transportation and Works Department supports lower driveway boulevard parking between the curb and sidewalk, at any time, on both sides of Bristol Road West between Swificurrent Trail and McLaughlin Road.

RECOMMENDATION: That a by-law be enacted to implement the temporary road closure of Mississauga Road from Erin Centre Boulevard to Reid Drive commencing at 9:00 a.m. on Friday, November 1,2013 and ending at 5:00 p.m. on Monday, November 4, 2013.

BACKGROUND: The Transportation and Works Department is in receipt of a request from the Canadian Pacific Railway Company (CP Rail) to have a road closure at the railway crossing on Mississauga Road in the City of Mississauga.

The road closure is requested in order to complete repairs to the railway crossing on Mississauga Road between Erin Centre Boulevard to Reid Drive starting on Friday, November 1,2013 for a period of four days.

COMMENTS: The CP Rail crossing on Mississauga Road is in need of repair. CP Rail has identified a track defect in both tracks at the above noted location. In order to nndertake the repairs, CP Rail requires the roadway to be closed to facilitate the removal and replacement of the ~/W ') Council - 2 - October 16,2013 ~==~------~~------~~~~~

railway tracks, ties, rubber panels and repaving of the asphalt approaches.

CP Rail will supply and install the appropriate closure signage to notifY the public of the closures. The Transportation and Works Department will notifY all emergency services, 311 Customer Service Centre, Student Transportation, GO Transit, and Mississauga Transit.

The Ward Councillor supports the proposed road closure.

FINANCIAL IMPACT: NOTapp1icaole.

CONCLUSION: In recognition of the need to complete the repairs to the CP Rail crossing on Mississauga Road, the Transportation and Works Department supports the closure of Mississauga Road from Erin Centre Boulevard to Reid Drive commencing at 9:00 a.m. on Friday, November 1,2013 and ending at 5:00 p.m. on Monday, November 4, 2013.

The City entered into an extension agreement witb the owners of 285 Wallenberg Crescent on October 26, 2011. The agreement provided for regular payments of the tax arrears with payment of tbe balance of tbe cancellation price being due on November 1, 2013.

COMMENTS: 285 Wallenberg Crescent Extension Agreement

The property at 285 Wallenberg Crescent is owned by Lawrence Mpamugo and Kathleen Mpamugo. The City entered into an extension agreement witb the owners on October 26,2011 which required tbe owners to make monthly payments of $750, pay the interim and [mal taxes each year as billed and pay tbe balance of tbe cancellation price by November 1, 2013. The owners have adhered to tbe terms of the agreement to date. Property taxes including penalties and interest in the amount of$18,409.77 remain outstanding.

The owners have requested an extension of the agreement to November 1, 2014. Legal Services has confirmed that the City has tbe ability to amend the end date of the Agreement provided Council approves it before tbe expiry of tbe existing agreement on November 1, 2013. There are no other changes to tbe terms of the agreement.

Delegation of Authority

Property owners have tbe ability to enter into a payment extension agreement witb the municipality within one year of registration of a Tax Arrears Certificate. Often, there is a delay in taxpayers making a request to enter into an agreement as they may look for otber options first (e.g. remortgage tbeir property) which may make it impossible to seek Council approval prior to tbe legislated deadline.

The last two summers Council has delegated the authority to enter into an extension agreement to the Director, Revenue and Materiel ((-3Ch) Council - 3 - October 15, 2013

Management. Council will be required to pass a confirming by-law following execution of the extension agreement. There will be no accompanying corporate report as the purpose of the by-law is self­ explanatory. Contracts will continue to be reviewed by Legal Services prior to execution.

CONCLUSION: The City entered into aT ax Arrears Extension Agreement with the owners of285 Wallenberg Crescent on October 26, 2011. The Agreement expires on November I, 2013. The owners have adhered to the terms of the agreement to date and have requested an extension t{) November I, 2014 to pay the balance of the cancellation price. An extension would avoid tax sale of the property provided the owners adhere to the terms of the agreement. Failure to meet any payment date and/or amount specified in the agreement will reinstate the tax sale process.

During the past two summer recesses, Council delegated the authority to enter into extension agreements to the Director, Revenue and Materiel Management.

(Benisasia Funeral Home Inc.), 3263 Derry Road East, north of Derry Road East, east of Airport Road, be adopted in accordance with the following:

1. That City Council direct the City Solicitor, representatives from the appropriate City Departments and any necessary consultants to attend the Ontario Municipal Board (OMB) hearing on the subject applications in support of the recommendation outlined in the report dated September 24, 2013 from the Commissioner of Planning and Building.

2. TC-0026-2013 That the deputation by Matthew Williams, Transportation Planner and Chris McCarthy, SNC­ Lavalin with respect to the Hurontario-Main Street LRT Project be received.

TC-0027-2013 1. That the Hurontario-Main Street LRT corridor_align.rp.entfrom the Port Credit GO Station northerly within Mississauga be approved and that Council authorization be provided to issue the Notice of Commencement for initiating the Ontario Ministry of the Environment Transit Project Assessment Process (Ontario Regulation 231/08).

2. That the report dated October 2,2013 entitled, "Hurontario-Main Street LRT Project" be forwarded to the Ministry of Transportation of Ontario with a request to review the operations of the QEW interchange at Hurontario Street, especially with regard to opportunities for reinstating the northbound to westbound ramp loop operations.

3. That the report dated October 2, 2013 entitled, "Hurontario-Main Street LRT Project" from the Commissioner of Transportation and Works be received by Transportation Committee and forwarded to the City of Brampton, Metrolinx, the Ministry of Transportation of Ontario and 407ETR for information.

TC-0028-2013 That Transportation Committee provide direction regarding the Port Credit Business Improvement Area's request to waive on-street parking charges within the Port Credit Business Improvement Area for the month of December 2013.

TC-0029-2013 That a by-law be enacted to amend By-law 555-2000, as amended, to implement 30-minute parking anytime on the west side of Living Arts Drive from a point 10 metres (32 feet) north of Prince of Wales Drive to a point 10 metres (32 feet) northerly thereof.

TC-0030-2013 That a by-law be enacted to amend By-law 555-2000, as amended, to extend the existing 40 kmIh speed zone on Tamar Road. The new zone will extend between a point 110 metres (360 feet) south of Millcreek Drive and Copenhagen Road. This amendment also includes the addition of the existing zones on Tamar Road and Millcreek Drive that are currently signed in the field but not included in the by-law. TC-0031-2013 1. That a by-law be enacted to implement the temporary road closure of the intersection of Hazelton Place and Plantation Place commencing Monday, November 4,2013 and ending on Friday, November 22, 2013.

2. That a by-law be enacted to amend By-law 555-2000, as amended, to implement the following:

a) Yield conditions on Hazelton Place and Plantation Place for all movements entering the roundabout.

b) One-way traffic in a counter-clockwise direction for traffic within the roundabout.

TC-0032-2013 That a by-law be enacted to amend Traffic By-Law 555-2000, as amended, to remove a stopping prohibition on both sides of Windwood Drive between Andorra Circle (west intersection) and Tours Road.

TC-0033-2013 That McNally-Kiewit-Aecon Partnership be granted an exemption from Noise By-law No. 360- 79, as amended, to allow for extended construction work for the second phase of twinning of the existing West Trunk Sanitary System between Highway 401 and Queen Elizabeth Way (QEW), commencing Friday, November 1,2013 and ending Monday, August 31, 2015.

TC-0034-2013 That the request for a Crossing Guard at the intersection of Bristol Road West and Heatherleigh Avenue for the students attending St. Valentine Catholic School be denied as the warrants have not been met and that the Site Inspection Subcommittee of Traffic Safety Council re-inspect the location in October 2013 after the Thanksgiving holiday and prior to the October Traffic Safety Council meeting. TC-0035-2013 That a second Crossing Guard be implemented at the southwest comer of Cliff Road and The Queensway for the students attending St. Timothy Catholic School as the warrants have been met. (TSC-0093-2013)

The Budget Committee presents its third report for 2013 and recommends:

BC-0005-2013 That the Corporate Report dated September 26, 2013 from the Commissioner of Community Services entitled "Sport Field Rates" be deferred to the next Council meeting on October 30, 2013 to enable Recreation staff to meet with David A. Huctwith, President, Mississauga Southwest Baseball Association, and Robert (Bert) Dagnon, President, Mississauga North Baseball Association, to discuss their concerns regarding the Corporate Report and proposed changes to sport field rates.

BC-0006-2013 1. That the new and revised fees outlined in Appendix 1 and Appendix 2 attached to the Corporate Report dated October 3, 2013 from the Commissioner of Corporate Services and Chief Financial Officer entitled "2014 General Fees and Charges By-Law Amendments" be approved; and 2. That a by-law be enacted, effective January 1, 2014, to establish and require payment of various fees and charges under the authority ofthe Municipal Act that incorporates all existing general fees and charges and the recommended revisions, as outlined in Appendix 1 and Appendix 2 attached to the Corporate Report dated October 3, 2013 from the Commissioner of Corporate Services and Chief Financial Officer entitled "2014 General Fees and Charges By-Law Amendments" and that By-Law 240-12, as amended, be repealed.

GC-0588-2013 1. That the vendors included on Appendix 1, attached, be designated as vendors of record for the supply and delivery of replacement parts and sublet repair services for Transit buses.

2. That the Purchasing Agent be authorized to execute annual blanket order contracts with the designated vendors of record for the supply and delivery of replacement parts and sublet repair services for Transit buses, as required.

GC-0589-2013 That the City of Mississauga assume the municipal works as constructed by the developer under the terms of the Municipal Works Agreement for City File No. OZ 001/02, De Zen Construction Company Limited OIBIO 678604 Ontario Inc. associated with 98 William Street, (lands located north of the Streetsville Plaza, south of Caroline Street, west of Queen Street South, and east of St. Lawrence & Hudson Railway, in Z-39(E» known as William Street Reconstruction and that the Letter of Credit in the amount of $81,444.00 be returned to the developer. GC-0590-2013 1. That the draft Corporate Policy entitled "Park Pathway Lighting" attached as Appendix 1 to the Corporate Report dated September 16, 2013 from the Commissioner of Community Services be approved.

2. That the existing Corporate Policy and Procedure "Park Path Lighting Design and Construction Standards" policy 05-02-06, attached as Appendix 2 be rescinded.

GC-0591-2013 1. That notwithstanding that location film in residential areas will be limited to two permits per calendar year for each residential block before residents are required to provide 80% approval, the Director, Culture Division may elect to require that the company seek approval of at least 80% of the impacted residents for the first and subsequent film permit requests; (i) In areas where there are extenuating circumstance; and (ii) Multiple issues and concerns have been brought forward to the film office by a number of residents in the past. GC-0592-2013 That the revised Corporate Policy and Procedure Arena Ice Allocation 08-03-03, attached as Appendix 1 to the Corporate Report dated September 25,2013 from the Commissioner of Community Services be approved.

GC-0593-20 13 1. That the Purchasing Agent be authorized to execute the necessary contract with Ridgeway Occupational Consultants Inc. on a single source basis in the estimated amount of $1,033,115.35 (exclusive of taxes) for the provision of an Employee Health Services Program for a ternl of five years ending December 31, 2018.

2. That the Purchasing Agent be authorized to issue contract amendments to increase the value of the contract where necessary to accommodate additional services subject to budget availability.

GC-0594-2013 That a by-law be enacted authorizing the Commissioner of Community Services and the City Clerk to execute a Ground Lease Agreement, and all documents ancillary thereto including amending agreements, between The Corporation of the City of Mississauga ("City") as Landlord and Bell Mobility Inc. ("Bell") as Tenant, for the use of a portion of a municipal park known as Lisgar Fields (P-359), for a term of five (5) years commencing on January 1,2014 and expiring on December 31, 2018, together with three (3) options to extend of five (5) years each, to permit Bell to install and operate a telecommunication cell tower. The subject property, containing an area of approximately 48 square metres (517 square feet), is located on the north side of Doug Leavens Blvd., in the City of Miss iss aug a, Region of Peel, in Ward 10. GC-0595-2013 1. That the irregular-shaped parcel ofland located on the north side of Eglinton Avenue West, east of Orbitor Drive, containing an area of approximately 22.2 square metres (239.0 square feet), be declared surplus to the City's requirements for the purpose of sale to the adjoining owner, Peel Condominium Corporation No. 431 ("Condo 431"). 3. GC-0596-2013 I. That the Investigator Services Agreement dated December 12, 2007 between The Corporation of the City of Mississauga and Local Authorities Services Limited ("LAS") be renewed in accordance with the automatic renewal provisions contained therein, until such time as the retainer or investigation fee increases.

2. That the Mayor and the City be authorized to execute the Addendum to the Investigator Services Agreement to give effect to a fee increase for the new term starting in 2014, in a form satisfactory to Legal Services.

3. That all necessary bylaws be enacted.

BACKGROUND: At the Budget Committee Meeting of November 21,2011, Council received a Corporate Report entitled "Recreation and Parks Pricing Study Final Report" from the Commissioner of Community Services. In that report Council approved the recommendations of the Pricing Study in principle subject to armual review through the budget process and the approval of recreation program and rental fees.

The Pricing Study is founded on the principle that, in order to ensure service sustainability, all Recreation and Parks & Forestry Lines of Business should endeavour to maintain or incrementally increase their cost recovery rate year over year. Since the revenue used to offset costs to provide Recreation and Parks & Forestry services is derived through property taxes or user fees, any additional revenue needed to maintain cost recovery, not recovered through user fees, will ultimately come from an increase in property taxes.

The key objective of the Pricing Study with reference to rentals was to ensure that a logical pricing foundation be established to facilitate a system that recognizes the importance of customer satisfaction and cost recovery.

Sports Field Pricing The Pricing Study made two (2) significant recommendations specific for sports fields: 1) that all sports field rental rates move to a structure based on an hourly rental rate and 2) that non-primetime rates for sport fields be eliminated. The move to an hourly rate created a consistent platform from which to compare prices and allowed staff to better manage and track utilization trends that are critical in determining capital expenditures and field provision levels.

The new sports field rental structure was presented to user groups in a series of engagement sessions in 2011 and 2012. Following these sessions youth affiliated ball groups had additional questions and areas of concern that needed to be addressed before the new structure would be supported. At the Budget Committee of November 26, 2012 Council received a Corporate Report entitled "Sport Field Rate & Deputation Response" from the Commissioner of Community Services. In that report staff addressed the concerns of the affiliated youth ball groups related to the new pricing structure and committed to meeting with affiliated youth groups anuually to review any issues from the current season and potential rates changes for the following season.

COMMENTS: To align with the principles of the Pricing Study and support a pricing framework that balances user fees with funding from taxes, staff recommends the following rate structure for the 2014 season:

The proposed rate structure is grounded in the key principle, as outlined in the Pricing Study, that the City endeavours to maintain and incrementally increase cost recovery year over year. Groups were advised that the City, at a minimum, would require pricing that maintains last years' recovery ratio.

The operating cost recovery rate for sport fields is projected to be 30.14% in 2013. As predicted utilization rates decreased in 2013 as groups adjusted to the new hourly rate structure and became more pragmatic when booking facilities. For 2014, Parks and Forestry is projecting increased costs to maintain fields resulting from higher labour .costs and materials and supplies costs which include grass seed, fertilizer and sports paint.

To manage utilization and cost pressures the rates and fees recommended apply greater increases on lit facilities in consideration of the general user type (competitive and adult), the higher associated costs to maintain lit facilities and what surrounding municipalities charge for lit facilities. gateway for young children to enter into sport which is an important aspect to healthy living and keeping youth active.

User Group Engagement th th Staff hosted two mcetings, August 19 and September 30 , with youth affiliated ball groups to reflect on the 2013 season and present the proposed rate structure for the 2014 season. Staff also consulted with other affiliated youth field groups regarding the proposed 2014 pricing structure. Those discussions did not result in any COncerns.

The following summarizes the feedback presented by the ball groups to staff through the engagement process:

Issue: Administering Tournament Rainouts and Streamlining Contracts

As a result of implementing the Pricing Study recommendations in 2013 groups were required to administer tournament rainouts and received a greater volume of contracts.

To address feedback regarding administering tournament rainouts and increased contract volume, staff recommends the introduction of a weekend rate (20% discount from the weekly rate). The tournament rate has been removed to facilitate this discount. The weekend rate recognizes the need to provide a reduced rate for groups to operate tournaments and would be eligible for the rainout discount (youth ball only) provided a minimum number of weeks are booked (22 weeks lit and 18 weeks unlit). This also streamlines the number of contracts groups would receive by reducing the variation of contracts required per season.

Initial reaction from the groups was positive however some focussed on the potential impact of removing the tournament rate and groups' ability to operate cost effective tournaments. Staff recognizes that groups will experience incremental rate increases to deliver tournaments as result ofthe new structure, however staff analyzed the potential impact of this change using 2013 utilization data and found that groups will save overall when booking weekend time assuming the same booking patterns. Issue: Sport Field Maintenance Levels

It is the ball groups' perception that maintenance service levels are higher in other municipalities and as a result that rates to book Mississauga facilities should be lower. Based on benchmarking of surrounding municipalities it has been determined that Mississauga's service levels are comparable. Further, when benchmarking the 2014 proposed rate structure staff found Mississauga's hourly rate to be more than 20% lower when comparing similar facilities in neighbouring municipalities. Table 3 provides a comparison of youth lit facility rates from surrounding municipalities.

Through the development of the Outdoor Sport Field Management Policy, the Mississauga Field Users Network will have an opportunity to review the City's current maintenance standards and assist in the development of new standards where it is deemed appropriate and necessary.

Issue: Capital Contributions Users have requested an ability to provide capital contributions to new capital, replacement and upgrade proj ects. Existing capital partnerships will continue to be respected and new requests considered on a case by case basis. Longer term, a capital partnership framework will be included in the Outdoor Sport Field Management Policy.

Issue: 2014 Proposed Rate Structure Youth ball groups believe that the lit facility price increase is too high. Although groups understand staff s intention to maintain and incrementally increase cost recovery ratios and the potential impact to the tax base should the City not maintain these ratios; principally groups believe that the City should only apply inflationary (2-3%) increases against all sport field facilities in order to maintain affordability for participants. u~ ~ \( e ;Udget Committee - 6 - September 26, 2013

The overall impact of the proposed 2014 pricing structure on affiliated youth ball groups is anticipated to drive incremental revenues of $8,118, wmch represents a total increase of 6.06% over 2013 and is predicated on no further decrease in utilization.

Future Sport Field Rates To maintain a balance between affordability and cost recovery and to belp groups forecast their budgets and fees, staff is proposing a 5-year rates and fees plan for sports fields. The plan proposes to incrementally increase the operating cost recovery rate from 30% to 32% over the next five years subject to Council approval through the annual Fees and Charges by-law. Table 4 outlines the proposed 5-year plan for sports fields.

FINANCIAL IMPACT: Tbe revenue impact of the proposed 2014 rates and fees for sportsfields are based primarily on market price comparisons, benchmarks and an examination of historical price changes and the impact on volume and utilization projections. Incremental revenues of $58,400 for sport fields is projected in 2014, predicated on no material change to utilization rates.

CONCLUSIO"l : The recommendations contained within tms Corporate Report are consistent with the framework, and methodology, endorsed by Council through the 2011 Recreation and Parks Pricing Study. The proposed pricing structure addresses some of the feedback brought forward by affiliated youth groups. The proposed rates and 5-year plan allows the City and sports organizations to continue to provide quality and affordable services for residents, wmle maintaining an appropriate balance between property taxes and user fees. REPORT • A review of the Committee of Adjustment Section of SUMMARY: Appendix 1 attached to the report titled "Amendments to the Planning Act Processing Fees and Charges By-law 253-12, as amended" from the Commissioner of Planning and Building was undertaken; • Appendix 1 was revised to clarify an increase to the Residential Multiple Application (l0 or more) within a Plan of Subdivision fee.

BACKGROUND: On October 16, 2013, Budget Committee considered a report titled "Amendments to the Planning Act Processing Fees and Charges By­ law 253-12, as amended" from the Commissioner of Planning and Building and a question regarding the Committee of Adjustment fees was brought forward regarding the Residential Multiple Application l)~,~ca)~c~ou~n~c~il ______-~2_- ______~O~ct~0~be~r~2~1,~2~0~13

(10 or more) within a Plan of Subdivision fee. The matter was referred to the October 30, 2013 Council meeting for clarification.

By way of background information, on October 17, 2012, Budget Committee considered and approved the recommendations contained within the Corporate Report titled Proposed Changes for the Committee of Adjustment Fees and Charges under Budget Committee recommendation BC-0027-2012 which was subsequently adopted by Council on October 24, 2012.

Within the new fee structure, a gradual increase to Minor Variance fees was proposed over a four year period starting in 2013. In addition, a gradual increase in fees for Consent was proposed over the same four year period. Council at that time determined that the Consent - New lot or lot addition application fee should be increased to the maximum level immediately in 2013.

The following table indicates the fees approved for 2013-2016:

COMMENTS: As noted in the Corporate Report titled "Amendments to the Planning Act Processing Fees and Charges By-law 253-12, as amended" from the Commissioner of Planning and Building under Appendix I, Schedule 'A' on page 10f II of Appendix I under the heading Minor Variances, it was noted that the Residential Application Fee was ufb-2{b) Council - 3 - October 21, 2013

increasing from $700 to $800 in 2014 in accordance with Budget Committee recommendation BC-0049-2012 which approved the gradual increase in Committee of Adjustment fees.

A question arose regarding the fee for Multiple Residential Applications (10 or more) within a Plan of Subdivision which was indicated on Appendix 1 of the Report to be $700 for the first 10 applications. This fee should have shown the base fee increase from $700 to $800. The attached Appendix 1 has been revised to reflect the correct base Residential Application fee increase for the Multiple Residential Application (l0 or more) within a Plan of Subdivision fee.

FINANCIAL IMPACT: There will be limited financial impact resulting from the change in fee as the Multiple Residential Application (l0 or more) within a Plan of Subdivision fee is not often utilized.

CONCLUSION: A review ofthe Appendix 1 attached to the Corporate Report titled "Amendments to the Planning Act Processing Fees and Charges By­ law 253-12, as amended" from the Commissioner of Planning and Building was conducted and a typographical error was found as the Multiple Residential Applications (l0 or more) within a Plan of Subdivision fee which should have reflected the base increase in the Residential Application Fee.

Dear Madam Mayor,

I'm sitting on the floor outside the Security Office as Crime Awareness Day 2013 is happening all around me. I can think of no more fitting way to finally deliver on my February 2010 promise to meet with you to discuss my concerns relating to the City's governance in general, and your Corporate Security "force" in particular.

Please remember that I requested permission to document our meeting on video and you responded with "anything yon want", I also understand that at best, I might be able to get an hour of your time. I propose that we meet on Monday, October 6, 2014 -just over a year from uow. I chose this date for three reasons.

First I've attended enough court sessions to know that to make the most efficient use of time, lawyers exchange factums. I propose to do that as well-provide you a series of factums over the course of a year, to be included in Council and Governance Committee minutes. These factums will be Freedom of Information documents, and audio/video evidence (ie: Staff interviews, meetings, speeches etc).

The Oxford dictionary defines "factum" as:

I'm sure you'll agree that if! state something supported with Freedom of Information, audio, or video evidence, then the factum will indeed be "facts of a case". Your Staff can review each and respond where they see I might be in error. Or not.

My third and fmal reason for waiting a year is that I know that nothing I say or do will actnally have any effect on anything, other than setting the record straight and finally answering your question.

What question?

You asked it during the October 16, 2008 Peel Police Homicide Information Session at Peel Regional Council. Frustrated by the spike in homicides that year, you'd asked Chief Metcalfe and Peel Regional Council, "We're spending a lot of money on programs. What is missing?"

You asked "What is missing?" five years ago. I submit that the answer to your "What is missing?" goes a long way to explain what is missing in the McMurtry/Curling Review of the Roots ofYouth Violence report.

The City's 2013 Crime Awareness day is a rainy, gray affair and I've taken enough time sitting on the floor of the Great Hall.

I've just cbecked tbe Malton CC MissCorp/sec database printouts. Tbey're from the same FOr batch as the Burnhamthorpe one --stats from for all major community centres up to September 20,2008.

So I'd assume that there'd be a Burnhamthorpe-specific searcb, a McKechnie-specific search, a Malton­ specific search, a RiverGrove one etc etc.

I've confirmed that so far three "all community centres" and ''all facilities" bans show up DO for the Malton-specific FOr search ..

So why not Burnhamtborpe?

So who at MissCorpSec confmned your suspicions that the reason the Youth didn't show was because the printout was for a facility-specific searcb. Because tbat's simply wrong.

I was concerned to learn that Mississauga is considering passing a resolution to oppose the above repository based only on infonnation provided by opponents.

For clarity, I am a proponent for this project, and a citizen of Clarkson.

This is an important project for Ontario. In this project, low & intennediate level radioactive wastes currently stored temporarily at surface at the Bruce nuclear site near Kincardine will be safely placed 680 m below surface in the very stable rock at the Bruce site. These wastes are from the production of electricity by nuclear stations in Ontario. These stations have provided about half of Ontario's electricity for the past 30-40 years. This project is a responsible approach to managing these wastes.

This project has been in the planning stage for about 10 years. It is presently being evaluated by the relevant federal authorities, and in particular by a federal Joint Review Panel. I strongly recommend that you let the expert panel do its job. Alternatively, you should seek input on this from Mississauga citizens. I would be happy to speak to this project. I am sure there are also other citizens knowledgeable in nuclear topics in Mississauga who could also provide input.

WHEREAS Ontario Power Generation (OPG) proposes to manage current and future low and intermediate level waste from its Bruce, Pickering, and Darlington facilities in a Deep Geologic Repository (DGR) near Kincardine 680 metres below the surface of the ground in limestone one kilometre from Lake Huron;

AND WHEREAS OPG asserts that the DGR is more secure than the current near­ ground storage;

AND WHEREAS the United States of America (U.S.A.) has identified and constructed a permanent depository for nuclear waste and the Government of Canada has not;

AND WHEREAS this proposal will set a precedent for the long term management of low and intermediate level radioactive waste from nuclear power generating facilities in the Great Lakes and SI. Lawrence basin;

AND WHEREAS the municipality of Kincardine came forward as a willing DGR host in 2002, and there has been extensive community outreach in the immediate area as well as extensive information available online, OPG did not sufficiently consult with the broader Great Lakes and SI. Lawrence community;

AND WHEREAS there are concerns that Kincardine is the right location as no other sites were considered;

AND WHEREAS the Great Lakes and SI. Lawrence Cities Initiative (Cities Initiative), an organization of over 100 cities from Canada and the United States representing over 16 million people that work together for the protection, restoration, and long-term sustainability of the largest body of surface freshwater, opposes the DGR proposal by OPG in Kincardine at this time;

It has been brought to my attention that federal funding came to an end on March 31" of this year for Heavy Urban Search and Rescue (HUSAR) teams across the country. The City of Mississaug. firmly believes this funding shOUld be restored.

These teams require highly technical training and specialized equipment and respond to low frequency, high hazard and very visible events with the potential for much loss of life.

Maintaining these skills within a limited number of fO'e departments across the country through federal funding support is a very effective way to maintain a high level of readiness in centrally located cities where these skills can be accessed by other municipalities. Funding these programs only at the local level by a few large cities leads to the risk they will be abandoned as too expensive for a localized tax source to support. This in tum negatively impacts the availability of these rescue programs to all municipalities.

National leadership is required for this type of emergency readiness to best match nationwide funding resources against the likelihood of serious emergencies either natural or manmade occun'ing anywhere in the country.

On behalf ofthe citizens of Miss iss aug a, I urge the Federal Government to restore this funding to ensure all communities in Canada have access to these specialized skills whenever they are needed.

AND WHEREAS there are very few, if any, stormwater systems in .Canada able to withstand the intensity of the storms occurring across Canada on a more frequently basis such as (Toronto August 2005, Mississauga August 2009, Winnipeg April 2011, Calgary June 2013, and West-Central GTA July 2013;

AND WHEREAS the Greater Toronto Area alone has had five extreme weather events over the last decade with rain intensity greater than the 100 year design storm;

AND WHEREAS before 1990, only three Canadian disasters exceeded $500 million in damages, in the past decade alone, nine surpassed that amount;

AND WHEREAS in the first 6 months of 2013, Canada has experienced two weather related disaster events estimated to be responsible for damages in excess of $1 billion with only one half of the damages covered by insurance;

AND WHEREAS weather-related water damages are now the leading cause of property losses and the highest percentage of residential insurance claims;

AND WHEREAS Canadian municipalities are on the front line of climate adaptation and mitigation policies, strategies and leadership;

AND WHEREAS recent disastrous extreme weather events across Canada have made climate charlge top of the public agenda and most notably on the urgency to adapt our communities' core infrastructure to a changing climate for the protection of Canadians and their communities, and the collaborative roles that all levels of government must play;

AND WHEREAS FCM Federal and Municipal programs Green Municipal Fund and Partners for Climate Protection have aided municipalities with capacity building tools to address climate mitigation, adaptation, and have proven economic benefits locally, regionally, provincially and nationally;

AND WHEREAS Canada is the only G8 country where people cannot buy insurance for overland flooding;

AND WHEREAS this Motion has been endorsed by the City of Mississauga's Environmental Advisory Committee at its meeting of September 10, 2013;

NOW THEREFORE BE IT RESOLVED that the Council of the City of Mississauga requests the Federation of Canadian Municipalities urge the federal government to incorporate climate change adaptation and mitigation principles within the Build Canada Fund; establish a permanent natural disaster relief fund; and provide sustainable funding for infrastructure to address residential and business flooding;

The Council of the Corporation of the City of Mississauga at its meeting on September 18,2013, adopted the enclosed Resolution 0159-2013 with respect to the Build Canada Fund.

Council requests that fue Federation of Canadian Municipalities urge the Federal Gove=ent to incorporate climate change, adaptation and mitigation principles within the Building Canada Fund. We also request that a permanent natural disaster relief fund be established to provide sustainable funding for infrastructure to address residential and business flooding.

On behalf of Members of Council, I urge you to incorporate climate change, adaptation and mitigation principles within the BuiJding Canada Fund.

WHEREAS Canada is seeing a dramatic increase in extreme weather events;

AND WHEREAS there are very few, if any, stormwater systems in .Canada able to withstand the intensity of the storms occurring across Canada on a more frequently basis such as (Toronto August 2005, Mississauga August 2009, Winnipeg April 2011, Calgary June 2013, and West-Central GTA July 2013;

AND WHEREAS the Greater Toronto Area alone has had five extreme weather events over the last decade with rain intensity greater than the 100 year design storm;

AND WHEREAS before 1990, only three Canadian disasters exceeded $500 million in damages, in the past decade alone, nine surpassed that amount;

AND WHEREAS in the first 6 months of 2013, Canada has experienced two weather related disaster events estimated to be responsible for damages in excess of $1 billion with only one half of the damages covered by insurance;

AND WHEREAS weather-related water damages are now the leading cause of property losses and the highest percentage of residential insurance claims;

AND WHEREAS Canadian municipalities are on the front line of climate adaptation and mitigation policies, strategies and leadership;

AND WHEREAS recent disastrous extreme weather events across Canada have made climate change top of the public agenda and most notably on the urgency to adapt our communities' core infrastructure to a changing climate for the protection of Canadians and theircommunities, and the collaborative roles that all levels of govemment must play;

AND WHEREAS FCM Federal and Municipal programs Green Municipal Fund and Partners for Climate Protection have aided municipalities with capacity building tools to address climate mitigation, adaptation, and have proven economic benefits locally, regionally, provincially and nationally;

AND WHEREAS Canada is the only G8 country where people cannot buy insurance for overland flooding;

AND WHEREAS this Motion has been endorsed by the City of Mississauga's Environmental Advisory Committee at its meeting of September 10, 2013;

NOW THEREFORE BE IT RESOLVED that the Council of the City of Mississauga requests the Federation of Canadian Municipalities urge the federal govemment to incorporate climate change adaptation and mitigation principles within the Build Canada Fund; establish a permanent natural disaster relief fund; and provide sustainable funding for infrastructure to address residential and business flooding;

AND FURTHER that the Federation of Canadian Municipalities and the Association of Municipalities of Ontario request similar endorsement of all their members in good standing;

AND FURTHER that this resolution be forwarded, for immediate attention and action to: the Prime Minister of Canada, the Right Honourable Stephen J. Harper, as well as Canada's Minister of Finance, the Honourable James M. Flaherty, and all local members of Parliament.

The timing of the signal at Bud Gregory and Central Parkway is set to slow walking speed which is the standard for crossings that are used by students and seniors. It has been set at slow walking speed since 2004. The Traffic Signals Department will review it in the next few weeks to ensure that the signal is working as it should so in plenty oftime for September school start.

By copy of this email to Sacha, I am requesting that TSC ask Recreation and Parks to give consideration to removing the signs that indicate there is no winter maintenance and ensure that the Huron Heights park paths do receive winter maintenance since a significant number of SI. Pio of Pietreicina Catholic School students use the paths to access the school.
