GENERAL OBSERVATIONS ABOUT THE FREE STATE PROVINCIAL GOVERNMENT The effectiveness of the Free State Provincial Government in realising its mandate of providing a ‘better life’ for the residents of the Free State must be considered in relationship to the limits of the State. What can and what cannot be realistically expected from a provincial government? There are two major observations in this regard: • The first concerns the Free State Provincial Government as an institution. How does it govern? How well does it govern? • The second concerns the ability of the Free State Provincial Government to have a positive impact on the lives of the residents in the Province. In the South African context both these issues need to be answered in the context of the transition from apartheid rule to democratic government. 1. In the first decade of democracy in the Free State, as in the country at large, much of the work of government was aimed at government itself: integrating heterogeneous apartheid administrations, including absorbing homeland governments; building a more representative public service; expanding how and where the provincial government operated; and expanding infrastructure and service delivery. As discussed in the Governance section of this report, the challenge of amalgamating fragmentary former homeland administrations with the Orange Free State Provincial Administration to produce a new, unitary provincial government was less onerous in the Free State than it was in other provinces – if only because the homeland areas were much smaller. The process of amalgamation was not, however, immune from the difficulties that accompanied regional transitions, including instances of departments supporting ‘ghost workers’ and the inheritance of ‘…divergent staff with different attitudes…’ (DPSA 1997). There have, however, been major challenges in the establishment of a provincial government as opposed simply to a provincial administration. Since 1994, provinces have been fully-fledged governments accountable to their citizens. In contrast to an administration that receives its mandate from another, higher tier of government – such that its functions are essentially technocratic – an elected tier of government must not simply establish the requisite instruments and procedures to get things done. It must develop priorities and it must plan in a way that respects the law and spirit of the constitution and that takes cognisance of the will of the citizens. Since 1994 this has meant the Free State creating ways of aligning the legislative and regulatory role of the Province with its administrative functions. There are two aspects of governance that emerged during our interviews that are worth noting. In the first place, the Free State Provincial Government, especially under Premier Winkie Direko, innovated in the field of governance. The province was the first to introduce the cluster system – to provide for coordination and dialogue between and across government departments. In principle, it creates opportunities for departments to work cooperatively and to overcome their inherent tendency to operate in isolation. The 4 success of the system in the Free State is uneven (see the section on Governance as well as the section on the Economy). It largely depends on the ability of MEC’s, heads of department and their staff to work together. Our interviews suggest that political competition between MEC’s and/or HOD’s sometimes mitigated against successful cooperation. On the other hand, when departments do work together all sorts of synergies are created. The second major issue that emerged during interviews was the uneasy relationship between the provincial government and the African National Congress (ANC), the ruling party in the Free State.     JOERNAAL/JOURNAL TWALA/BARNARD WINKIE DIREKO-A POLITICAL LEADER IN HER OWN RIGHT? Chitja Twala* and Leo Barnard** 1. INTRODUCTION To record merely that Winkie Direko, present premier of the Free State Province, was born on 27 November 1929 in Bochabela (Mangaung) and to an average family, will be an inadequate prelude to assessing her community and political life, which had an impact on her political career. Her entry into full-time party politics after the April 1994 first non-racial democratic election in South Africa caused a great stir in the Free State Province, and no one ever expected that she would rise to the premiership position after June 1999. This article attempts to provide an accurate, scientific and historical assessment of Direko as a political leader in her own right amid serious criticisms levelled against her before and after her appointment as the province's premier. The article, however, does not tend to adopt a defensive stance for Direko, but rather to answer a repeatedly asked question in the political circles of the Free State Province on whether Direko is a political leader or not. The article extends beyond narrowly held views that Direko emerged to promi- nence after she had been inaugurated as the province's second woman premier in 1999. In the political arena, some critics within the ruling African National Congress (ANC) in the Free State Province claim that there is no testimonial that can more aptly describe her political leadership role. The fact that she occupied the premiership position for almost five years unlike her predecessors is testimony enough that she is a political leader in her own right.

    Splitting Sovereignty: The Legislative Power and the Constitution's Federation of Independent States JAMES T. KNIGHT II* ABSTRACT From the moment the Constitutional Convention of 1787 ended and the Framers presented their plan to ªform a more perfect Union,º people have debated what form of government that union established. Had the thirteen sepa- rate states surrendered their independence to form a new state stretching from New England to Georgia, or was their individual sovereignty preserved as in the Articles of Confederation? If the states remained sovereign in some respect, what did that mean for the new national government? I propose that the original Constitution would have been viewed as establish- ing a federation of independent, sovereign states. The new federation possessed certain limited powers delegated to it by the states, but it lacked a broad power to legislate for the general welfare and the protection of individual rights. This power, termed ªthe legislative powerº by Enlightenment thinkers, was viewed as the essential, identifying power of a sovereign state under the theoretical framework of eighteenth-century political philosophy. The state constitutions adopted prior to the national Constitutional Convention universally gave their governments this broad legislative power rather than enumerate speci®c areas where the government could legislate. Of the constitutional documents adopted prior to the federal Constitution, only the Articles of Confederation provides such an enumeration. In this note, I argue that, against the background of political theory and con- stitutional precedent, a government lacking the full legislative power would not have been viewed as sovereign in its own right.

    ARTICLES STATE ENFORCEMENT OF FEDERAL LAW MARGARET H. LEMOS* Federal law is enforced through a combination of public and private efforts. Com- mentary on the choice between public and private enforcement has generated a remarkably stable set of arguments about the strengths and weaknesses of each type. But the conventional wisdom tells only part of the story, as it ignores varia- tions within the category of public enforcement. Many federal statutes authorize civil enforcement by both a federal agency and the states. State enforcement is dif- ferent from federal enforcement in several important respects, representinga unique model of public enforcement. The authority to enforce federal law is also a unique form of state power. As I show, enforcement authority can serve as a potent means of state influence by enabling states to adjust the intensity of enforcement and to press their own interpretations of federal law. To date, enforcement has been neglected in the federalism literature, which tends to equate state power with state regulation. But enforcement authority may exist outside of regulatory authority, allowing states to operate even in areas where state law is preempted or state regula- tors have chosen not to act. And enforcement empowers a distinct breed of state representatives-elected,generalist attorneys general. Just as state attorneys general differ from federal agencies as agents of enforcement, they differ from state agen- cies as agents of federal-state interaction.Moreover, attorneys generalin most states are independent from the state legislature and governor, and may represent dif- ferent constituencies. Enforcement authority therefore opens up new outlets for state-centered policy, empowering actors whose interests and incentives distinguish them from the state institutions that dominate other channels of federal-state dialogue.

    An historical exploration on service delivery and poverty alleviation The Premier’s Economic Advisory Council in the African National Congress-led government of the Free State Province, 1999-2004: An historical exploration on service delivery and poverty alleviation1 Chitja Twala Department of History University of the Free State [email protected] Abstract The article traces the impact and relevance of the service delivery and poverty alleviation strategies introduced by the African National Congress (ANC) led provincial government in the Free State Province. This was in line with the promises made by the ANC during its electioneering campaigns of a “better life for all”. South Africa was confronted with the challenge of transforming a racially and ethnically fragmented and unequal public service delivery system into one that would be able to meet the demands from a newly enfranchised citizenry for economic, social and political development. The legacies of apartheid, combined with widespread poor budgetary and financial management, a massive backlog in basic services and infrastructure, race and regional inequalities in provision, and sometimes tense social relationships, tended to limit opportunities for social development and expanded delivery.2 South Africa’s new Constitution guaranteed human rights and democratic governance, promised efficient delivery of services and implemented a number of reforms aimed at achieving equity, access and the redistribution of resources.
