Establishing 15 IP Tribunals Nationwide, Chinese Courts Further Concentrate Jurisdiction Over IP Matters March 15, 2018 Patent and ITC Litigation China has continued to develop its adjudicatory framework for intellectual property disputes with the establishment of three Intellectual Property Tribunals (“IP Tribunals”) this month. This reform began with the establishment of three specialized IP Courts in Beijing, Shanghai, and Guangzhou at the end of 2014, and has been furthered with the establishment of IP Tribunals in 10 provinces and two cities/municipalities around the country. For companies facing an IP dispute in China, understanding this framework in order to select the appropriate jurisdiction for a case can have a significant impact on the time to resolution, as well as the ultimate merits of the case. Most significantly, through the establishment of these IP Tribunals many Chinese courts have been stripped of their jurisdiction over IP matters in favor of the IP Tribunals. This has led to a fundamental change to the forum selection strategies of both multinational and Chinese companies. The three IP Tribunals established on the first two days of March 2018 are located in Tianjin Municipality, and cities of Changsha and Zhengzhou respectively. This brings the number of IP Tribunals that have been set up across 10 provinces and two cities/municipalities in China since January 2017 to a total of 15. The most unique aspect of the specialized IP Tribunals is that they have cross-regional1 and exclusive jurisdiction over IP matters in significant first-instance2 cases (i.e., those generally including disputes involving patents, new varieties of plants, integrated circuit layout and design, technical-related trade secrets, software, the recognition of well-known trademarks, and other IP cases in which the damages sought exceed a certain amount)3. -

For the first half of the 20th century, China faced political chaos. Following a revolution in 1911, which overthrew the Manchu dynasty, the new Republic failed to take hold and China continued to be exploited by foreign powers, lacking any strong central government. The Chinese Civil War was an attempt by two ideologically opposed forces – the nationalists and the communists – to see who would ultimately be able to restore order and regain central control over China. The struggle between these two forces, which officially started in 1927, was interrupted by the outbreak of the Sino-Japanese war in 1937, but started again in 1946 once the war with Japan was over. The results of this war were to have a major effect not just on China itself, but also on the international stage. Against the backdrop of a widespread scholarly claim that the Shanghai Cooperation Organization (SCO) plays no role in this endeavor, this thesis argues that Beijing acts as a security-seeker to bind both Kazakhstan and Russia into energy cooperation within the organization. Acting as a regional forum through which China channels and reinforces its oil dealings, I argue that the SCO corrects the pitfalls of a bilateral approach which elicits the counter-balancing of Chinese activities by Astana and Moscow who are concerned with the distribution of gains. Putting to a test differing hypothesis by rationalist IR theories, I find that the SCO approach enables China to assure both actors about its benign intentions and maximize gains on a bilateral level as expected by defensive neorealism. ASIA REPORT ISSUE NO. 47 DECEMBER 2019 Cross-Strait Relations under Stress: Chinese Pressure and Implications for Taiwan As China increases pressure on governments and corporations around the world to support its political objectives, Taiwan has emerged as a focal point in the region that exemplifies how to withstand or mitigate Chinese challenges. Nevertheless, Chinese military and political belligerence has numerous implications for Taiwanese security and domestic politics ranging from the tightening of Taiwan’s international space to the use of Chinese sharp power to influence the electorate. The Sigur Center for Asian Studies recently hosted a conference featuring two expert panels to discuss the impacts of Chinese pressure campaigns on Taiwan and other involved nations as well as how cross-strait relations might proceed because of these actions. Keeping Taiwanese Democracy Secure The conference began with opening remarks from Christine M. Y. Hsueh, Deputy Representative at the Taipei Economic and Cultural Representative Office. Deputy Representative Hsueh highlighted Taiwan’s role as a beacon of democracy, which contributes to pressure and attacks from China, such as election interference. With the recent failure of the “one country, two systems” policy in Hong Kong and Chinese President Xi Jinping’s threat to use force in reunification with Taiwan, the Taiwanese government is working to ensure that the status quo is not unilaterally altered by Chinese aggression. Although Taiwan faces many challenges in maintaining security and stability, outspoken support from Vice President Mike Pence and other figures in the current US administration have been encouraging signs for Taiwan moving forward. Reconstructing the Evolutionary History of Chinese Dialects Esra Erdem Institute of Information Systems, Vienna University of Technology, Vienna, Austria [email protected] Feng Wang Department of Chinese Language and Literature, Peking University, Beijing, China [email protected] Evolutionary relations between languages based on their shared characteristics can be represented as a phylogeny --- a tree where the leaves represent the extant languages, the internal vertices represent the ancestral languages, and the edges represent the genetic relations between the languages. On the other hand, languages not only inherit characteristics from their ancestors but also sometimes borrow them from other languages. Such borrowings can be represented by additional non-tree edges, turning a phylogeny into a phylogenetic network. With this motivation, we reconstruct the evolutionary history of languages in two steps: first we compute a plausible phylogeny with a minimal number of incompatible characters, and then we turn this phylogeny into a perfect phylogenetic network, by adding a small number of lateral edges, so that all characters are compatible with the network. For both steps, to formulate the problems and to solve them, we use answer set programming --- a new form of declarative programming. This method has been successfully applied to reconstruct the evolutionary history of Indo-European languages. In the following we summarize its application to reconstruct the evolutionary history of Old Chinese and the following 23 Chinese dialects: Guangzhou, Liancheng, Meixian, Taiwan, Xiamen, Zhangping, Fuzhou, Nanchang, Anyi, Shuangfeng, Changsha, Beijing, Yuci, Taiyuan, Ningxia, Chengdu, Yingshan, Wuhan, Ningbo, Suzhou, Shangai 1, Shangai 2, Wenzhou. We have started with a dataset consisting of 200 lexical characters (the Swadesh wordlist), each with 1--24 states. -
