  • Rich Rodriguez – Jumping Has Legal Consequences
deference to state high school athletic associations and educational institutions regardless of the adverse effects on students who are deemed ineligible to participate in interscholastic athletics, reflects the judiciary’s strong desire to avoid interfering with and micromanaging the high school educational process.69 In a forthcoming article Professor Timothy Davis and I have proposed that a high school or college athlete should be denied an opportunity to participate in a sport only if doing so actually furthers a legitimate objective of the governing body or a school such as ensuring academic integrity, maintaining competitive balance and fair play, or promoting appropriate standards of conduct.70 In summary, United States law does not establish any constitutionally protected or fundamental right to participate in sports. Nevertheless, Olympic and professional athletes are provided a means to seek independent de novo review of eligibility decisions, usually through a system of private arbitration. In contrast, despite the significant benefits of participation in intercollegiate or interscholastic sports competition, U.S. courts almost uniformly refuse to recognize a legally protected interest in interscholastic or intercollegiate athletic participation or apply more than very limited rational basis scrutiny of student-athlete eligibility determinations unless there is exclusion or discrimination prohibited on constitutional or statutory grounds. ___________ 69. Mo. 2000); Jones, 197 Cal.App.3d 751, 757 (1988) (Stating “schools themselves are far the better agencies to devise rules and restrictions governing extracurricular activities. Judicial intervention into school policy should always be reduced to a minimum”).

Off the fi eld, Stockstill made an immediate impact as well by dramatically improving the team’s APR to 949 from 892. A benchmark of all championship teams is the ability to win away from home, and Stockstill’s Blue Raiders demonstrated their mental toughness by winning a league-best four Sun Belt Conference road games on the way to a school record six conference wins in all. In fact, Middle Tennessee’s road success was among the best in college football in 2006–only 10 other teams won as many conference road games (Arkansas, Auburn, Boise State, BYU, Ohio, Ohio State, Oklahoma, Texas A&M, USC, Wake Forest). It is said you are only as good as the people you surround yourself with, and Stockstill assembled a championship staff well before he coached his first game. Stockstill’s staff sports two Super Bowl rings, three National Championships, 58 bowl rings, and 125 years of coaching experience. Along with his extensive background in collegiate coaching circles, the driven and determined Stockstill also has had the advantage of working alongside some of the greatest minds in college football history. These experiences were evident in his highly successful fi rst season at the helm. Stockstill, who made his way to Murfreesboro after spending the previous two years at South Carolina, has worked with legendary coaches Lou Holtz, Steve Spur- rier, Danny Ford, Tommy Bowden, Ken Hatfi eld, and Tommy West.

merican culture seems obsessed at times with crowning the best and greatest. One could certainly make that observation of Asports fans. Countdown shows have whittled away at great people and events to arrive at THE greatest ever. Boxers and tight ends have even declared themselves the greatest. And by just about any measure available, Bobby Bowden, who will lead the Seminoles for the 30th time in 2005, has put up the numbers suggesting he should be called the greatest college football coach in history. The statistics are startling. Bowden became the all-time winningest coach in major college history in 2003 and currently has 351 career wins. He is the winningest bowl coach by percentage and is just one shy of tying for the most bowl wins ever by a college coach. He is the only coach to lead his team to 14 straight seasons that ended with a ranking among the Associated Press Top five. He’s coached two national championship teams including the 1999 squad that was the first ever to go through a season from start to finish as the AP No. 1. So overwhelming has Bowden’s influence been on college football and, in particular, at Florida State, that the field at Doak Campbell Stadium backyard fence in Birmingham, Alabama. His love and talent for the was named for him last season and a national award given by the game grew from playing with friends on the same fields everyday and Fellowship of Christian Athletes now bears his name. later practicing with high school teammates. His knowledge of the Bowden’s interest in the sport of football began while watching game grew as a quarterback at Samford and from watching and his neighborhood high school team practice just on the other side of his listening to the legendary Bear Bryant.
