OUSD(I) asked RAND to help monitor and assess the poten- tial for effectiveness of this new DoD initiative to stem unauthorized disclosures of classified information, and make recommendations as needed. This report provides some overall observations of the RAND project team concerning the activities of the UD PIT for the period from mid-September 2012 through January 2013; then, building off those observations, the report recommends possible enhancements in the mechanisms and procedures that the UD PIT uses to accomplish its principal goals. While the study focus is limited to DoD, the recom- mendations may be of broader interest to the Intelligence Community (IC), since the DoD intelligence agencies and components belong to the IC and the scope of these issues is broader than DoD alone, and thus perhaps applicable to non-DoD IC elements. End-to-End Accountability Process ..............................17 vii Summary Introduction Recent unauthorized disclosures (UDs) of classified information, par- ticularly those to the public media that put sensitive operations and intelligence sources and methods at risk, have highlighted the inad- equacy of extant law and policy to address the causes of and remedies to such damaging disclosures. In response to this situation, the Under Secretary of Defense for Intelligence (USD(I)) has initiated a new series of comprehensive measures, all of which are encapsulated within a Strategic Plan designed to address this heretofore intractable issue. The Plan was developed by a Department of Defense (DoD) Unau- thorized Disclosures Working Group (UDWG) assembled in response to direction from the Defense Security Enterprise (DSE) Executive Committee (EXCOM) and subsequent amplifying tasking from the Under Secretary of Defense for Intelligence. Further, pursuant to the recommendations of the UDWG, OUSD(I) established an Unauthor- ized Disclosures Program Implementation Team (UD PIT) to oversee Strategic Plan implementation and its incremental improvement. More specifically, the UD PIT, endorsed by the Defense Security Enterprise Advisory Group (DSEAG), was established to prevent and deter the unauthorized disclosure of classified information by all personnel through the implementation of the UD Strategic Plan. With a view toward enhancing its odds of success and to discover any deficiencies that, if remedied, could improve the potential effec- tiveness of the overall program, OUSD(I) asked the RAND Corpora- tion to provide an outside perspective in assessing the program concept ix x Fixing Leaks and its early implementation. J. Robert Oppenheimer, who helped build the first fission bombs, commented often on this (1). Albert Einstein, whose letter to then President Franklin Roosevelt helped convince him to fund them, talked about the imperative to seek peace and new ways of thinking about everything as he neared death (2). Bertrand Russell coauthored a Manifesto with Einstein (and nine others) to warn the world that everything had changed (3). Yet thousands of thoughtful people still felt compelled by the urgencies of World War II to make nuclear weapons and to use two of them against other human beings. To end the war, they said to each other, and perhaps to show the Soviets who would be the big dog following. But then what? Another arms race had begun, and bigger, badder WMDs would be developed soon. As soon as more than one nation had nuclear weapons, some strategy had to be conceived for their use. Mutual Assured Destruction was the main result, and millions learned the irony of a “MAD” strategy, where safety was to be assured by capabilities and declared will to destroy human civilization if we were frightened enough by any enemy. Those we terrified produced similar weapons and strategies.

WikiLeaks' successive disclosures of classified U.S. documents throughout 2010 and 2011 invite comparison to publishers' decisions forty years ago to release portions of the Pentagon Papers, the classified analytic history of U.S. policy in Vietnam. The analogy is a powerful weapon for WikiLeaks' defenders. The Supreme Court's decision in the Pentagon Papers case signaled that the task of weighing whether to publicly disclose leaked national security information would fall to publishers, not the executive or the courts, at least in the absence of an exceedingly grave threat of harm. The lessons of the PentagonPapers case for WikiLeaks, however, are more complicated than they may first appear. The Court's per curiam opinion masks areas of substantial disagreement as well as a number of shared assumptions among the Court's members. Specifically, the Pentagon Papers case reflects an institutional framework for downstream disclosure of leaked national security information, under which publishers within the reach of U.S. law would weigh the potential harms and benefits of disclosure against the backdrop of potential criminal penalties and recognized journalistic norms. The WikiLeaks disclosures show the instability of this framework by revealing new challenges for controlling the downstream disclosure of leaked information and the corresponding likelihood of "unintermediated" disclosure by an insider; the risks of non-media intermediaries attempting to curtail such disclosures, in response to government pressure or otherwise; and the pressing need to prevent and respond to leaks at the source.     GCHQ and UK Mass Surveillance Chapter 5 5 Beyond signals intelligence: Offensive capabilities 5.1 Introduction Documents released by German magazine Der Spiegel provide a much richer picture of the offensive activities of the NSA and its allies, including the UK’s GCHQ.i The global surveillance infrastructure and hacking tools described in the previous chapters are not only used for obtaining information to be fed into intelligence reports and tracking terrorists. The agencies are also developing cyber-warfare capabilities, with the NSA taking the lead within the US armed forces. This militarisation of the internet saw U.S. intelligence services carried out 231 offensive cyber-operations in 2011ii. The UK's National Strategic Defence and Security Review from 2010 made hostile attacks upon UK cyberspace a major priorityiii. It is fair to assume that many countries are following suit and building cyber-warfare capabilities. Der Spiegel terms the development of these aggressive hacking tools as Digital Weapons. In their view D weapons which should join the ABC (Atomic, Biological and Chemical) weapons of the 20th century because of their indiscriminate nature. Here lies a fundamental problem. The modern world with connected global communications networks means that non-state actors such as civilians and businesses are now affected by the agencies’ activities much more frequently than before. The internet is used by everyone – cyberspace is mainly a civilian space – and the opportunity for collateral damage is huge. The papers leaked to Der Spiegel appear to show that signal agencies have little regard for the security and wellbeing of anyone who gets caught in the path of their operations.

  • In Defense of the American Surveillance State
    IN DEFENSE OF THE AMERICAN SURVEILLANCE STATE Dr. Gabriel Schoenfeld* ABSTRACT The term “American surveillance state” is something that has come into use by fierce critics of U.S. government counterterrorism efforts, efforts that necessarily contain surveillance as a critical element. A body of opinion has emerged arguing that thanks to the ubiquitous eyes of the National Security Agency, the Central Intelligence Agency, the Federal Bureau of Investigation, the Department of Homeland Security, and thanks also to the widespread distribution of myriad new forms of surveillance technology, privacy in America is being destroyed and George Orwell’s dark vision of Big Brother is on its way to realization. This Article rejects this characterization, and asserts that current counterterrorism efforts are an effective and appropriate response to ongoing threats. While history teaches us the government may at times overstep its bounds, even in today’s current national security climate the U.S. government’s approach is less intrusive than it has been in the past and is critical for protecting the safety of the American people.
