ORDER 17 This Application came on for hearing before The Ontario Energy Board on the 28th of September, 1960, in the presence of Counsel for the Applicant, Counsel for the Board, and J. W. Leavens, Manager, the Small Arms Division of Canadian Arsenals Limited, and Kenneth C. Culham, President, The Canadian Commercial Coal Dock Operators Association, in person, no one else appearing, although all the respondents and the public generally were duly served with notice of the said hearing, the respondent municipalities by mail and the general public by publication in daily newspapers having a circulation within the respondent municipalities.
18 The Application was continued on September 29th, 1960, and successively adjourned to and continued on October 20th, 1960, December 15th, 1960, January 9th and February 28th, March 28th and 29th and April 19th, 1961, and concluded on April 21st, 1961.
19 The Board after hearing all of the evidence adduced and what was alleged by Counsel aforesaid during the hearing of the said Application reserved judgment thereon and having delivered its Reasons for Decision this 15th day of August, 1961.

THE BOARD DOTH ORDER THAT, pursuant to The Ontario Energy Board Act R.S.O. 1960 Chapter 271, the rates set forth in the schedule of rates attached hereto and forming part of this order, which are the same as the rates set forth in the schedule of rates attached to the interim order of the Ontario Fuel Board F.B.R.O. 121 dated the 24th day of August, 1960, be and the same are hereby approved and will remain in effect until the 30th day of September, 1961.
21 2. AND THE BOARD DOTH FURTHER ORDER THAT the application of the Company for an order approving permanent rates dated the 7th day of January, 1955, be and the same is hereby dismissed.
22 3. AND THE BOARD DOTH FURTHER ORDER THAT the costs of the Board in this application, including the Board's disbursement of $925.00 to the Court Reporter, be and the same are hereby fixed a $17,033.00 to be paid forthwith by the Company.
23 DATED at Toronto this 15th day of August, 1961. ONTARIO ENERGY BOARD
