Conclusion .......................................... 12 P a g e | 2 1 Introduction This document supports the Development Application lodged by Infigen Energy Developments Pty Ltd with the State Commission Assessment Panel for the development and operation of the 25 MW (52MWh) Battery Energy Storage System on Section 244, hundred of Mayurra, Lakeview Road, German Flat (the Subject Land). This Planning Report has been prepared to support the Development Application and Statement of Effects Report submitted with the Application. 2 The Subject Land The subject land is Section 244, Hundred of Mayurra, Lakeview Road, German Flat and is owned by Infigen Energy Development Pty Ltd and is contained in Certificate of Title Volume 6129 Folio 170. A copy of the Certificate of Title is provided with the Development Application. The subject land is 56.83 hectares (or 140.43 acres) in area. Located on the subject land are 4 wind turbines (part of the applicant’s Lake Bonney Windfarm), the existing Lake Bonney Windfarm site office, windfarm substation and ancillary facilities. The subject land is shown on Photo 1 below. Photo 1 – the Subject Land and Snuggery Locality P a g e | 3 3 Project Description Overview The proposed Battery Energy Storage System will comprise the following components – . 300 battery units; . 48 inverters; . 8 Medium-Voltage transformers; . Associated cabling and communication systems required for the interconnection of the Battery Energy Storage System; and . Electrical Balance of Plant (EBOP) components to connect the proposed facility with the existing Mayurra substation. The Mayurra substation will also be extended to facilitate this connection. The area to be occupied by the proposed Battery Energy Storage System measures 100 metres x 100 metres (being 10,000 m2 or 1 hectare) while the area to be occupied for the substation extension works is 60 metres x 25 metres (being 1,500 m2). The subject land on which the proposed development of the proposed Battery Energy Storage System and Substation extension is to be undertaken is located in the Primary Production Zone of the Development Plan (Wattle Range – consolidated on 7 February 2013) and is not located in a Policy Area. An extract of Zone Map WatR/1 showing the location of the proposed development is in Plan 2 below. Plan 2 – Zone Map WatR/1 (Extract) The proposed Battery Energy Storage System and Substation extension is considered to be ancillary to the Lake Bonney Windfarm development and in the Primary Production Zone a windfarm and ancillary development is a form of development envisaged in eh zone and is categorised as a Category 2 development for the purpose of public notification. Wattle Range Council will be responsible for the assessment of the development application against the provisions of the Development Plan (Wattle). The following is an assessment of the proposed development against the relevant key provisions of the Development Plan for the Wattle Range Council area (Consolidated – 7 February 2013). Primary Production Zone Objectives & Principles of Development Control The most directly applicable provisions of the Development Plan in the Primary Production Zone section are discussed below. Objectives 1 Economically productive, efficient and environmentally sustainable primary production. 3 Protection of primary production from encroachment by incompatible land uses and protection of scenic qualities of rural landscapes. P a g e | 5 5 Accommodation of wind farms and ancillary development. Desired Character Wind farms and ancillary development such as substations, maintenance sheds, access roads and connecting power-lines (including to the National Electricity Grid) are envisaged within the zone and constitute a component of the zone's desired character. Principles of Development Control Land Use 1 The following forms of development are envisaged in the zone: ▪ commercial forestry ▪ dairy farming ▪ diversification of existing farming activities through small scale tourist accommodation ▪ farming ▪ horticulture ▪ intensive animal keeping ▪ wind farm and ancillary development ▪ wind monitoring mast and ancillary development. 2 Development listed as non-complying is generally inappropriate

The matters raised by you are more appropriately addressed to the Victorian Department of Transport, Planning and Local Infrastructure (formerly known as the Victorian Department of Planning and Community Development). They are not matters that fall within the powers of the Clean Energy Regulator (the Regulator) under the various Commonwealth legislation administered by the Regulator. The Clean Energy Regulator is an economic regulator. With respect to the Renewable Energy Target, the Regulator regulates both the supply of certificates (by ensuring the integrity of their creation by renewable power stations) and the demand and surrender of those certificates (by ensuring liable electricity retailers surrender the correct number of certificates). The Clean Energy Regulator is only empowered to administer relevant Commonwealth laws (eg to ensure that a wind farm operator complies with its responsibilities under relevant Commonwealth legislation that the Regulator administers). It cannot interfere in state-based activities. If a wind farm is not complying with State/Territory laws (eg as to planning requirements and noise control etc), it is a matter for the relevant State/Territory a.uthority to address. The Macarthur Wind Farm is an accredited power station under the Renewable Energy (Electricity} Act 2000 (the Act) and the Renewable Energy (Electricif:W Regulations 2001 (the Regulations). Once an eligible power station has been accredited, it remains accredited unless the Regulator decides to suspend the accreditation under Division 11 of Part 2 of the Act {being sections 30D and 30E and the circumstances prescribed for the purposes of subsection 30E(5) in regulation 20D of the Regulations).

    1 A brief chronology of SA EPA and other SA regulatory authorities awareness of wind farm noise complaints and ongoing evidence of LGA and community requests for review of the SA wind farm noise guidelines and compliance procedures M Morris 3/4/14 There appears to be a systemic failure of the SA wind farm noise complaints procedure and the following up of complaints with regulatory authorities as the number of complaints by residents and received by the developers and local councils is not reflected in the number of complaints quoted by the SA EPA. (SA only acknowledges seven separate complaints). The two SA wind farms generating the greatest number of complaints are the Waterloo wind farm (Clare & Gilbert Valleys Council) and the Hallett group of wind farms (Regional Council of Goyder). Presumably there has also been at least one complaint about the Clements Gap wind farm as the 2012 EPA/Resonate(1) study released January 31, 2013 investigated this Clements Gap home variously described as approximately 1.4 km (page 23) and also 1.5 km (page 65) from the nearest turbine as well as one house 1.5 km from the nearest turbine at The Bluff wind farm near Hallett. The SA EPA’s and met with Millicent residents on 14 March 2013 (in the presence of by M Morris and ), and heard the extent of their problems near the Lake Bonney wind farm. The EPA was asked, but declined, to investigate the noise at the Mortimer home. Either the majority of Waterloo and Hallett wind farm complaints have not been passed on to the EPA, or the SA EPA has not acknowledged them.

Abstract With the increasing installation of wind power around the world the questions surrounding its benefits and issues are also growing at the same rate. This paper analyses the wind energy in the Australian National Electricity Market (NEM) using actual data from 2012 and 2013 and attempts to answer some of the pressing questions around how variable the wind output is, its impact on carbon emissions, and its influence on other generators especially those balancing the power system. Starting with a static study of generation half hour data, the report then looks in more detail at the 5-minute variability experienced across the NEM, and the corresponding impact on frequency and time error for large excursions. Notably the largest variations experienced in wind power are during wind storms in the wind power zones of South Australia and Victoria. Three of these storms are analysed in detail looking at the individual performance of the wind farms and their contribution to the variability. Lastly, the effect of the wind variations on the regulation or balancing generators is studied – in particular with large increases in wind power that causes fossil- fueled generators to decrease their output and hence efficiency.
