Support RAND Make a tax-deductible charitable contribution at www.rand.org/giving/contribute www.rand.org Preface On 7 May 2014, the government announced the integration of the Australian Customs and Border Protection Ser vice (ACBPS) and the Department of Immigration and Border Protection (DIBP) into a single government department, including the forma- tion of the Australian Border Force (ABF), to be accomplished by 1 July 2015.1 A year after the integration began, DIBP leadership sought an in de pen dent analy sis of the effectiveness and efficiency of the integrated department. In fulfilment of this requirement, RAND Australia conducted an evaluation of the newly integrated DIBP, which was completed in 2016. The DIBP has requested a second evaluation of the DIBP, considering the changes that have occurred since the publication of the previous study. This follow-on effort has two primary thrusts. The first is to update the previous analy sis from 2016 with the data and experiences gained in 2016–2017. The second is to identify lessons learned that could be useful in continuing the reform of the DIBP that continues tod ay and to inform the upcoming transition to an Australian Depart- ment of Home Affairs (HA). By necessity, this study builds on the previous findings and, therefore, uses the first study2 as the foundation for the analy sis. As such, it does not endeavour to repli- cate the previous effort, but rather commences from that starting point. Relevant documents and interviews with se nior leaders from across the department, including the ABF, we re undertaken. While documents dating back to 2005 provided the foundation for many judgments and findings in this report, RAND concentrated on 1 The Department of Immigration and Border Protection (DIBP) has under gone a number of name changes since 2001. The case for reform had been recognised in the earliest documents from 2005. Some changes had been implemented in a piecemeal fashion over the period from 2005 to 2015. However, these earlier efforts largely were designed to address specific shortfalls, not necessarily to build capacity and professionalise the organisations. Therefore, despite long and proud histories, neither organisation had developed the capabilities or profes- sionalisation in the workforce expected of a modern border management organisation. In looking at the reform, the analy sis concentrated on five areas, which had been specified by the DIBP leadership for additional scrutiny during the first study: (1) intel- ligence, (2) investigations, (3) detention, (4) integrity and corruption, and (5) learning and development (L&D). DIBP’s pro gress to ward completing the integration and reform has continued, although it has been uneven across the department. For example, in areas of policy, operations, and intelligence (POI), impor tant pro gress has been made toward the goals of integration and subsequent reform. However, in the enterprise, corporate, and man- agement areas (ECM), RAND identified shortfalls. In summary, many of the goals of integration and reform remain a work in pro gress. In these ECM areas, it will require continued pro gress and leadership attention to meet the goals set out in the original integration directives. Looking to the future, DIBP reform must continue to realise the full transformation of Customs and Immigration to ward the twenty- first- century border management institu- tions envisioned in the integration mandate. Many lessons have been learned over the past two years and these insights could be invaluable as the DIBP forms the core of HA. Furthermore, other organisational transformations undertaken by similar organ- isations provide impor tant insights into potential priorities for the establishment of HA and identification of potential pitfalls. In this analy sis, six— five international and one Australian— examples are examined. The overarching conclusion of the report is that impor tant pro gress has been made in building a modern border management capability for Australia. More work remains, but pro gress has been clear and unequivocal. The foundations of the DIBP are solid and will serve as a basis for the establishment of HA. The study sponsor was the DIBP, led by Secretary Michael Pezzullo, and acting Australian Border Force Commissioner Michael Outram. The Office of the First Assis- tant Secretary, Enterprise Strategy, Reform, and Per for mance Division within the DIBP served as the primary interlocutors with the RAND study team and provided outstanding support to the study effort. The conference Identification of victims and criminals – why we do not notice them on 30–31 May 2013 in Tallinn, Estonia formed the conclusion of a Nordic-Baltic-Northwest Russian cooperation project. Around 80 participants attended the two-day conference to discuss ways of identifying victims and criminals and to find answer to the question of why we do not notice victims or criminals, even though we now have available to us facts, figures, research and knowledge about human trafficking as a part of international organized crime. BISHOP1 Baruch College, The City University of New York, USA In recent years, the governments of the United States, Australia, and Norway have developed and launched informational multimedia campaigns targeted at dissuading unwanted groups of asylum-seeking migrants and have disseminated these media in strategic international locales. This project investigates the visual and textual facets of these deterrence campaigns using critical narrative analysis. Asylum seekers globally occupy a precarious liminal position; this article interrogates the processes of governmentality at work in this liminal space. Specifically, I analyze the ways that government-funded deterrence campaigns offer material directives that (1) discursively bifurcate the nature of the threats posed when individuals seek asylum, and (2) omit requisite information about migrants’ human right to seek asylum, thereby advancing strategic ignorance in their audiences. In Europe, the number of individuals seeking asylum has increased nearly 4,000% in the last decade, and the rate of arrivals is accelerating (Eurostat, 2019). Displaced individuals often flee to neighboring areas, and about 85% of displaced people reside in developing regions that are often unable to provide the material resources and long-term social services necessary for a high-functioning asylum system (United Nations High Commissioner for Refugees [UNHCR], 2018b).

As of today, Indonesia still has an ‘un-settled’ sea territory, with regard to the rights of sovereignty (Additional Zone, Economic Exclusive Zone, and continent plate). This frequently provokes conflict between the authorised sea-territory officer on patrol and foreign ships or fishermen from neighbouring countries. One of the principal border problems is the Sipadan-Ligitan dispute between Indonesia and Malaysia, which started in 1969.

    Managing the risk of asbestos at the border The health risks posed by exposure to asbestos are well known. An Australia-wide ban on the manufacture and use of all forms of asbestos took effect on 31 December 2003. Work Health and Safety (WHS) laws in all states and territories prohibit the supply and unauthorised transport, use, or handling of asbestos. In order to support the domestic ban: Importing asbestos, or goods containing asbestos, to Australia is prohibited under Regulation 4C of the Customs (Prohibited Imports) Regulations 1956 unless a permission has been granted or a lawful exception applies. Exporting asbestos, or certain goods containing asbestos, from Australia is prohibited under Regulation 4 and Schedule 1 of the Customs (Prohibited Exports) Regulations 1958, unless permission has been granted or a lawful exception applies. Australia is one of the few countries in the Asia/Pacific region that has a comprehensive ban on all six types of asbestos. In many countries, despite the known threat to human health, local standards allow low levels or particular types of asbestos to be used for manufacturing. Goods manufactured outside Australia might be labelled “asbestos free” and still contain low levels of asbestos. Such goods will not be permitted for importation into Australia, except in very limited circumstances. Types of prohibited asbestos Asbestos means the asbestiform varieties of mineral silicates belonging to the following serpentine or amphibole groups of rock forming minerals: actinolite asbestos; grunerite (or amosite) asbestos (brown); anthophyllite asbestos; chrysotile asbestos (white); crocidolite asbestos (blue); tremolite asbestos; or a mixture that contains one or more of the minerals referred above.

Conceptually, it assumes that their admission leads to paradoxes for host states’ governmental apparatuses: If these migrants’ reasons to seek new lives outside of their home countries and regions are recognized, they need to be granted protection statuses and thus be ‘welcomed’ to stay temporarily or permanently. As a consequence of public ‘backlashes’ and anxieties, destination countries’ governments have however increasingly attempted to control and restrict their entry. To understand these phenomena, this study explains the underlying incentives and scopes for handling contemporary migratory movements primarily from a governmental top-down point of view. Historical institutionalism helps to understand the path-dependent emergence of certain policies in the context of each state’s particular actor constellations. Approaches taken from public choice theory are adopted to illuminate the connection between societal sentiments, discourses, and domestic political decision- making. Insights from delegation, blame and signaling games are used to complete this picture. Supplemented by expert interviews, the empirical part of this study deciphers the observable political developments, as well as the resulting administrative asylum/refugee regimes in 21st century Germany, Canada, and Australia.
