Sections 3 and 4 of the Federal Arbitration Act (the "FAA") provide remedies for a party who is aggrieved by another party's failure or refusal to arbitrate under the terms of an FAA-governed agreement. FAA Section 3, which governs stays of litigation pending arbitration, requires courts, ?upon application of one of the parties,? to stay litigation of issues that are ?referable to arbitration? ?until arbitration has been had in accordance with the terms of the parties' arbitration agreement, providing [the party applying for a stay] is not in default in proceeding with such arbitration.? 9 U.S.C. § 3.
