Will the Minister Incharge of the Aviation Division be pleased to state the details of renovation work carried out in the Peshawar Airport during the last three years indicating also the expenditure incurred on the same?

Minister Incharge of the Aviation Division: (a) Details of renovation work carried out in last three years at BKIAP Peshawar are mentioned as under:— 2

(b) The major expansion/remodeling of terminal Building has also been commenced since February, 2016. It will provide world class facilities and comfort to passengers and meters/greeters. The expenditure on expansion/remodeling will be over Rs. 2 billion.

Minister Incharge of the Cabinet Division: (a) Total seven (07) offices of Pakistan Bait-ul-Mal are established in FATA. Will the Minister Incharge of the Cabinet Division be pleased to state the names, status / designations of the foreign Heads of States and other foreign dignitaries / officials to whom highest Pakistani civil award / medals have been awarded so far indicating also the names of country, date of awarding and the name of Pakistani dignitaries who awarded the same in each case?

Minister Incharge of the Cabinet Division: The lists of names of the Head of States / Foreign dignitaries upon whom Nishan-i-Pakistan, Nishan-i- Quaid-i-Azam, Nishan-i-Imtiaz and Nishan-i-Khidmat have been conferred till date are annexed.

Will the Minister Incharge of the Cabinet Division be pleased to state:

(a) the details of Prime Minister’s programme for Sustainable Development Goals indicating also the amount allocated for the same during the fiscal year 2016-17 with sector / goal wise break up; and

(b) the details of the civic amenities proposal under the said programme?

Minister Incharge of the Cabinet Division: (a) An amount of Rs. 20 billion has been allocated by the Government during current financial year 2016-17 for achievement of SDGs under Prime Minister’s Global SDGs Achievement programme. The Cabinet in its meeting held on 30-09-2016 approved comprehensive implementation mechanism and guidelines for execution of Prime Minister’s Global SDGs Achievement Programme.

Pakistan has lagged behind in the achievement of 34 indicators of Millennium Development Goals and Targets (MDGs) in comparison to other countries of the region. Pakistan was on track on ten (10) indicators. Pakistan’s progress towards MDGs was influenced by slow growth world over and natural disasters, man- made conflicts, institutional, administrative and political changes in Pakistan. The global community adopted sustainable development goals (SDGs) consisting of 17 goals with 169 targets and 304 indicators covering a broad range of sustainable development issues. These include inter-alia no poverty, zero hunger, good health and well-being, quality education, gender equality, clean water and sanitation, affordable and clean energy, decent work and economic growth, industry innovation and infrastructure, reduced inequalities, sustainable cities and community, responsible consumption and production, climate action, life below water, life on land, peace, justice, strong institutions and partnerships for the goals. There was a need to implement a targeted programme at grass root level to achieve sustainable goals, cater to community needs and cover the gaps by providing missing links. In order to achieve SDGs, the Cabinet has approved for establishment of Prime Minister’s Global SDGs Achievement Programme.

(b) Following sectors/areas are included in the programme:— 12 (i) POWER SECTORS (a) Electrification Schemes. (b) Rehabilitation of Electricity Distribution Infrastructure. (ii) GAS & NATURAL RESOURCES (a) Missing gas infrastructure, subject to availability of gas, duly certified by the Ministry of Petroleum & Natural Resources. (iii) SOCIAL SECTOR (a) Construction of new schools, up-gradation or uplifting of existing schools, including provision of missing facilities. (b) Construction of new BHUs and RHCs; up-gradation and uplifting of existing facilities, including provision of missing facilities. (iv) MUNICIPAL SECTOR (a) Water Supply Schemes & Filtration Plants. (b) Urban Sewerage, Sanitation and rural Drainage Schemes. (c) Communal facilities including but not limited to graveyards and public parks. (v) INFRASTRUCTURE SECTOR (a) Construction and of rehabilitation of farm to market roads.

(a) the names, educational qualifications, date of appointments and place of domiciles of the persons working as Air Room Fighters in Civil Aviation Authority’s Headquarter, Karachi; 13 (b) whether it is a fact that the salaries of a number of the said persons have been stopped, if so, their names and reasons for stoppage of salary in each case; and

(c) whether any inquiry has been conducted in the cases of stoppage of the salaries of the said persons, if so, the details thereof in each case and if not, the reasons thereof indicating also the time by which they will be paid their salaries?

Minister Incharge of the Aviation Division: (a) Names, educational / qualification date of appointment and place of domicile in respect of persons working as Aerodrome Fire Fighters at Headquarters CAA and Jinnah International Airport is placed at Annexure “A” & “B”.

(b) None of the person’s salary mentioned above are stopped.

(c) the names and designations of those persons who have been re- employed by the said Authority; and

(d) the number and category of employees of that Authority who are entitled for the grant of bonus indicating also the reasons for not granting the same to the remaining employees?

Will the Minister Incharge of the Aviation Division be pleased to state;

(a) whether there is any proposal under consideration of the Government to purchase new aircraft by floating international tenders, if so, the number and type of aircrafts to be purchased; and

(b) the name of authority responsible to check the quality of new aircrafts at the time of their purchase?

Minister Incharge of the Aviation Division: (a) There is no proposal under consideration of the Government to purchase new aircraft by floating international tenders. However PIA has floated tenders for acquiring aircraft (04 Wide-body and 04-Narrow aircraft) on Dry Lease.

(b) Civil Aviation Authority is authorized to check the quality of new aircraft at the time of acceptance of aircraft.

Will the Minister Incharge of the Aviation Division be pleased to state:

(a) whether it is a fact that Pakistan International Airlines (PIA) and other domestic airlines don’t offer internet and mobile services during their flights, if so, the reasons thereof; and

(b) whether there is any proposal under consideration of the Government to make arrangements for provision of the said facilities by PIA, if so, when?

Minister Incharge of the Aviation Division: (a) It is a fact that Pakistan International Airlines and other domestic airlines i.e. M/s and don’t offer internet and mobile services during flights. Such facilities required modification in the aircraft which is very expensive.

(b) PIACL is considering the same and initiated a case for offering internet, video streaming and data connectivity service during flights in five B777 aircraft by August 2017, subject to the approval of the Board of Directors. 27 (Def.)*Question No. 128. Will the Minister Incharge of the Aviation Division be pleased to state:

(a) the names of persons appointed against the posts of Director and above in PIA during the last two years indicating also the pay, allowances and other fringe benefits admissible to them; and

(b) the procedure adopted for the said appointments indicating also the date of publication of advertisement for the posts and the dates of conducting test and interviews for the same?

Minister Incharge of the Aviation Division: (a) PIACL has hired the following 05 incumbents (Director & above) during the last 02 years i.e. 2015-2016. Detail regarding their pay, allowances and other fringe benefits is as under:—

Will the Minister Incharge of the Capital Administration and Development Division be pleased to state:

(a) the details of agreement under which 13.5 acres land was provided by CDA for the construction of Grand Hyatt Hotel near Convention Center, Islamabad;

(b) the market price of the said land at that time an the price at which the same has been provided to the Grand Hyatt indicating also the amount received by CDA so far;

(c) the name of legal title owner and shareholders, if any, of the Grand Hyatt indicating also the percentage of shares owned by its shareholders; and

(d) whether there is any proposal under consideration of the Government to revise the said agreement, if so, the details thereof?

Dr. Tariq Fazal Chaudhary: (a) Annexure “A”.

(b) It is submitted that official price was fixed by Finance Wing in 2005 was Rs. 14,500/- per sq yard for the land/plot reserved for construction of five star hotel near Convention Center, Islamabad. M/s BNP Group offered the highest bid of Rs. 75,000/- per sq. yard.

Rs. 1227.253 million has received out of total Rs. 4,882.00 million before cancellation.

Rs. 200.00 million i.e. installment due on 31-12-2016 has been deposited by the lessee on the order of Hon’ble Islamabad High Court.

(c) M/s BNP Group (Pvt) Ltd. is the legal owner / lessee of plot/ land.

(d) No proposal regarding revision of said agreement is under consideration of the Authority.

Will the Minister Incharge of the Capital Administration and Development Division be pleased to state whether it is a fact that persons working in BPS-16 and above in Cardiac Center, PIMS, Islamabad have not been paid their salaries for the last fourteen months, if so, the reasons thereof and the time by which the same will be paid to them?

Dr. Tariq Fazal Chaudhary: It is fact that 09 persons working in BPS-16 and above in Cardiac Center, PIMS, Islamabad have not been paid their salaries for the last fourteen months. They will be paid their salaries for fourteen months if their services would be regularized by the Government from retrospective effect or from the date of their regularization. The list of employees of Cardiac Center from BPS-16 and above who are not paid salaries is enclosed at Annex-A. The reasons are submitted are as under:—

(i) The case regarding regularization of the contract employees of the Cardiac Center is under process in the regularization committee. All the said employees appeared before the committee on 18-05-2016 and 20-12-2016 respectively for personal hearing.The decision of the regularization committee is awaited.

(ii) It is also intimated that a summary regarding regularization of the services of contract employees was submitted by the Secretary CA&DD to the Prime Minister on 14-01-2016. The Prime Minister has constituted the following committee to examine the matter in detail and to furnish its recommendations on eligibility, suitability & performance of the employees for their further retention in services on regular basis:

(a) Secretary, Establishment Division Convener

(b) Secretary, Law & Justice Division Member

(c) Joint Secretary CA&DD Member/Secretary

The recommendation / decision of the committee is still awaited. 36

*Question No. 114. Senator Col. (R) Syed Tahir Hussain Mashhadi: (Notice received on 08-08-2016 at 10:45 a.m.)

Will the Minister for Textile Industry be pleased to state whether there is any proposal under consideration of the Government to establish new garments cities in the country, if so, when?

Minister for Textile Industry: At present there is no proposal under consideration of the Government for setting up new garment cities in the country.

*Question No. 115. Senator Col. (R) Syed Tahir Hussain Mashhadi: (Notice received on 9-8-2016 at 10:52 a.m.)

Will the Minister for Commerce be pleased to state:

(a) whether it is a fact that the country has been facing trade deficit during the last three years, if so, the reasons thereof;

(b) whether it is also a fact that the services sector also faced deficit during the said period, if so, the reasons thereof; and

(c) the steps taken / being taken by the Government to control the said deficit?

Engineer Khurram Dastgir Khan: (a) Yes, it is a fact that the country is facing trade deficit during the last three years. In the financial year 2015-16. Pakistan recorded trade deficit of USD 23.96 billion as compared to USD 22.1 37 billion during the last financial year, reflecting increase of 8.42%. The percentage of said deficit for the last three years is as under:

The reason thereof, are as under:

Import

Pakistan’s imports have grown by nearly 6% mainly owing to the following reasons:

1. The demand of many imported items is inelastic e.g. petroleum products, food items and machinery.

2. Due to the increase in development activity in the country especially CPEC the import of machinery and equipment has increased.

3. Due to the shortfall in cotton production in the country, the raw cotton is to be imported from abroad to meet the demand of the textile industry.

Exports

The trade balance has also been affected due to decline in Pakistan’s exports for the following reasons:

1. Economic slowdown in the global market

2. Global commodity crisis

3. Currency devaluation by competitors

4. Pakistan’s low position in global competitiveness index 38 (b) Yes, it is a fact that the country is facing trade deficit in Services Sector during the last three years. However, the services trade deficit has decreased by 18.54% in the last financial year. In FY 2016, Pakistan recorded services trade deficit of USD 2.41 Billion as compared to USD 2.96 Billion during the last financial year. The services trade for the last three years is as under:

The reasons thereof, are as under:

Imports

1. Pakistan’s services sector imports have declined in almost all the sectors except the Construction Services. The increase in the imports of Constructions is an outcome in the increase in the development work and CPEC related construction projects.

Exports

1. The exports of Transport, Travel and Financial Services have registered a decline in the current financial year. However, the share of these services is minimal in the total services exports of Pakistan.

2. Approximately, 50% of services exports of Pakistan are comprised of Government Services, which has registered a decline of 9.6% in the current financial year.

3. The decline in the services exports is mainly related post 2014 NATO forces withdrawal from Afghanistan. Pakistan’s services exports to USA have declined by 23% in FY 2016. 39 (c) The Government has taken following steps to reduce trade deficit of the country:

1. Vide SRO. 491(1)/2016, the revised sales tax zero-rating regime for five export oriented sectors, i.e., textile, leather, carpets, surgical and sports goods has been introduced with effect from July 1, 2016.

2. Under Strategic Trade Policy Framework (STPF), 2015-18, several initiatives are announced to enhance Pakistan’s export competitiveness and institutional strengthening. A total of Rs. 20 billion will be spent on development of export sector during the next three years. The initiatives inter-alia include:

a. Establishment of Export Promotion Council for Pharmaceuticals & Cosmetics, and Rice Export Promotion Council.

b. Support for the import of plant & machinery to strengthen supply chain and encourage value-addition.

c. Performance Based Incentive (PBI) to offset the burden of higher utility costs and local levies and taxes on the export sectors, i.e. per unit price based refund @ 4% of 10% over last year’s exports.

d. Under short-term export enhancement measures, the four product categories i.e. Basmati rice, horticulture, meat and meat products, and jewellery, are being focused with the parallel focus on the following markets: (i) Iran, (ii) Afghanistan, (iii) China, and (iv) European Union.

3. Through active trade diplomacy, Government is trying to get better market access for the local businesses in international markets by concluding Free Trade Agreements (FTAs) and Preferential Trade Agreements (PTAs) with different countries.

4. Bilateral free trade agreements with China, Sri Lanka, Malaysia, Iran, Mauritius and Indonesia are already in place. The opportunity of zero-rated market access in European Union market under GSP Plus scheme has provided a fillip to our exports to our largest market. Moreover, Government is in the process of negotiating trade agreements with Thailand and Turkey. 40 5. The leading business support institutions are being strengthened. Trade Development Authority of Pakistan has recently been restructured; Pakistan Horticulture Development and Export Company is being revitalized and strengthened. Trade Development Authority of Pakistan (TDAP) is undertaking various export promotional activities through trade exhibitions and delegations.

6. The TEXPO Pakistan has recently been held in Karachi for showcasing a large number of Pakistan’s textile products to foreign Textile buyers.

7. In order to fulfill long awaited demand for reducing cost of doing business, Government has taken a major step of reducing electricity tariff by Rs. 3 for the industrial units with effect from 1st January 2016.

8. The availability of affordable finance for the export sector has considerably improved. The State Bank of Pakistan has further reduced the discount rate which currently stands at 5.75%. The Export Finance Rate currently at 3% for textile sector.

9. To enhance exports the government has announced a number of initiatives in the Budget 2015-16 which included establishment of Exim Bank which will be helpful in enhancing export credit and reducing cost of borrowing for exporting sectors on long term basis and help reduce their risks through export credit guarantees and insurance facilities.

10. Services Trade Development Council and Services Trade Wing have been established to promote services trade and strengthen domestic framework to develop services sector of Pakistan.

11. To seek better market access for Services sector, Pakistan has concluded services trade agreements with Malaysia and China.

12. To further enhance Pakistan’s export prospects in Services factor, Services Chapter will be incorporated in upcoming trade agreements. e.g. Turkey, Thailand and Sri Lanka. 41 13. Trade in Services Agreement (TISA) is currently under negotiation which will liberalize services trade at the plurilateral level.

14. In order to mitigate the effect of these costs, restore competitiveness of the export sector and boost exports, the Trade Enhancement Package of 180 billion Rupees has been announced by the Prime Minister. The salient features of the package are as under:

i. Zero rating of machinery imports. ii. Withdrawal of duty and sales tax on cotton import iii. Withdrawal of duty on import of MMF iv. Release of pending liabilities of Textile Policies v. Release of pending Sales Tax Refunds vi. Drawback of taxes for the following export sectors cascaded in terms of value addition:

o Garments o Madeups o Processed fabrics o Yarn & greige fabrics o Basmati rice o Non-basmati rice o Horticulture o Fish & fish preparations o Meat & meat preparations o Spices o Sports goods including gloves & footballs o Leather manufactures including garments o Tanned leather o Footwear o Surgical goods o Cutlery o Engineering goods o Furniture o Pharmaceuticals o Carpets & rugs o Plastic materials 42 *Question No. 116. Senator Mian Muhammad Ateeq Shaikh: (Notice received on 10-08-2016 at 12:45 p.m.)

Will the Minister Incharge of the Climate Change Division be pleased to state:

(a) the amount released for making Environmental Monitoring System functional in the country including Islamabad during the last two years indicating also the details of utilization of the same; and

(b) the details of equipment installed in the Environmental Monitoring office, Islamabad?

Mr. Zahid Hamid: (a) Pakistan Environmental Agency Pak-EPA was provided technical supplementary grant of Rs.18.8 million in Feb, 2016 for repair/ maintenance of central laboratory for environmental analysis and networking (CLEAN), Islamabad (Annex-I). The repair maintenance included fixed and mobile air quality monitoring station and PG-250 Stack analyzer. M/s Mextech corporation was contacted for the repair and maintenance being the sole distributor of Horiba Japan the original suppliers of chemicals for labs (Annex-II). However, at the final stage M/s Maxtech requested for 100% release of funds which is not permissible under financial code. M/s Maxtech also refused to provide 100% bank guarantee due to which the contract could not materialize (Annex-III).

As far as Environmental monitoring system established in the provinces are concerned it is stated that stands devolved and Provincial Environmental Protection Agencies (EPAs) are performing there respective duties independently out of the budgets allocated by the Provincial Governments.

(b) Pak-EPA, an attached department of Ministry of Climate Change established a state-of-the-art Cenrtral Laboratory for Environmental Analysis and Networking (CLEAN) with the financial aid of JICA. The laboratory has been established in its own builing. Following major equipment have been installed (Annex-IV); 43 44 45 46

Senator Mian Muhammad Ateeq Shaikh: (Notice received on 18-08-2016 at 01:00 p.m.) Will the Minister Incharge of the Capital Administration and Development Division be pleased to state: (a) the names and specialties of the physicians working in Pakistan Institute of Medical Sciences, Islamabad; and (b) whether it is a fact that the present number of posts of the said physicians is insufficient to meet the requirements of increasing number of patients in the said hospital, if so, the steps taken / being taken by the Government to increase the number of those posts? Dr. Tariq Fazal Chaudhary: (a) The names and specialties of the Physicians working in Pakistan Institute of Medical Sciences, Islamabad is at Annex-A. (b) It is a fact that the present number of posts of the said physicians is insufficient to meet the requirement of increasing number of patients in PIMS. As regards the steps taken, it is intimated that the 49 vacant posts of consultants and physicians in PIMS pertain to direct appointment quota have been advertised in the press and published on 01-09-2016 for recruitment. Recruitment against these posts is under process. The promotion cases are also under process against the promotion quota posts. 47 Moreover creation of 143 additional posts of consultants and physicians is under process to meet the requirement of increasing number of patients in PIMS.

Will the Minister for Commerce be pleased to state:

(a) whether any study has been conducted in recent years to assess the impacts of Pak-Afghan Transit Trade on the manufacturing sector in the country, if so, the details thereof; and

(b) the steps being by the Government to make the said transit trade more beneficial for the economy of the country in general and for the manufacturing sector in particular?

Engineer Khurram Dastgir Khan: (a) No study has been conducted in the recent years to assess the impact of Pak-Afghanistan Transit Trade on the manufacturing sector in the country.

(b) Under Article 30 of the Afghanistan-Pakistan Transit Trade Agreement (APTTA), 2010, various businesses, involved in clearance of transit cargo such as port terminal operators shipping companies, stevedores, freight forwarders, customs agents, transport operators, insurance companies, tracking companies and toll tax collectors, earn revenues from transit trade, which helps the economy in general.

Since, transit trade is about facilitating Afghan global imports through Karachi port up to Torkham border, the manufacturing sector of Pakistan is not directly involved in, affected by or benefiting through the transit arrangement.

Will the Minister Incharge of the Capital Administration and Development Division be pleased to state:

(a) the expenditure incurred on the construction of Kashmir highway from Rawalpindi and Islamabad so far; and

Mr. Zahid Hamid: (a) The mechanism of Ministry of Climate Change for coordination with the Provincial Governments for protection of forests is as under:

¦ Ministry of Climate Change holds biannual inter-ministerial and inter- provincial meetings for spring and monsoon tree plantation campaigns wherein tree planting campaigns are coordinated at national level.

¦ Under the direction of the Prime Minister, the National Forest Policy was prepared in consultation with provinces and stakeholders, which inter alia includes forest protection. The Policy has been approved in Principle by Council of Common Interests (Flag. A).

¦ Federal Government has constituted National Steering Committee on Reducing Emissions from Deforestation and Forest Degradation (REDD+) having representation of the Provinces. 54 (b) Yes, Forestry is a provincial subject under the constitution. Part V of the Constitution governs relations between the Federation and the Provinces.

(c) The following new steps have been taken by the government to protect the climate in the country, with reference to forests:—

i. Green Pakistan Programme under which plantation of 100 million new trees is being under taken for the period 2016-2017 to 2020-21.

ii. REDD+ is a new innovative mechanism under which, after meeting international standards, entities that protect forests are rewarded by cash compensation for the carbon stored in trees. It is envisaged that the national strategy on REDD+ shall be finalized with the consent of all provinces by 2020.

(b) Pakistan ranks 135th amongst countries contributing to global warming and 7th amongst countries most vulnerable to adverse impacts of climate change. To address this situation Ministry of Climate Change has developed a comprehensive strategy to address Climate Change which identifies policy approaches and implementation pathways for both adaptation and mitigation. Given our extreme vulnerability to climate change, adaptation and climate resilient development remains our essential priority along with adoption of comprehensive approach on disaster risk reduction and management.

(1) Legislation

Ministry of Climate Change has submitted draft legislation on Pakistan Climate Change Act (PCCA, 2016). It envisages the establishment of Pakistan Climate Authority, Pakistan Climate Change Council and Pakistan Climate Change Fund.

(2) Policy

Ministry of Climate Change has formulated National Climate Change Policy, 2012 (NCCP) in consultation with all stake holders, which act as a guiding document for federal and provincial departments/organizations.

Further, to stream line Policy’s implementation a framework for Implementation of National Climate Change Policy has also been developed. 55 (3) Institutions

In order to meet the multifaceted challenge of climate change the government has established a number of new and dedicated institutions over a period of time and these institutions are

(a) Ministry of Climate Change (MOCC) (b) Global change Impact Study Centre (GCISC) (c) National Disaster Management Authority (NDMA) (d) Pakistan Environmental Protection Agency (PAK-EPA) (4) Provincial Implementation Committees

The Provinces have notified provincial-National Climate Change policy Implementation committees. These committees are responsible for developing provincial action plans for their respective province.

(5) Intended Nationally Determined Contributions (INDCs)

Ministry of Climate Change has completed a study on stocktaking of greenhouse gases (GHG) emissions, their trends and projections along with climate change mitigation, its economic and mitigation modeling and analysis in Pakistan. This study has calculated the country’s future emission projections in detail followed by its analysis regarding the potential for mitigation in all sectors of the economy. Engineer Khurram Dastgir Khan: (a) e-Commerce in Pakistan is currently at an initial but evolving stage. The past few years have seen a rising trend of domestic online shopping owing to the availability of required infrastructure for e-Commerce in Pakistan.

SBP has issued various rules/regulations/instructions to banks for regulating online transactions. To prevent cardholders from risks and vulnerabilities from card data losses, SBP has issued regulations on Payment Card Security. These regulations are intended to help standardization and enhancement of security features of payment cards, ensuring confidentiality of customer’s data and to promote effective and secure means of electronic Payment mechanisms. Moreover in order to mitigate the risks associated with internet banking and safeguard the interests of customers, SBP has issued regulations for the security of internet banking. These regulations contained in the Payment Systems and Electronic Fund Transfers Act, 2007, and outline a minimum set of operational, administrative, technical and physical safeguards to secure internet banking offered by the banks in Pakistan.

Ministry of Commerce is also working on a policy framework for development of e-Commerce/ digital trade in the country. Some key aspects of this framework are as follows:

(a) Enactment of National Law on Consumer Protection specifying rights, obligations, liabilities and penalties for both sellers and consumers.

(b) Enactment of Privacy and Data Protection Laws including provisions for e-transaction to enable e-contracts.

(c) Amendments in the Foreign Exchange Regulations of the State Bank of Pakistan to facilitate cross border electronic transactions. 58 (d) Establishment of Dispute resolution mechanism for e-Commerce.

(e) Formulation of licensing requirements for establishing and operating e-Commerce businesses.

(b) SBP has issued various regulations to provide such protection. In October 2014 rules for payment system operators and payment service providers under Payment Systems and Electronic Fund Transfers Act, 2007 have been framed. Currently the following mechanism is in place to provide protection to consumers:—

(a) Prevention of Electronic Crime Bill 2016 provides for intermediary liability protection and consumer protection from electronic fraud, forgery etc.

(b) Electronic Transaction Ordinance 2002 provides for the recognition and facilitation of documents, records, information, communications and transactions in electronic form, accreditation of certification service providers, and for matters connected therewith and ancillary thereto.

Moreover, the Ministry of Commerce is in thy process of formulating a policy framework fo e-Commerce in Pakistan. One of the key aspects of this policy framework is enactment of national law on consumer protection, specifying rights obligations, liabilities and penalties for both sellers and consumers. The consumer protection laws would be modified to align it with the United Nations guidelines on consumer protection and the OECS guidelines to encourage harmonization of consumer protection legislation and foster consumer confidence in e-Commerce.

Engineer Khurram Dastgir Khan: Pakistan is considered to be the 14th largest exporter of Mandarin in the world and our exports of Kinnows in 2015-16 was Rs. 17.581 million (source: PBS). There are many varieties of citrus fruits available in Pakistan but only a few varieties are commonly grown: Mandarin, Oranges, Grapefruits, Lime and Lemons. Pakistan’s Kinnow belongs to the Mandarin family, and the major markets of Pakistani Kinnows are Afghanistan, Russia, UAE, Ukraine, Iran, Saudi Arabia, Indonesia, Philippines, Kuwait and Sri Lanka.

Ministry of Commerce has been involved in exploring new markets for the export of Kinnow through its attached departments, while marketing efforts are conducted through Trade Development Authority of Pakistan (TDAP).

TDAP being the Trade Promotion Organization of the country continually promotes Pakistani products in the world market. TDAP organized the following export promotional activities for the promotion of Kinnows throughout the world:

¦ TDAP organized visit of two quarantine inspectors from China in June who inspected the facilities of Kinnow and Mango Growers in Pakistan from 25th April - 3rd May 2016. 66

¦ A trade delegation of Agro Food Products comprising 22 members, headed by CE, TDAP Mr. S. M. Muneer visited Russia (Moscow and Saint Petersburg) from 13-81, September, 2015.

¦ CE, TDAP also headed a 16 member TDAP sponsored trade delegation to Russia (Ufa city, Kazan and Moscow) from 29 May to 7th June, 2016. (c) No Inordinate delay has been caused on part of CAA. The awarding of license for an airline is an entirely different phenomenon which involves assurance of safety, security of the people and aircraft, involving considerable investment that is only possible with a viable and very strong financial status. This assurance requires thorough scrutiny of the company, its owners / officials, equipments, documentation, maintenance setup reliable infrastructure and so many other aspects. This process is carried out by different directorates of Pakistan Civil Aviation Authority and requires extensive time for completion. Police Service of Pakistan and Pakistan Administrative Service are all Pakistan services as envisaged in Article 240 of Constitution of Pakistan, 1973. Establishment Division’s Rotation Policy of 2000, inter alia, envisages that an officer has to serve for a period of five years in the Province of first allocation including the period of UT ship/ training. The Province of first allocation would be a province other than the province of domicile. It further states that the officer may be transferred/ posted to other Federating Units during the second span of his service which commences from BS-19. However, the accident did not occur due to fault in landing gear. rather the pilot could not control the aircraft within the runway boundary.

(b) During the preceding 60 days snags related to flight controls were logged five times by the crew in the month of November 2016. On all occasions no abnormality was found however preventive maintenance was carried out accordingly. In the month of December 2016 there were no reports related to flights controls or engine right up to the accident. The aircraft went through ‘A’ check in October 2016.

Dr. Tariq Fazal Chudhary: (a) Directorate of Building Control Capital Development Authority issued approval for construction of 5-Star Hotel Grand Hyatt vide letter No. CDA/DBC-6(23) Con.Hotel/ 2006/560 dated: 29-03-2008. 89 (b) Architect/ Engineer vide letter dated: 25-11-2008 certified commencement of work at site.

(c) As per record no environment survey or study was carried-out before the construction.

(d) Grand Hyatt Hotel near Convention Center has been sealed on 01-07-2016 due to following violations;

(i) Deviation of approved plan.

(ii) Service apartments have been sold in market without approval of CDA.

(iii) Construction of 120 flats v/s 60 serviced apartments.

(iv) Without seeking completion certificate, owner has committed a serious violation of CDA laws and regulations by handing over possession to third parties and creation of third party interest without obtaining Completion Certificate or permission from CDA.

(v) The site which was initialing declared as Hotel site and auctioned not utilized, which was an integral part of the project.

Subsequently allotment/lease of the plot has been canceled by the CDA.

Minister Incharge of the Cabinet Division: (a) It is confirmed that in terms of rule 3 (3) of the Rules of Business, 1973 the administrative control of five 90 (05) Regulatory Authorities have been transferred from Cabinet Division to their respective line Ministries / Divisions on 19-12-2016. As per proviso to the rule 3 (3) of the Rules ibid, distribution of the business of Division may be modified from time to time by the Prime Minister. Accordingly, the Prime Minister transferred the administrative control of NEPRA, PTA, FAB, OGRA and PPRA to their respective line Ministries/ Divisions.

(b) The Regulatory Authorities are working in accordance with their statute/ law. The placement of a Regulatory Authority under a certain Division of Federal Secretariat does not involve any deviation from their prescribed statute/ law and policy. Moreover, the transferring of Regulatory Authorities from Cabinet Division to their respective line Ministries/ Divisions will not affect their administrative, financial and operational autonomy and independence which is enshrined in their parent legislation that remains unchanged.

Minister Incharge of the Aviation Division: (a) Presently, PIACL fleet comprises of 32 aircrafts, out of which 27 are operational, and 05 are grounded for scheduled maintenance.

(b) There is no proposal under the consideration of the Government to buy new aircraft. However, PIACL has floated tenders for acquiring aircraft (04 Wide body and 04 Narrow body) on dry lease.

(c) Presently 522 pilots, including 458 regular pilots, 20 cadet pilots, 28 rehired pilots, and 16 contractual pilots are working in PIACL as per detail placed at Annex-I. (a) the number of commercial attaches posted in Pakistan embassies and missions abroad during the tenure of the present Government with province wise break up; and

(b) the procedure adopted for the selection of the said attaches?

Engineer Khurram Dastgir Khan: (a) 49 Commercial Attaches have been posted in Pakistan Embassies and Missions abroad during the tenure of the present Government. The province wise breakup is at Annex-I.

(b) The selection process for the officers mentioned at Annex-II was based on following steps:

i. Advertisement in news paper. ii. Written test by LUMS. iii. interview by Special Selection Board. iv. Approval of the Prime Minister.
