THE UTTARAKHAND LOKAYUKTA BILL, 2011 [UTTARAKHAND BILL NO. OF 2011] A Bill to establish an independent authority to investigate offences under the Prevention of Corruption Act, 1988 so as to detect corruption by expeditious investigation and to prosecute offenders and redressal of certain types of public grievances and to provide protection to whistleblowers. Be it enacted by Legislative Assembly of Uttarakhand in the Sixty-second year of the Republic of India as follows:- CHAPTER I PRELIMINARY Short title, 1. (1) This Act may be called the Uttarakhand Lokayukta Act, 2011. commencement (2) For the purpose of preparations, the provisions of the Act shall and extent come into force at once and the Act shall be operationalised within 180 days of its securing assent from the Governor of Uttarakhand. (3) It extends to the whole of the State of Uttarakhand. Definitions 2. In this Act, unless the context otherwise requires:- (a) “Board” means the Chairperson and the other members of the Lokayukta collectively. (b) “Complaint” means an allegation of corruption or a request by whistleblower for protection or a request for redressal of certain grievances covered under this Act. (c) “Lokayukta” means and includes, (i) The Board; (ii) Benches constituted under this Act and performing functions under this Act; (d) “Lokayukta Bench” means a Bench of two or more members of the 1 Lokayukta with or without the Chairperson acting together in respect of any matter in accordance with the regulations framed under the Act. At this moment seventy per cent of Kashmir’s population is under the age of thirty-five. This means that most of them have grown up knowing no other reality than that of living in a heavily securitized zone. This thesis is written based on the memories and experiences of thirty women who all come from Kashmir. Some of them were born just before 1990, most of them after this defining year in Kashmir history. Women’s voices are the most misunderstood and underreported in a conflict. This thesis aims to find an answer to how the securitization of Kashmir, through the AFSPA, has mobilized women to use public space as a tool for resistance in Srinagar. It finds that women mobilize to claim a space for their own identity as Kashmiri women, within a larger society that experiences an attack on its identity in the form of Indian occupation. -

SAGE Los Angeles, London, New Delhi, Singapore, Washington DC Everyday violence, institutional denial and struggles for justice in Kashmir HALEY DUSCHINSKI and BRUCE HOFFMAN Abstract: In the summer of 2009, the apparent murder and rape of two young women in the small town of Shopian sparked a year of popular protest in heavily militarised Kashmir Valley expressing outrage at the everyday forms of violence that accompany Indian occupation in the contested region. Here, the authors analyse the case by drawing on ethnographic field research conducted via research visits in 2009–2010, to show how the state has exercised occupational authority through practices of denial and cover-up that are built into the legal systems that claim to protect the rights and interests of Kashmiris. They demonstrate how various local actors have worked to establish alternative forums to challenge state violence and the institutionalised denial of justice, illuminating the ways in which they have sought justice in this context of intense militarisation, characterised by routine state violence through legal and criminal justice processes. The event, and the responses to it, reshaped the interplay between legal authority, social protest and political power under conditions of occupation, with implications for future formations of popular resistance against Indian rule in Kashmir. Haley Duschinski, who conducts ethnographic research on violence and militarisation, popular protest and political resistance, and local meanings of human rights in Kashmir Valley, is an assistant professor in the Department of Sociology and Anthropology at Ohio University. Bruce Hoffman researches genocide, the cultural boundaries of criminological science and the ways in which social and political movements strategically engage with law and science and is an associate professor in the Department of Sociology and Anthropology at Ohio University and a visiting fellow at the American Bar Foundation. -

The role of political elites in orchestrating attacks against Muslims for electoral gains was a conspicuous characteristic of the violence. Yet, as this article demonstrates, the political thesis was insufficient in explaining why neighborhoods, often contiguous, experienced different levels of violence. Alternative explanations, such as interethnic contact, were also found wanting. A unique research design allowing the comparison of neighborhoods in the same electoral ward in the city of Ahmedabad demonstrates the critical role of ecology in explaining microspatial variation in the violence. Even when attacks were politically orches- trated, attackers still acted with some regard to self-preservation in selecting which location to attack. Observational and testimonial evidence based on 22 months of ethnographic fieldwork reveals the importance of two ecological factors: the built environment and the population distribution of potential targets. Together, the two factors heavily shaped crowds’ decisions to attack or escape, thus influencing the subsequent success or failure of the attack. Muslims were most vulnerable where they were concentrated in small numbers and on routes that afforded the attackers obstacle-free entry and retreat. Where the potential targets had an obstacle-free escape route to a large concentration of fellow Muslims, the outcome was looting and arson rather than killing. By implication, the course of politically orchestrated violence was com- plicated by the ecology of the targeted space. -

Tummala ABSTRACT This paper deals with the ubiquitous problem of corruption among public officials– both elected and appointed, in India. By looking at the legal and administrative provisions to combat corruption, it is shown how futile the attempts so far have been. Among the plethora of reasons for failure to combat corruption, it is concluded that the more important ones are the inadequate and inefficient enforcement mechanisms, lack of political will, and more importantly the cultural context of social tolerance and easy forgiveness. Any outrage that is there is largely confined to rhetoric, not action. Despite some helpful developments such as the newly conferred freedom of information, active investigative media and engaged civic groups, reasons for optimism appear to be minimal. The need seems to be a serious effort to develop sound norms by changing the societal culture, which places the premium on the shoulders of political parties. Accountability for mass violence Examining the State’s record By Surabhi Chopra Pritarani Jha Anubha Rastogi Rekha Koli Suroor Mander Harsh Mander Centre for Equity Studies New Delhi May 2012 Preface Contemporary India has a troubled history of sporadic blood-letting in gruesome episodes of mass violence which targets men, women and sometimes children because of their religious identity. The Indian Constitution unequivocally guarantees equal legal rights, equal protection and security to religious minorities. However, the Indian State’s record of actually upholding the assurances in the secular democratic Constitution has been mixed. This study tries to map, understand and evaluate how effectively the State in free India has secured justice for victims of mass communal violence. It does so by relying primarily on the State’s own records relating to four major episodes of mass communal violence, using the powerful democratic instrument of the Right to Information Act 2005. In this way, it tries to hold up the mirror to governments, public authorities and institutions, to human rights workers and to survivors themselves. Since Independence, India has seen scores of group attacks on people targeted because of their religious identity1. Such violence is described in South Asia as communal violence. While there is insufficient rigorous research on numbers of people killed in religious massacres, one estimate suggests that 25,628 lives have been lost (including 1005 in police firings)2. The media has regularly reported on this violence, citizens’ groups have documented grave abuses and State complicity in violence, and government-appointed commissions of inquiry have gathered extensive evidence on it from victims, perpetrators and officials.
