Framework The German Federal Government has exclusive legislative authority in foreign affairs (Art. 73 no. 1 of the German Basic Law). The Foreign Service consists of the Foreign Office (headquarters) and the foreign missions, which together constitute one unitary, federal supreme authority (oberste Bundesbehörde). The tasks and organisation, as well as the legal status of members of the Foreign Service, are set down in the Foreign Service Act (FSA) of 30 August 1990 [Federal Law Gazette I 2002, p.1842], as amended by the First Act Amending the Foreign Service Act of 20 June 2002 [Federal Law Gazette I 2002, p. 2001 (attached)]. The Foreign Office headquarters steers the work of the foreign missions, assesses their reports and analyses, and on this basis draws up foreign policy blueprints for government policy. Headquarters also co-ordinates the foreign policy activities of other ministries and the federal states (Bundesländer) to ensure a uniform approach to German foreign policy and security policy. The Foreign Office consists of 11 departments and four regional political directorates, which in turn comprise divisions focusing on specific policy areas or geographical regions. Gripped by nationalism and ensnared by competing interests, mutual mistrust, and Ialliances, they made a series of tragic miscalculations that resulted in 40 million casualties. One of the more sobering aspects of this period was the speed with which events transpired in the summer of 1914, following the assassination of Archduke Franz Ferdinand and his wife, Sophie, in Sarajevo on June 28. This is the aspiration of the pragmatic Foreign Policy of The Bahamas, and the lessons from the opportunities of interaction in the global arena despite its many challenges. These challenges include, not least, the economic and financial crises with which a majority of States continues to grapple, including The Bahamas, and, the “hot spots” and “hot issues” from which no State is ultimately immune in an interdependent world. This is, therefore, the backdrop of this year for my reflections with you, on the focus, conduct and promulgation of the Foreign Policy of The Bahamas for 2011. I shall also this time attempt to be a bit ambitious and reveal some hopes for the future. Excellencies, Honorary Consuls, Ladies and Gentlemen, Diplomatic and Consular Representation 2 I shall begin, however, with an update on an overview of The Bahamas Diplomatic and Consular Representation. This is because both principles can guarantee the dignity and equality of sovereign states when resolving issues in international relation. Not every statement of persona non grata has to culminate in expulsion because a statement may be issued by the receiving state both after the diplomatic agent has started performing his functions and even before he arrives at the receiving state. If such a statement is followed by the expulsion of the diplomat, it should be based on article 41 of the Vienna Convention, 1961 (infringement on laws of receiving state and/or espionage actions). Also, expulsion may occur due to war and severance of diplomatic relation between two states. Indonesia has had to deal with issues of persona non grata on several occasions both as receiving and sending state. This paper analyses several cases of declaration of persona non grata involving several countries, especially Indonesia in order to give a better understanding of how the declaration of persona non grata plays out between states, and the significance of the Vienna Convention of 1961 on diplomatic relations.

American Ambassador Joseph C. Grew asserted, "The moment we knew that the news of war had been confirmed I gave orders to burn all our codes and confidential correspondence."1 Huge bonfires which emanated from the grounds of the Japanese embassy at Wash- ington served as dramatic evidence that the Japanese treated their important archives similarly.2 These actions illustrate that modern states are unwilling to entrust their vital documents to the diplomatic representatives of neutral governments at the outbreak of war, even though international law and practice dictate that records so de- posited are inviolate. Such an attitude stimulates an inquiry into the extent to which diplomatic archives are considered inviolable under international law and the extent to which the principles of interna- tional law are being observed. This subject has never been adequately investigated by scholars, although it is a matter of definite im- portance to the international lawyer and diplomat on the one hand, and the historian and the archivist on the other.     UNITED STATES MISSION TO THE UNITED NATIONS NEW YORK October 23, 2009 HC-125(S)-09 The United States Mission to the United Nations presents its compliments to the United Nations Secretariat and has the honor to refer to the standards applicable to the employment of personal workers, attendants, and any other domestic workers employed by United Nations officials who are in the United States in nonimmigrant G-5 visa status. The United States Mission wishes to emphasize the importance to the United States Government of providing fair treatment to domestic workers who come to the United States to work for members of the diplomatic community and to request that the United Nations Secretary-General take any and all measures necessary to ensure that the officials of the Organization employing such workers respect the laws relating to the treatment to be accorded domestic workers. This note supersedes previous notes on this subject. New Domestic Worker Visa Eligibility Requirements The United States Mission wishes to inform the United Nations Secretariat of two new requirements it is implementing in connection with the employment of domestic workers by United Nations officials that pertain to the visa eligibility of prospective domestic workers. The United States Mission currently requires that it be notified at the time of the arrival in and departure from the United States of all domestic workers. DIPLOMATIC NOTE -2- Effective November 15, 2009, the United States Mission will also require that it be provided with notification of any prospective domestic worker before the worker applies for a visa. This “pre-notification” requires that the Visa Committee of the United Nations Office of Human Resources Management submit a completed “Pre-Notification of a Domestic Worker” form (“Pre-Notification Form”) addressed to UNDomesticWorkers@state.gov.
