The Role of the Eu in Counter-Terrorism THE ROLE OF THE EU IN COUNTER-TERRORISM Mr Gijs De Vries, Counter-Terrorism Co-ordinator of the European Union Thursday, June 1, 2006 Consultative Com m ittee of Accounting Bodies (CCAB) Lunch at the Sheraton Luxem bourg by Rosm arie CAROTTI After a short introduction by our colleague Peter Welch, Chairm an of the CCAB, M r Gijs De Vries, European Union Counter-Terrorism Coordinator, took the floor. M r Gijs De Vries, who had left a Council m eeting to attend this session, started by outlining the recent historical form s of terrorism : IRA, ETA, Red Arm y Fractions, Red Brigades. But the tragic events of 9/11 gave terrorism a new face because of its cross-border nature and the high num ber of civilian casualties. The terrorist attacks in Spain and London therefore strengthened the EU's resolve to com bat terrorism . Europe now needs a com prehensive response to terrorism . This fight increasingly requires cross-border cooperation.     I DOCUMENTATIECENTRUM NEDERLANDSE POLITIEKE PARTIJEN 130 Lubbers' variaties In de afgelopen week heeft premier Lubbers tijdens de start van de CDA-verkiezingscampagne de aanval geopend op de PvdA. Dat verbaast mij. Toen het PvdA-verkiezingsprogramma het licht zag was de minister-president nog vol lof. "Het leest als een goed boek", was zijn commentaar. Hij voegde daar nog aan toe dat de socialisten er blijk van gaven een stuk realistischer te zijn geworden. Twee maanden geleden sprak de premier in Rotterdam op de Erasmus Universiteit. Daar gaf hij te kennen dat D66 -in tegenstelling tot de VVD- zich 'gouvernementeel' opstelt. De huidige CDA-PvdA-regeringscoalitie zou het beste kunnen worden aangevuld met D66, de zogenaamde Lubbers-variant. En nu opeens komt de premier met zijn kritiek op zijn coalitiegenoot. Hij zegt nu bevreesd te zijn dat door een zwenking naar links van de PvdA "de goede resultaten van zijn beleid zullen wegspoelen". Ik vraag mij af op welke resultaten de heer Lubbers denkt te kunnen bogen. Nederland is nu aanzienlijk zieker dan Lubbers zelf enige tijd gelden al heeft vastgesteld. De werkloosheid stijgt met 14.000 mensen per maand en bereikt een naoorlogs record. Het aantal mensen met een WAO-uitkering nadert het miljoen. Het financieringstekort neemt weer toe. In de strijd tegen de criminaliteit heeft de overheid forse tegenslagen geïncasseerd. De uitspraak van de voormalige CDA-lijsttrekker zijn bovendien vrijwel identiek aan die uit 1989, toen hij er voor waarschuwde dat "de vruchten van het herstelbeleid uit de jaren tachtig niet zouden moeten worden weggespoeld." Helaas is dat precies wat er tijdens het kabinet Lubbers- Kok is gebeurd.

He said he has to speak “with his mouth full of meal”, meaning that he could not answer the questions of the Members of Parliament in detail.1 After arriving in Brussels, he confirmed his position by stating that he had come to the EU summit with a loaded gun in his pocket and that it would not be in the Dutch interest to lay down his pistol on the table immediately. In its vagueness, Rutte’s stance is in line with the Dutch EU policy, which is traditionally seen as part of the foreign policy domain. Seen from this perspective, Dutch politicians should not be too open in public about their strategy, since this could harm their position at the EU negotiation table. For several reasons, one may ask whether this position is still accurate. Since the Treaty of Maastricht, the EU has become a policy domain far beyond the field of foreign affairs, concerning not only all ministries, but above all, the peoples of the member states. Therefore, democratic legitimacy and parliamentary control has become an important issue. One might ask why Dutch parliament allows its Prime Minister to keep his gun in his pocket.

Introduction In 1991, civil war broke out in Yugoslavia. European leaders initially thought their collective efforts would suffice to contain and resolve the conflict. Luxembourg’s Foreign Minister Jacques Poos famously declared that ‘The hour of Europe has dawned.’1 It proved a false dawn. Divided among themselves, and unwilling to risk the lives of their own soldiers, European governments proved incapable of restor- ing peace to their continent. Instead, the United States and NATO did. This humiliating experience has prompted EU Member States to strengthen their political and military capacities for joint action. The Common Foreign and Security Policy (CFSP) was established as the Second of the three Pillars of the European Union in the Maastricht Treaty of 1992. It covered ‘all questions related to the security of the Union, including the eventual framing of a common defence policy, which might in time lead to a common defence’ (Art. J.4(1) TEU). In June 1992, the Ministerial Council of the Western European Union decided that military forces of WEU member states could be employed for humanitarian and rescue tasks, peace- keeping tasks, and tasks of combat forces in crisis management, including peace- making. These so-called ‘Petersberg tasks’ were included in the European Union’s Amsterdam Treaty in 1997. They currently feature in Article 17(2) of the Treaty on European Union. The Amsterdam Treaty also created the post of High Representa- tive for CFSP.2 Having endowed the Union with these competences, Member States realised they had to provide the necessary capabilities as well.

Na de val van de Berlijnse muur in 1989 en de ondergang van het communisme startte Brussel de onderhandelingen met de staten in Midden- en Oost-Europa over toetreding. De ambitieuze blauwdruk kwam grotendeels uit de koker van pvda’er Piet Dankert, staatssecretaris van Buitenlandse Zaken, belast met Euro- pese samenwerking. Vrijwel alle andere lidstaten waren van dit ontwerp niet gediend, zodat de deconfiture als ‘zwarte maandag’ de geschiede- nis in zou gaan. Lubbers mocht dan op Europees niveau zijn hand hebben overspeeld, in Den Haag kon hij op de warme steun van de coalitiepartijen rekenen – en zelfs die van de beide oppositiepartijen d66 en de vvd.1 In de pro-Europese Haagse harmonie begon echter enige verande- ring te komen door toedoen van vvd-leider Frits Bolkestein. Hij kriti- seerde openlijk het streven van zijn partij naar ‘een Europese Unie op federale grondslag’, en de daarbij horende overdracht van soevereiniteit van de lidstaten naar Brussel.
