QUT Sport – UniSport Nationals Participation Agreement Your selection to represent QUT in the UniSport Event(s) (including but not limited to, at the Nationals Div 1&2), is conditional upon you, or where applicable, your parent or legal guardian, signing this Agreement and accepting the terms and conditions as stated. Page 1 of 8 QUT Sport – UniSport Nationals Participation Agreement PARTIES Queensland University of Technology ABN 83 791 724 622 of 2 George Street, Brisbane, Queensland 4000 (‘QUT’) Selected QUT Sport Student representative (’I’, ‘You’ or ‘Your’) 1. Definitions 1.1 In this Agreement: Agreement means these Terms and Conditions, any annexures or attachments, or other document incorporated by reference. ASADA means the Australian Sport Anti-Doping Authority. Commencement Date means the date that QUT receives notification that You have electronically accepted the terms of Your UniSport Participation Agreement. Law means any applicable statute, regulation, by-law, ordinance, policy or subordinate legislation in force from time to time in Australia, whether made by a State, Territory, the Commonwealth or a local government, and includes the common law and equity as applicable from time to time, and any mandatory standards or industry codes of conduct. Medical Condition has the meaning given in clause 7.2. Personal Information means information or an opinion (including information or an opinion forming part of a database) whether true or not, and whether recorded in material form or not, about an individual whose identity is apparent, or can be reasonably ascertained, from the information or opinion. Term means the period commencing on the Commencement Date and ending upon Your return to Your home city following the Events. UniSport means UniSport Australia Limited ABN 22 634 634 319. UniSport Code has the meaning given in clause 6.3. UniSport Events means all official and unofficial UniSport events and functions, and includes the 2021 UniSport Nationals. UniSport Officials means any official or delegate appointed by UniSport in relation to the UniSport Events, and includes without limitation event staff and organizers, coaches, umpires, referees. 1.2 In this Agreement, the following rules of interpretation apply unless the contrary intention appears: (i) headings are for convenience only and do not affect the interpretation of this Agreement; (ii) the singular includes the plural and vice versa; (iii) words that are gender neutral or gender specific include each gender; (iv) where a word or phrase is given a particular meaning, other parts of speech and grammatical forms of that word or phrase have corresponding meanings; (v) “includes” means without limitation; (vi) a reference to: (i) a document includes all amendments or supplements to that document; (ii) a clause, term, party, schedule or attachment is a reference to a clause or term of, or party, schedule or attachment to, this Agreement; Page 2 of 8 (iii) an agreement other than this Agreement includes an undertaking, or legally enforceable arrangement or understanding, whether or not in writing; and (iv) a monetary amount is in Australian dollars. 2. Term This Agreement commences on the Commencement Date and continues for the Term unless terminated earlier in accordance with this Agreement. 3. Personal Obligations 3.1 As a member of the QUT Team You acknowledge and agree that the You: (a) remain at all times a representative of QUT; (b) will only participate at UniSport Events if You are eligible according to UniSport Rules, and agree to advise the QUT Team Manager immediately of any change to Your circumstances that may impact Your ability to participate at UniSport Events; (c) must comply with all Laws; (d) must comply with all directions, policies, procedures and guidelines of QUT, including the conduct requirements specified in clause 6. (e) must comply with all applicable policies, procedures, guidelines or other documentation provided by UniSport in relation to the UniSport Events. (f) must not engage in any unlawful behaviour, including harassment of any UniSport Officials, other event participants, spectators or members of the public. 3.2 In relation to Team duties and participation at the UniSport Events, You acknowledge and agree to: (a) always behave in a responsible and appropriate manner, including observing the spirit of fair-play, while attending, participating and engaging with officials, organizers, other teams and members of the public at all UniSport Events; (b) behave appropriately at all times to ensure You maintain peak-performance and carry out Team duties to the best of Your ability at all UniSport Events; (c) observe and comply with all reasonable directions of the QUT Team Manager and UniSport Officials and event staff (including appointed delegates); 3.3 While travelling to and from UniSport Events, including attending, participating in and obtaining or receiving related services such as accommodation services, You agrees to: (a) wear the official QUT Team Uniform; and (b) behave in a proper manner so as to ensure team harmony and avoid any conduct which has the potential to bring You, QUT or UniSport into public disrepute or censure. 4. Anti-Doping and prohibition on illicit substances 4.1 You agree to comply with all Laws regarding: (a) anti-doping; (b) responsible consumption of alcohol; and (c) possession, use, supply, or otherwise dealing with illicit substances. 4.2 You warrant, and it is a condition of this Agreement, that: (a) You will not possess, use, traffic, supply or otherwise deal (including any attempt) with any illicit substance; (b) You will not participate in any UniSport Event whilst under the influence of any alcohol or illicit substance; Page 3 of 8 (c) You will not consume any alcohol at UniSport Events venues while carrying out Team duties; (d) in relation to consumption of alcohol during the Term (including without limitation social functions hosted by UniSport), You will only consume alcohol in a responsible manner: (i) in licensed areas within the relevant venue(s); (ii) outside of times designated by QUT which are deemed to be competition preparation blocks (iii) avoiding excessive intoxication and any inappropriate conduct; and (iv) will refrain from any conduct that will or is likely to breach this Agreement, or cause QUT to breach the terms of any corporate arrangement in connection with this Agreement. 4.3 You acknowledge and agree that: (a) any breach of this clause, including excessive consumption of alcohol, is strictly prohibited during the Term; (b) all instances of non-compliance will be subject to investigation in the first instance, and may result in disciplinary proceedings and/or referral to relevant authorities; and (c) where QUT incurs unexpected costs as a result of Your breach of this clause 4, including in relation to any injury or third party property damage, QUT will seek reimbursement from You directly in accordance with clause 5.2. 4.4 You acknowledge that UniSport requires You to comply with: (a) The UniSport Anti-Doping Policy (as adopted and implemented in accordance with ASADA’s and UniSport’s responsibilities under the World Anti-Doping Code, the Australian Sports Anti-Doping Authority Act 2006 (Cth), the Australian Sports Anti-Doping Authority Regulations 2006 (Cth) (including the National Anti-Doping scheme), available at https://docs.wixstatic.com/ugd/8e3023_2e2a92340c214715b6aa33d59ce777ea.pdf; and (b) in relation to each sport You will perform at the UniSport Events, the relevant ASADA National anti- doping policies and the World Anti-Doping Code, as applicable (available at https://www.asada.gov.au/). *Note: further information about these requirements can be obtained by contacting UniSport. 5. Financial Obligations and Participant Expenses 5.1 You agree that selection to the QUT Team and participation in the UniSport Events is subject to QUT receiving the QUT Sport Participation Fee by the specified due date, unless otherwise agreed with QUT. 5.2 You acknowledge and agree that: (a) You will be required to reimburse QUT for any unanticipated or unauthorised costs or expenses incurred by QUT (‘Expenses’) as a direct result of Your conduct during the Term; (b) for the purposes of this Agreement, Expenses includes without limitation: (i) costs associated with withdrawal or forfeiture of You or the QUT Team; and (ii) expenses associated with air travel, accommodation and hire vehicles (including third party property damage). 5.3 If QUT incurs any Expenses as contemplated in clause 5.2(a): (i) QUT will issue to You an itemised account of the relevant Expenses (‘Expenses Notice’); and (ii) You will promptly reimburse QUT for all specified Expenses, in accordance with the terms and conditions stated on the Expenses Notice. Participant Conduct Requirements and Disciplinary Process 6.1 You acknowledge that QUT and/or UniSport Officials will assess Your conduct throughout the Term (as applicable), including before, during and after UniSport Events, and Your conduct in connection with accommodation providers and non-sport related activities. QUT Student Code of Conduct 6.2 You acknowledge and agree that: (a) You must comply with the QUT Manual of Policies and Procedures E/2.1 Student Code of Conduct, available at http://www.mopp.qut.edu.au/E/E_02_01.jsp (QUT Student Code) at all times while away from home and representing QUT; and (b) any breach of the QUT Student Code will be dealt with in accordance with clause 6.5. UniSport Code of Behaviour 6.3 You warrant that You have read, understood, and agree to comply at all times with the UniSport Code of Behaviour extract (UniSport Code, available at https://www.unisport.com.au/policies-and- guidelines) whilst attending or participating in UniSport Events.
