Washington has raised its annual military assistance by two-thirds to $50 million and is providing surplus military equipment. To further cement the relationship, Philippine and US defense officials announced that the two countries would negotiate a new “framework agreement” under the 1951 Mutual Defense Treaty providing for greater access by US forces to Philippine bases and the positioning of equipment at these facilities. Washington is also stepping up participation in ASEAN-based security organizations, sending forces in June to an 18-nation ASEAN Defense Ministers Plus exercise covering military medicine and humanitarian assistance in Brunei. Prefatory Statement & Position I write this Dissenting Opinion to reiterate my position that the Executive Department under President Benigno Aquino III disregarded the clear commands of the Constitution and the required constitutional process when it implemented the Enhanced Defense Cooperation Agreement (EDCA) as an Executive Agreement. I thus vote for the grant of the motions for reconsideration. The EDCA, an international agreement between the Philippines and the United States, should be covered by a treaty that, under the Constitution, ~ Dissenting Opinion 2 G.R. Nos. 212426 and 212444 requires concurrence by the Senate. The agreement should be made through a treaty rather than an executive agreement because it embodies new arrangements and new resulting obligations that are not present in the existing treaties.

The Basilan Attack: First Significant IS Battle in Southeast Asia By Rohan Gunaratna Synopsis Following the attack by IS on the Philippine army in Western Mindanao, Manila should make fighting IS its national security priority and step up cooperation with its counterparts in Southeast Asia to eliminate the threat. Otherwise, IS will grow and affect the security and stability of the region. Commentary THE SELF-STYLED Islamic State (IS) mounted an attack on the Philippine army in Basilan, Western Mindanao, killing 18 and injuring 53 on 9 April 2016. Although Manila did not acknowledge the clash as a fight between government forces and IS, the group that fought the Armed Forces of the Philippines (AFP) was led by the IS’ designated leader in the southern Philippines, Isnilon Hapilon, a former deputy head of the Abu Sayyaf Group (ASG). Defence Secretary Voltaire Gazmin and the Armed Forces Chief of Staff flew to Zamboanga City and Basilan the next day. The operation by AFP was poorly executed and demonstrated the lack of appreciation of the emerging IS threat.
