THE MUNICIPALITY IS A LOCAL SELF-GOVERNMENT UNIT

THE LOCAL SELF-GOVERNMENT IN THE REPUBLIC OF MACEDONIA IS TERRITORIAL- LY ORGANISED IN 84 MUNICIPALITIES, OF WHICH 10 ARE IN THE CITY OF SKOPJE.

ALL MUNICIPALITIES HAVE EQUAL COMPETENCES

CITIZENS EXERCISE THEIR RIGHT TO LOCAL SELF-GOVERNMENT DIRECTLY AND THROUGH THEIR REPRESENTATIVES IN THE ORGANS OF THE MUNICIPALITY

THE CITY OF SKOPJE IS A PARTICULAR LOCAL SELF-GOVERNMENT UNIT WHERE CITIZENS FULFIL THEIR COMMON NEEDS AND INTERESTS ARISING FROM THE CHARACTER OF THE CITY OF SKOPJE AS THE CAPITAL OF REPUBLIC OF MACEDONIA

4 KEY FACTS ABOUT THE MUNICIPALITIES

• The biggest municipality in the Republic of Macedonia by population is Kumanovo, with 105,484 inhabitants. • Vranestica has the least population, with 1,322 inhabitants and Vevcani, with 2,433 inhabitants. • Prilep is the biggest municipality by territory, 1,198 square kilometres. • The smallest municipality by territory is Vevcani, 23 square kilometres. • Out of the municipalities in the city of Skopje, the biggest municipality by population is Gazi Baba, with 72,617 inhabitants, whereas the smallest one is Suto Orizari, 20,800 inhabitants. • The biggest municipality in Skopje by territory is Saraj, 229 square kilometres, the smallest being Cair, 3.5 square kilometres.

Out of 84 municipalities: • there are 16 with less than 5,000 inhabitants; • 16 municipalities, 5,000 - 10,000 inhabitants; • 21 municipalities, 10,000 - 20,000 inhabitants; • 17 municipalities, 20,000 - 50,0000 inhabitants; • 13 municipalities, 50,000 - 100,000 inhabitants; • Only one municipality, Kumanovo, has over 100,000 inhabitants.

In the Republic of Macedonia, there is a total of 1,767 populated areas. Bitola is the biggest municipality by the number of populated areas, a total of 66.

In 32 municipalities, beside the Macedonian, another official language and alphabet in use is the one of the ethnic community represented by over 20% of the population. • In 28 of these municipalities, both Macedonian and Albanian are official languages, • in 4 municipalities, Macedonian and Turkish, • in 1 municipality, Macedonian and Serbian, and • in one, Macedonian and Roma languages. In 19 of these 32 municipalities, the representatives of the non-majority communities at central level, are represented by over 50%. Those municipalities are: Aracinovo, Brvenica, Vrapciste, Gostivar, Debar, Zelino, Zajas, Bogovinje, Lipkovo, Oslomej, Plasnica, Struga, Studenicani, Tearce, Tetovo, Centar Zupa, Saraj, Cair and Suto Orizari.

The regulations related to culture, use of alphabet and languages spoken by less than 20% of the citizens in the municipality, the determining and the use of the coat of arms and the flag of the municipality are adopted by majority of votes from the present Council members, with majority of votes of the present Council members from communities which are not the majority population in the municipality (so-called “Badinter majority”). 1. CITIZENS RIGHTS

CITIZENS HAVE A RIGHT TO DIRECT PARTICIPATION IN THE DECISION-MAKING ON ISSUES OF LOCAL COMPETENCE

Citizens’ Initiative

Applying this form, citizens’ initiative, citizens have a right to propose to the Municipal Council adoption of a certain act or decide upon a certain issue of its jurisdiction. The citizens’ initiative can not refer to issues related to staff and finances. The Council is obliged to debate on the initiative within 90 days if it is supported by 10% of the electorate of the municipality, or the neighbourhood government the issue relates to and consequently inform the citizens about the decision made.

Citizens’ Gathering

Citizens’ Gathering can be summoned for the territory of the whole municipality or for the area of the neighbourhood government, on Mayor’s initiative, on Council’s request, or upon request of at least 10% of the municipal electorate, or the electorate of the neigh- bourhood government the issue relates to. The municipal organs are due to review the con- clusions of the Citizens’ Gathering within 90 days, take them into consideration and then inform the citizens about their decision.

Referendum

The citizens can decide on issues of local jurisdiction as well as on other issues of local interest by referendum. There can be local referendum on adoption of a regulation, on issues to be regulated in the municipality, the City of Skopje and the municipalities in the City of Skopje (previous referendum), or for assessing a regulation previously adopted (additional referendum). The Council can organise a referendum upon request of at least 20% of the munici- pal electorate. The Council can also organise a referendum upon its initiative on issues of its jurisdiction. The decision made on the referendum is obligatory for the Council. Local referendum can not be organised on issues related to budget and final account of the budget of the municipality, the City of Skopje and on municipal administration organ- isation. Local referendum can not be organised on issues for which the Council decides on with majority votes of the present Council members, the majority of which are majority votes of the ethnic representatives who are not the majority population in the municipality, the City of Skopje and the municipalities in the City of Skopje.

9 Complaints and Proposals

Citizens have a right to submit complaints and proposals on the work of the munici- pal organs and the municipal administration individually or as a group.

Public Hearings

When developing certain regulations in the municipality, citizens have a right to express their opinion at public hearings and debates organised and conducted by the Municipal Council or the Mayor.

CITIZENS HAVE A RIGHT TO BE INFORMED ABOUT THE WORK OF THE MUNICIPAL ORGANS

The municipal organs, the Municipal Committees and public services established by the municipality have a duty to inform the citizens, free of charge, about their work, the plans and programmes important for the development of the municipality. The Municipal Council sessions are public, except for cases when there are justified reasons determined by statute. The sessions on which there is a debate on the municipal budget, the annual budget account and urban plans must not be closed for the public.

CITIZENS HAVE A RIGHT TO KNOW HOW THE MUNICIPALITY SPENDS THEIR MONEY

After the end of the fiscal year, the Municipal Council adopts the annual municipal budget account. The annual account contains all the planned and actual revenues and expenditures of all municipal budget users. After the adoption of the annual account, the Mayor informs the public on its contents.

CITIZENS HAVE A RIGHT TO NEIGHBOURHOOD GOVERNMENT

The municipality can establish forms of neighbourhood government, i.e. urban com- munities in towns and rural communities in the other populated areas. On the citizens’ gatherings, the inhabitants of the urban, i.e. rural community: - review issues, take positions, and make proposals on issues of direct and every- day importance for the life and work of the inhabitants of their community. - can select a council of the urban, i.e. the rural community, in a procedure deter- mined by the municipal statute.

The municipal statute in details regulates the relations with the municipal organs, the activ- ities the Mayor is responsible for whose performance may be delegated to a president of the neighbourhood government council, and the manner of providing funds for delegated activities. 10 2. COMPETENCES OF THE MUNICIPALITY

ENVIRONMENT PROTECTION

• The municipality takes measures for protection and prevention from water pollution, air pollution, land pollution, protection of nature, noise pollution protection, and non-ionising radiance.

LOCAL ECONOMIC DEVELOPMENT

• The municipality plans the local economic development, determines priorities, creates local economic policy, supports the development of small and medium- sized businesses as well as the entrepreneurship at local level, participates in the establishment and development of local network of institutions, promotes partnership.

COMMUNAL ACTIVITIES

• The municipality is responsible for: • Supply of drinking water, • Delivery of industrial water, • Outflow and purification of waste waters, • Maintenance of public hygiene, 11 • Public lighting, • Local public transport, • Street traffic signalization, • Parking, • Construction and maintenance of open markets, • Supply of natural gas and heating energy, • Construction, reconstruction and maintenance of local roads and streets, • Determining names of streets, squares, bridges, according to law.

CULTURE

• The municipality is founder of local cultural institutions, • It fosters the folklore, customs, old crafts, • Organizes cultural events, • Encourages various forms of artistic creation.

SPORT AND RECREATION

• The municipality is founder of local sport facilities, • Takes care of the develoipment of mass sport and recreation, • Organizes sport shows and events, • Supports sport unions.

SOCIAL PROTECTION AND CHILD CARE

• The municipality is founder of kindergartens and homes for the elderly, • cares for the disabled, for parentless children, children with special needs, people abused by drugs and alcohol, education of pre-school children, in compliance with the National Programme on Social Protection Development.

EDUCATION

• The municipality is founder of primary and secondary schools, • It is responsible for its funding and administration in co-operation with the central government, • Organizes transport and meals for students and their accomodation in boarding homes.

HEALTH CARE

• The municipality participates in managing public health organisations in primary health care by appointing members of the Managing Boards, • cares for improvement of health, health education, preventive activities, assistance to patients with special needs, etc. 12 PROTECTION AND RESCUE

The municipality conducts preparation and undertakes measures for protection and rescue of citizens and the material goods from: • war destructions, • natural disasters, and • other accidents and consequences resulting thereof.

FIRE PROTECTION

Fire protection is carried out by 30 territorial fire protection units located in: • Skopje, Kratovo, Probistip, Sveti Nikole, Vinica, Valandovo, Kavadarci, Makedonski Brod, Resen, Debar, Struga, Kriva Palanka, Delcevo, Berovo, Radovis, Negotino, Krusevo, Demir Hisar, Kicevo, Gostivar, Veles, Kumanovo, Stip, Kocani, Strumica, Gevgelija, Prilep, Bitola, Ohrid and Tetovo.

3. POWERS OF THE ORGANS OF THE MUNICIPALITY

The Mayor: • Represents and advocates for the municipality • Controls the legality of the council’s regulations • Publishes the council’s regulations in official newsletter • Provides for implementation of the Council’s decisions • Initiates and proposes adoption of regulations • Proposes the annual budget and the annual account of the municipal budget • Executes the municipal budget • Selects managers of the public services established by the municipality, based on public announcement • Regularly informs the Council about the performance of the Mayor’s responsibilities • Makes decisions on administrative issues, on rights, obligations and interests of legal and physical entities, in compliance with law • Manages the municipal administration • Provides for appropriate and lawful utilization, maintenance and protection of the municipal property.

The Council: • Adopts the statute of the municipality and other regulations • Adopts the budget and the annual account • Determines the amount of own funding sources, according to law • Establishes public services and supervises their performance • Appoints members of managing boards of the public services • Adopts programmes on the activities of the public services 13 • Adopts reports on budget execution and the municipal annual account • Adopts reports and final accounts of the public services • Decides upon the manner of availability of the municipal property • Decides upon the manner of conducting financial control over the municipal budget, according to law • Selects the head of the local office of the Ministry of Interior in the municipality, according to law • Reviews and adopts the annual report on public safety, submitted to the Minister of Interior and the Ombudsman.

4. FINANCING OF THE MUNICIPALITY AND ITS TASKS

The municipality is financed from: • Own revenues; • Revenues from Personal Income Tax; • Grants from the Budget of the Republic of Macedonia and the budgets of the Funds.

THE MUNICIPALITY HAS THE FOLLOWING REVENUES FROM OWN FINANCING SOURCES AVAILABLE:

1. Local taxes determined by law: • Property tax; • Tax on inheritance and gift, determined by law • Property sales tax, and • Other local taxes determined by law.

2. Local fees determined by law: • communal fees; • administrative fees; • other local fees determined by law.

3. Local charges determined by law: • Charges for construction land development; • Charges from communal activity • Charges for physical and urban plans • Other local charges determined by law.

4. Revenues from ownership: • Revenues from lease; • Revenues form interests • Revenues from property sales, but sales that do not disrupt the public functions and competences of municipalities. 14 5. Revenues from donations; 6. Revenues from fines determined by law; 7. Revenues from self-contribution; 8. Other revenues determined by law.

THE AMOUNT OF LOCAL TAXES, LOCAL FEES AND LOCAL CHARGES IS DETERMINED BY THE MUNICIPALITY, ACCORDING TO LAW

Revenues from personal Income Tax: • 3% of the personal income tax from the salaries of physical entities collected in the municipality of their residence • 100% of the personal income tax from physical entities in handicrafts.

Grants from the Budget of the Republic of Macedonia and from the budgets of the Funds

The grants from the Budget of the Republic of Macedonia and from the budgets of the Funds provide additional revenues to the municipal budget to fund the municipal com- petences determined by law. The following types of grants are transferred from these budgets: • revenues from VAT; • earmarked grants; • capital grants; • block grants; • grants for delegated competence.

Revenues from VAT

Revenues from VAT are provided in the amount of 3% of the total collected VAT in the previous fiscal year. The revenues from VAT are allocated by municipality based on determined methodol- ogy for allocation of VAT revenues by the Government of the Republic of Macedonia.

THE MUNICIPALITY MAKES A DECISION ON THE MANNER OF USING THE VAT AND PERSONAL INCOME TAX REVENUES

Earmarked Grants

Earmarked grants are used for funding of certain activities. The line ministries propose the allocation of the earmarked grants by municipality, by project, and by institution to the Ministry of Finance.

15 Capital Grants

Capital grants based on a programme determined by the Government of the Republic of Macedonia are used for funding of investment projects.

Block Grants

Block grants are used for funding of competences determined by the Law on Local Self-Government in the fields of culture, social protection and child care, education, and health care. The funding by block grants will start in the second stage of the decentralisation process. Block grants will be transferred to the municipalities when the responsible Committee will confirm that the municipality has the necessary capac- ity for financial management, has shown good results in financial performance in the previous 24 months, and has no debts exceeding the usual payment conditions.

Grants for Delegated Competence

The grant for delegated competence is used for funding a delegated competence from the state administrative body to the Mayor of the municipality.

5. YOUR QUESTIONS

Do all mayors have equal salaries? The Mayor’s salary depends on the number of inhabitants in the municipality. According to the law that reg- ulates this matter, different coefficient, depending on the number of population in the municipality, is used for mayor’s salary calculation. - For mayor of municipality with up to 10,000 inhabitants, the coefficient is 2.7 - For mayor of municipality with up to 25,000 inhabitants, the coefficient is 2.9 - For mayor of municipality with up to 50,000 inhabitants, the coefficient is 3.2 - For mayor of municipality with over 50,000 inhabitants, the coefficient is 3.4 - The coefficient for determining the salary of the Mayor of Skopje is 3.7. The coefficient is determined on the basis of the average net salary in the Republic of Macedonia paid in the last three months.

What is the fee of the council members for attending municipal council sessions? For the work during the Council sessions, the Council members, including the President, have a right to a fee for attending the session, at most to 30% of the average net salary paid in the last three months. This is a fee for one session, regardless of its duration. The Council may determine different fee for the Council members and the President, however, the highest fee must not exceed the legally determined limit of 30% of the average net salary in the Republic of Macedonia paid in the last three months.

Which body is responsible for issuing a building permit? According to the Law on Construction, the constructions of third, fourth, and fifth categories are buildings of local importance. This implies that the Mayor of the municipality issues a building permit for these constructions, i.e. the mayors of the municipalities in Skopje. The third category of constructions refers to facilities for primary and secondary education, sport activities, culture, religious facilities, primary and secondary health care, social protection, economic and industrial construc-

16 tions, catering constructions, business, housing and business, and housing constructions, with over three levels of height, etc. Housing constructions up to three levels are constructions of fourth category. The Mayor also issues a build- ing permit for these, as well as for construction for the need of small businesses up to two levels of height. Fifth category structures are family house, monument and commemoration plaque, ground floor commer- cial structure in economy yard, booth and other prefabricated structures, sport flat field surface (football play- ground, tennis court etc.) etc.

What is the procedure for issuing a building permit? In order to obtain a building permit, the constructor submits a written request to the responsible body. In addition to the request, the constructor needs to submit a decision on location, project idea, complete basic proj- ect, approved evaluation study on the impact of the project on the environment, and approved evaluation study on the quality of the seismic protection of the facility. The building permit is issued within 7 days after the receipt of the complete documentation. The building permit is not valid if the constructor does not begin construction works within two years after the date the building permit has been issued.

Who the applicant of the building permit can address if his/her request is denied by the Mayor? The constructor may file a complaint, within 15 days after the receipt of the decision, to the Minister in charge of the state administrative body responsible for physical development, i.e. the Minister of Transport and Communications, against the decision, of the Mayor, that denies issuance of a building permit.

Who is responsible and what is procedure for election of principal of primary school? According to the Law on Primary Education, the principal of primary school is elected and dismissed by the Mayor, according to a procedure determined in this Law. Three months after the end of the mandate of the current principal, the Mayor brings a decision on pub- lishing a public announcement on election of principal by the School Board. The School Board and the representative from the Education Bureau interview the candidates that meet the requirements. The School Board propose one candidate to the Mayor, within 7 days after the interviews conducted. The Mayor elects the principal within 15 days after the receipt of the proposal. If the Mayor does not appoint the principal within this prescribed timeline, the School Board proposes another candidate whom the Mayor is obliged to appoint a principal within 5 days.

Who are the members of the School Board and what are its responsibilities? The School Board is a managing body of the primary school. • The School Board in smaller schools, up to 24 classes, consists of seven members: two represen- tatives from the teachers, technical associates and educators, two representatives from the parents, one representative from the Ministry of Education and two representatives from the founder (the municipality). • In schools with more than 24 classes, the School Board consists of 9 members: there is one more representative from each party or three representatives from the teachers and parents each.

The School Board: - Adopts the statute of the primary school - Proposes annual programme of the school and makes a report on its work submitted to the Municipal Council - Proposes financial plan and submits it to the founder - Proposes its final account

17 - Publishes public announcement on election of principal - Interviews the candidates for principal - Proposes a candidate for principal to the Mayor - Gives opinion on the selection of teachers to the principal - Decides on complaints by the school employees - Decides on complaints by parents and pupils - Revies other issues determined by the statute of the primary school

Who is responsible for determining the names of streets? According to the Law on determining names of streets, squares, bridges and other infrastructure facilities, the names on the territory of the municipality are determined by a decision of the Municipal Council, whereas for the territory of the City of Skopje, the Council of the City of Skopje is responsible in this regard. The decision is adopted by majority of votes of the present Council members, with majority of votes of com- munities which are not majority population in the municipality, i.e. the City of Skopje. The Law also envisages a procedure for determining the names. Firstly, the Councils make up a list of names that could be determined of geographic, ethnographic, historical and other significance, or give name of an outstanding figure in history, science and culture, other suitable names, as well as names of important events and dates. The Council determines the list after previously given consent by the Government of the Republic of Macedonia. When determining the list of names by the Council of the City of Skopje, the municipalities in the City of Skopje give their opinion about the list. A street can not be given a name that is disrespectful to the Republic of Macedonia, or offends national feelings of citizens of our and other countries, or disrupts the relations between communities, traditions and pub- lic moral. The names of the streets can also be determined by a number only. The determining of street names is not obligatory for populated areas with up to 100 housing facilities. The street name, according to the Law, can not have more than four words. The street names are written in Macedonian and its cyrillic alphabet. In municipalities where at least 20% of the citizens use another language, different from the Macedonian, the street names are written both in Macedonian and the language used by at least 20% of the citizens in the municipality.

Who can erect memorial monuments and memorial landmarks and who is responsible for issuing permits for construction thereof? Pursuant to Art. 5 of the Law on Memorial Monuments and Memorial Landmarks, the Assembly of the Republic of Macedonia can erect a monument. Initiatives for erecting a memorial monument can be proposed by the Assembly of the Republic of Macedonia and the state administrative bodies, the local self-government units, institutions, citizen associations, foundations and other interested legal entities and citizens. Art. 3 of this Law clearly defines what is a memorial monument. Memorial monuments are individual or a set of objects or monumental pieces of work in architecture, sculpture, painting and fine arts with historical and artistic contents and values, erected for permanent cherish of the mem- ory of events and figures of Art. 2 of this Law, of exceptional importance for the Republic of Macedonia. Memorial landmark can be built by municipalities, the City of Skopje and municipalities in the City of Skopje. Initiatives can also be submitted by legal and physical entities to the municipal councils, to the City of Skopje and the municipal councils in Skopje, and invest funds for building the memorial landmark. Art. 4 of this Law defines what is a memorial landmark. Memorial landmark implies statues, sculptures, plaques, fountains and other artistic and architectural pieces of work and creations whose contents and marks present events and figures of Art. 2 of this Law or from the folk tradition, of local interest. Accoridng to the Law on Construction, memorial monuments and memorial landmarks are construc- tions of fifth category. Accoridng to Art. 51, paragraph 2 of this Law, these constructions are of local importance and building permit is issued by the mayor of the municipality, i.e. the mayor of municipalities in the City of Skopje.
