Appendix B Long Range Service and Investment Program for Passenger Rail APPENDIX B LONG RANGE SERVICE AND INVESTMENT PROGRAM FOR PASSENGER RAIL (2009 – 2013) Introduction This Appendix describes the Long Range Service and Investment Program (LRSIP) required by the Federal Passenger Rail Investment and Improvement Act of 2008. These are the projects that the state expects to undertake or support, in whole or in part, to improve intercity passenger rail service in the future. The ultimate decisions on costs and funding of these projects are subject to future discussions with the involved rail partners. This investment program was developed from the comprehensive inventory of rail system needs described earlier in this report, specifically those projects that improve intercity rail passenger service. This Appendix presents the list of projects contained in the LRSIP. These include projects that solely benefit passenger rail service, as well as projects that benefit passenger rail service and improve infrastructure of the owning railroads, which can be either commuter railroads or freight railroads. Improvements are presented on each New York’s passenger rail corridors, including the Empire Corridor from Albany south to New York City, (Hudson line), Empire Corridor west from Albany to Niagara Falls (Empire Corridor West) and on the Adirondack line from Albany north to the Canadian border. The combination of projects on each segment of the corridor provide significant benefits to the passenger rail traveling public. These projects will improve rail infrastructure including track, control signals and passenger stations across the state and will result in significant improvements to intercity passenger rail service. These investments address critical capacity and bottleneck constraints as well as operational improvements that will improve the fluidity of the multi-purpose rail network. -

Introduction I am Andy Daly. I am Senior Director of Passenger Operations for CSX Transportation, Inc. (“CSXT”). My role as Senior Director of Passenger Operations includes overseeing the daily operations of passenger operations hosted by CSXT, as well as upholding CSXT’s contractual and statutory obligations with respect to passenger service. I have been involved in the analysis of CSX’s proposed acquisition of Pan Am Systems, Inc. (“Systems”) (the “Proposed Transaction”) since the bid process. Specifically, I have been involved in outreach, coordination, and planning for the integration of the current as well as the proposed passenger services on the PAR System1 and PAS Network. In connection with preparation of the Application submitted in this proceeding on February 25, 2021, and the Amended Application submitted in this proceeding on April 26, 2021, I oversaw the CSXT team that worked with the Systems team to prepare the passenger rail elements of the Operating Plan attached as Exhibits 13 to those filings. In order to highlight the importance that CSXT places on potential impacts to passenger rail resulting from the Proposed Transaction, I have prepared this Verified Statement to consolidate all discussion of passenger rail issues. -

It doesn’t like to be jostled, stored in hot places, or exposed to bright light. That’s one reason Washington state winemaker Chateau Ste. Michelle sends a million cases a year to East Coast markets in boxcars via the Produce Railex- press with Union Pacific, CSX, and a shipper called Railex. That’s right: boxcars. But not just any boxcars in any freight train. These are new 64-foot mechanical refrigerator cars weigh- fing in at more than 90,000 pounds each and running in solid, non-stop unit trains at passenger-train speeds. With nearly 7,000 cubic feet of interior space and with the capacity to haul 200,000 pounds, each of these cars can carry the load of three or four trucks, depending on whether it’s wine, salad ingredients, melons, or veggies. Temperatures are monitored and set by satellite from the mechanical desk at UP’s Harriman Dispatch Center in Omaha, Neb. The iceman cometh not. These food and drink unit trains are guaranteed to make the one- way trip in five days, matching or beating single-driver truck transit times for the 3,000-mile trips from the Railex hubs in California and Washington to its distribution center in Rotterdam, N.Y. Although the year-round service was initially designed for 55-car trains, advances in A.C. traction and distributed power have removed train length limits. -

Existing Transportation Conditions and Major Markets Section 2.1 presents an overview and route description of the existing Empire Corridor rail system. Section 2.2 describes the importance of the Empire Corridor to major markets, including the existing regional transportation market. Section 2.3 describes the linkages of the Empire Corridor to other rail routes. Sections 2.4 through 2.9 present the existing conditions of the Empire Corridor freight and passenger rail service relative to current rail operations, infrastructure, deficiencies, and safety considerations. 2.1. Empire Corridor Rail System 2.1.1. Railroad Ownership Exhibit 2-1 illustrates track ownership on the Empire Corridor. Amtrak owns, maintains, and dispatches the southernmost 20 miles of track on Empire Corridor South (west side line of former New York Central Railroad), from Penn Station to the Spuyten Duyvil Bridge that spans the Harlem River at the northern tip of Manhattan. Metro-North leases the track22 along the east side of the Hudson River, from the Spuyten Duyvil Bridge to Poughkeepsie, for its Hudson Line service with responsibility for maintenance and dispatching. With the exception of one short (6.8-mile) segment owned by Amtrak west of the Schenectady Station, located between the station and Hoffmans, CSXT is the owner of the Empire Corridor West rail infrastructure from Poughkeepsie to Niagara Falls. This CSXT corridor comprises the Hudson Subdivision (Poughkeepsie north to Albany-Rensselaer and west to Hoffmans); Selkirk Subdivision (Hoffmans to Amsterdam); Mohawk Subdivision (Amsterdam to Syracuse); Rochester Subdivision (Syracuse to Buffalo); Buffalo Terminal Subdivision in Buffalo; and Niagara Subdivision (Buffalo to Niagara Falls). -
