SHERRIF’S SALES

Conditions ofsale 1, The sale is conducted in terms of the rules of the High Court, which provide that it shall be without reserve but subject to the condition that the Sheriff requires to be satisfied that the highest price offered is reasonable, having regard to the circumstances of time and place and the state of the property. 2. After the auction, a report on the bidding and on thehighestprice offered, together with any other relevant information relating to the sale, will be forwarded to the Sheriff, who,if satisfied that the highest price offered is reasonable, having regard to the circumstances of time and place and the state of the property, will declare the highest bidder to be the purchaser. po . 3. In termsoftherules of court, any person having an interest in the sale may, within seven days of the Sheriff having declared the highest bidder to be thé” purchaser. apply to the High Court to haveit set aside on the grounds that the sale was improperly conducted or the property was sold for an unreasonably low sum, or any other good ground. , ‘

Immediately after conclusion ofthe auction, the highest biuder shall, ualess other arrangements are made with the auctioneer, deposit with the auctioneer . . an amountsufficient to cover the auctioneer’s commissiun, and either— {a) advise the Commissioner appointed by the Sherilf, attending the sale. of the manner in which he intends to make payment of the purchase-price and other costs andcharges in terms of these conditions and satisfy the Cummuiissiener as to his bona fides and ability to meet his obligations; or (b) effect payment to the Commissioner ofthe whole of the purchase-price in cash or by cheque or bank draft drawnto the order of the Sheriff, 9, The purchase-money,if not paid in full to the Commissioner at the conclusion of the auction, shall be paid on or before the registration of the transfer of the property into the name of the purchaser, unless the Sherilf approves thet arrangements for discharging the amount due by thepurchaser. 10. The purchaser shall be liable to puy interest at the rate of nine per cent. pet anuum in respect of any unpaid balance of the purchase-price, with effect from seven days after the date of confirmation ofthe sale by the Shecill. 11.
