Dear Councillors,

You will recall that Council received a grant of $856k earlier in 2020 from the Federal Government Local Roads and Community Infrastructure (LRCI) Program.

The objective of the LRCI Program is to assist local governments to deliver local road and community infrastructure projects, as well as create local job opportunities particularly where employment in other sectors have been negatively impacted.

Council has now been advised that this program has been extended and Council will receive an additional allocation of $5,849,906.

The grant funding conditions will be provided at a later date. Once the requirements are known, staff will develop a recommended program of works.

Dear Councillors On 22 September 2020 (C0920(2) Item 7, it was resolved that

• Council does not enter into a new lease with Summer Hill Community Centre Inc; • Council undertakes community consultation in relation to the Neighbourhood Centre at Summer Hill; • Following community consultation, Council proceed to an Expressions of Interest (EOI) for a suitably qualified and experienced community-based tenant to operate the Neighbourhood Centre; and • Outcome of the EOI process to be reported back to Council for decision.

Please find below an update on the timeframes based on the above resolutions:

Legal Advice Legal advice is as follows: S629 of the Local Government Act 1993 makes it an offence, without lawful excuse to remove any plant, animal, rock or soil from a public place. The maximum fine being $2,200. A Council ranger could issue a penalty notice for $220. A park or reserve is a public place. The licence or deed entered into with the community garden association does not give the association exclusive occupation therefore the public can enter into the area. To issue a penalty notice the Council ranger would have to be satisfied there is sufficient evidence to support the breach such as observing the person taking the plant or a person observing the other person taking the plant, identification by way of name, address. Council’s lawyer supports the approach currently taken by Council which is to prevent unlawful removal of plants or other materials from community gardens through community engagement and education. Council and groups currently do this by:

- Planning for good community access and inclusion in the group and garden to support members, visitors and the wider community to participate in activities and benefit from the garden. Recent community feedback on the policy included comments that community members feel excluded, and that there should be opportunities for access by the wider community beyond group members, including vulnerable or financially insecure community members - Engaging with the community to build support for the garden and how it operates - Communicating about opportunities to be involved. A range of methods are used by Inner West community garden groups to achieve this, for example: - an active social media presence - provision of a welcoming space for visitors and engaging with visitors to the garden - holding open and harvest days for the community

- attending community events or festivals or connecting with local community groups or schools - providing up to date information for Council’s community gardens webpage - onsite signage publicising community garden beds, working bee and share in the harvest times and dates.
