Statute Law Repeals: Consultation Paper Repeal of Turnpike Laws SLR 02/10: Closing date for responses – 25 June 2010 BACKGROUND NOTES ON STATUTE LAW REPEALS (SLR) What is it? 1. Our SLR work involves repealing statutes that are no longer of practical utility. The purpose is to modernise and simplify the statute book, thereby reducing its size and thus saving the time of lawyers and others who use it. This in turn helps to avoid unnecessary costs. It also stops people being misled by obsolete laws that masquerade as live law. If an Act features still in the statute book and is referred to in text-books, people reasonably enough assume that it must mean something. Who does it? 2. Our SLR work is carried out by the Law Commission and the Scottish Law Commission pursuant to section 3(1) of the Law Commissions Act 1965. Section 3(1) imposes a duty on both Commissions to keep the law under review “with a view to its systematic development and reform, including in particular ... the repeal of obsolete and unnecessary enactments, the reduction of the number of separate enactments and generally the simplification and modernisation of the law”. Statute Law (Repeals) Bill 3. Implementation of the Commissions’ SLR proposals is by means of special Statute Law (Repeals) Bills. 18 such Bills have been enacted since 1965 repealing more than 2000 whole Acts and achieving partial repeals in thousands of others. Broadly speaking the remit of a Statute Law (Repeals) Bill extends to any enactment passed at Westminster. Accordingly it is capable of repealing obsolete statutory text throughout the United Kingdom (i.e. -

Status: This is the original version (as it was originally enacted). Burial Act 1852 1852 CHAPTER 85 An Act to amend the Laws concerning the Burial of the Dead in the Metropolis. [1st July 1852] WHEREAS it is expedient to repeal " The Metropolitan Interments Act, 1850, " and to make such other Provision as herein-after mentioned in relation to Interments in and near the Metropolis: Be it therefore enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, as follows : I 13 & 14 Vict. c.52 repealed, and Her Majesty may continue additional Member of Board therein authorized. The said Act shall be repealed: Provided always, that it shall be lawful for Her Majesty to continue during the Continuance of the General Board of Health the Appointment of the additional Member of such Board authorized by the said Act, and the Salary of such Member, fixed as in the said Act mentioned, shall be paid as by Section Seven of the Public Health Act, 1848, is directed concerning the Salaries therein mentioned. II On Representation of Secretary of State, Her Majesty in Council may order Discontinuance of Burials in any Part of the Metropolis. ARTICLE BILLS OF ATTAINDER Matthew Steilen* ABSTRACT What are bills of attainder? The traditional view is that bills of attainder are legislation that punishes an individual without judicial process. The Bill of Attainder Clause in Article I, Section 9 prohibits the Congress from passing such bills. But what about the President? The traditional view would seem to rule out application of the Clause to the President (acting without Congress) and to executive agencies, since neither passes bills. This Article aims to bring historical evidence to bear on the question of the scope of the Bill of Attainder Clause. The argument of the Article is that bills of attainder are best understood as a summary form of legal process, rather than a legislative act. This argument is based on a detailed historical reconstruction of English and early American practices, beginning with a study of the medieval Parliament rolls, year books, and other late medieval English texts, and early modern parliamentary diaries and journals covering the attainders of Elizabeth Barton under Henry VIII and Thomas Wentworth, earl of Strafford, under Charles I. -

Whereas nothing can more conduce to the improving the Union of the Two Kingdom which by Her Majesties great Wisdom and Goodness hath been happily effected than that the Laws of both Parts of Great Britain should agree as near as may be especially those Laws which relate to High Treason and the Proceedings thereupon as to the Nature of the Crime the Method of Prosecution and Tryal and also the Forfeitures and Punishments for that Offence which are of the greatest Concern both to the Crown and to the Subjects to the end therefore that the said Union may be more effectually improved. Statute Law (Repeals) Act 1969 CH. 52 ELIZABETH II 1969 CHAPTER 52 An Act to promote the reform of the statute law by the repeal, in accordance with recommendations of the Law Commission, of certain enactments which (except in so far as their effect is preserved) are no longer of practical utility, and by making other provision in connection with the repeal of those enactments. [22nd October 19691 BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:- 1. The enactments mentioned in the Schedule to this Act are Repeal of hereby repealed to the extent specified in column 3 of the Schedule, enactments. 2.-(l) In proceedings by way of quare impedit commenced Advowsons. within six months of induction, judgment shall be given for the removal of an incumbent instituted to fill the vacancy, if he was instituted on a presentation made without title and is made a defendant to the proceedings. (2) Where the Crown presents to a benefice which is full of an incumbent, effect shall not be given to the presentation without judgment having been given for the removal of the incumbent in proceedings by way of quare impedit brought by or on behalf of the Crown. Subsection (1) above shall apply in relation to proceedings so brought whether or not they are commenced within the period of six months therein referred to. (3) The provisions of this section shall have effect in place of chapter 5 of the Statute of Westminster, the Second, chapter 10 of the statute of uncertain date concerning the King's prerogative and chapter 1 of 13 Ric. -
The Church Act
The Church Act: The expansion of Christianity or the imposition of moral enlightenment? David Stoneman A Thesis submitted as fulfilment of the requirement for the degree of Doctor of Philosophy, University of New England, Australia, 2011. Abstract The Church Act (1836) redefined and reinvigorated the religious environment in the emerging British colony of New South Wales, which profoundly impacted on its social and political development in a period of rapid population growth. It was a popular measure that has seen Governor Richard Bourke, its principal architect, be remembered as a provider of religious freedom. The simple motivation of the Act to expand Christianity and therefore morality has been complicated by the assertion that it assisted the expansion of a ‘new faith’ called moral enlightenment. This changes the implication of the Act and redefines the motives of the people responsible for its introduction, especially Bourke, by assuming that secular Enlightenment principles overrode Christian objectives. This has provided an ideological superstructure that has been used by some nationalist historians to present a picture of New South Wales colonial life that was fundamentally irreligious verging on atheistic. This has served to diminish the importance of religious thought and belief in the early development of Australia. This thesis argues that the Church Act was conceived to counter various forms of alternative belief and synchronised Christianity, ranging from plebeian ‘folk religion’ to heterodoxical, intellectual Protestantism. It encouraged orthodox Christianity by financially supporting the denominations that had cultural as well as spiritual connections to the majority of the population. The thesis concludes that the Church Act should be categorised as being a product of the ‘Age of Atonement’ not the imposition of moral enlightenment.
