It looks at all the recent studies and concludes that people are "born" that way, though well-funded studies are needed and there's a lot more to learn. Basically a sympathetic, friendly article for gays. But, hey, this is a blog and blogs were born to nitpick, so here goes. (Thanks to threader Gypsy Queen for pointing us to this.) What makes the case of Patrick and Thomas so fascinating is that it calls into question both of the dominant theories in the long-running debate over what makes people gay: nature or nurture, genes or learned behavior. Actually, only the MSM would describe the debate that way. It's been pretty clear to researchers (and obvious to queers) that sexual orientation is typically due to some combination of genetics and "environment," with environment typically referring to in utero exposure to certain amounts of hormones, etc. People are genetically disposed to being gay and that orientation is "locked in" by the time we're three at most, and most of the factors that lead to it are in utero. (A gross generalization, of course.) But no one serious in the field has argued for many years that dad refusing to play catch with his eight year old son is a contributing factor.

The course is split into three sections. First , we consider the media as an institution, as the “fourth branch” of government. We ask, what is news? Who is a journalist? How has the media changed over the course of American political development, and specifically with the rise of the Internet? Second , we consider the media in action— that is, how journalists cover the news. Is the media biased? How would (do) you know? What is the relationship between the media and government? How do the media frame the events they cover? Finally , we investigate media effects. What are the effects of media coverage on citizens—more specifically on citizens’ trust in government and political behavior? How do citizens respond to the nature of news coverage? Throughout the course we will spend considerable time considering the impact of different media forms—for example, blogging, talk radio, and entertainment media. It is my contention that the actions and discourse around the Tea Party Movement creates a cultural pedagogy that promotes structural violence that stems from an ideology of individualism. The promotion of individualism breaks down the foundations of democratic practices. In order to examine this, my investigation will work to: 1) explore the ties between neoliberalism, nationalism, and patriotism; 2) trace the ways in which race plays a role in Tea Party rhetoric and show its ties to racism, and; 3) locate the ways in which the Tea Party movement promotes hyper-masculinity. Restatement of Place* Mae Kuykendall† INTRODUCTION This article will explore the possible fit for a Restatement project of a large domain of human perception that pervades legal reasoning as an unstated background assumption. The domain is that of place, a term that deserves clarification for this article by comparison with related terms, such as territory and space. Place as a legal subject brings forth thoughts of the nation-state, jurisdiction, sovereignty, and the norms in international law affecting the reach of a sovereign into the territory of another sovereign. Those concerns are necessarily touched upon in this article, but the chief objectives are to (1) illustrate, through a survey of place’s effect in several very different legal contexts, how ideas about place have influenced legal reasoning, and (2) evaluate the possibility of making place a topic around which Restatement principles could be fashioned. Place, as a factor that is present in law but often not fully seen, has not been recognized for its theoretical importance as a viewpoint from which to understand the functioning and implications of many areas of the law.
