IBA Updates 840+ Bills Filed; Check Out Builders Bill Track for Those That Impact Housing We’ve completed week 3 of the 10-week legislative session, and of the more than 840 bills filed, there are nearly 100 that could impact housing. A list of all bills that have been filed is available here. Congress Extends Sec. 45L “Energy Efficient Homes” Tax Credit Congress, in its end-of-year fiscal year spending bill signed by President Obama just before Christmas, extended a number of tax deductions and credits that had expired at the end of calendar year 2014. Among the tax “extenders,” as they are called, was Sec.45L of the tax code that provides a credit of $2,000 for builders of new homes that are “energy efficient.” “Energy efficient” is defined in the tax credit as having 50 percent of the heating and cooling energy consumption of a home built to meet the baseline of the International Energy Conservation Code (IECC), and having heating, ventilating and air conditioning (HVAC) equipment that meets the minimums established by the Department of Energy (DOE) as of the date of completion of construction. The credit also requires that at least one-fifth of the 50-percent less energy use must come from building envelope improvements. Click here for the story. ACTION NEWS FEBRUARY 2016 EDITION Page 5 NAHB Updates WATERS OF THE : Background The Clean Water Act (CWA) provides the US Army Corps of Engineers and the Environmental Protection Agency (the agencies) with the authority to protect “navigable waters,” defined as a “water of the United States,” leaving all other waters under the protection of state and local governments. The agencies and the courts have long struggled to find a clear definition of “waters of the United States,” and the -Su preme Court has limited the agencies’ jurisdiction on a number of occasions. Supreme Court decisions have determined that CWA jurisdiction cannot be based on a mere connection to a navigable water (Rapanos), nor does it extend to waters far removed from navigable waters (SWANCC). Due to the confusion surrounding the Rapanos decision in 2006, the agencies have attempted to clarify jurisdiction through a rule that would greatly expand federal jurisdiction. WATERS OF THE UNITED STATES: RULEMAKING This rule drastically expands federal CWA authority. Under this new rule, any traditional water of the United States, its tributaries, and adjacent waters will be jurisdictional (i.e. federalized). Tributaries are defined to include, for the first time, man-altered and man-made water bodies, including ditches. Any land feature that exhibits a bed, a bank, or an ordinary high water mark (OHWM) will be considered a tributary with no examination of frequency or duration of flow. In addition, neighboring or adjacent waters and their tributaries will also be jurisdictional. This includes any water situated inside of a floodplain or within 1,500 feet of an OHWM. If there is anything else that is not considered a tributary or adjacent/ neighboring water, agencies can aggregate “other waters” with a “single landscape unit” to find a significant connection. The rule creates more confusion than clarity. The agencies use terms that have such broad definitions, which opens the door to potentially unlimited federal authority, leaving the burden of proof on the landowner. This rule will distort and ignore CWA Supreme Court decisions. The rule obliterates state authority over land and water, contrary to Rapanos and congressional intent under the CWA. In Rapanos, Justice Kennedy’s key point was that “any” connection is not enough to establish CWA jurisdiction and that there must be some defined limit to where federal jurisdiction ends and State jurisdiction begins. Therefore, the Court rejected the Government’s “any” connection theory and instead required a significant nexus between wetlands in questions and navigable waters. The rule treats any connection as regulable, directly contradicting Justice Kennedy’s opinion. The agencies have sidestepped many of the regulatory requirements that are designed to ensure a fair and balanced rule. This expansion of federal authority over water and land use will greatly increase the number of construction sites required to obtain a federal clean water act permit. This will delay or completely halt construction projects nationwide and slow economic growth. A 2002 study found that it takes an average of 788 days and $271,596 to obtain an individual permit and 313 days and $28,915 for a “streamlined” nationwide permit. Over $1.7 billion is spent each year by the private and public sectors obtaining wetlands permits. Importantly, these ranges do not take into account the cost of mitigation, which can be exces- sive. A backlog of pending CWA permit requests already exists. The current backlog for permits is exorbitant and, on aver- age, an individual permit takes two to three years to receive. Under this rule, more projects will require permits thereby increasing the backlog. WATERS OF THE UNITED STATES: LEGISLATIVE ACTION • On May 12, 2015, the House of Representatives passed H.R. 1732, the Regulatory Integrity Protection Act, which would force the agencies to withdraw the final rule and address the many procedural flaws. • Senator John Barrasso (R-WY) and Senator Joe Donnelly (D-IN) introduced legislation that would accomplish the same goal as the House bill. Dauby served as President of the Builders Association in 1997, and has remained active in the organization with his current company, Dauby Construction, Inc. Dauby also serves as SIBA’s Chairman for Codes Committee, and helps run the monthly Lunch and Codes meetings with code officials. SIBA’s board of directors is the governing body for the Association, and its meetings open for all members to attend. Over a single weekend, the Spring Tour will target advertising to attract buyers searching for their new home. Homes entered by SIBA builders will be included on the promotional map, which will be included in the Evansville Courier. The map will also be available on a special website built to help promote the builders’ homes. Featured on the new website will be loads of additional information for each house, and up to five photos. Bringing traffic to new homes is one thing that builders need – and that’s how the Association has designed the event. The Spring Tour, much like the Fall Tour of Homes, will work like a scaled-back Parade of Homes. Builders and Associates enjoy participating in the Parade of Homes, but the Spring Tour of Homes is a less formal event that usually delivers good results for traffic. In contrast to the Parade of Homes, these smaller events are known to do without the on-lookers, and get more actual buyers. Promotional packets with Builder Agreements were sent to all SIBA Builders the last week of January. The committee set the entry fee at $350 each, and there is a price-break for builders who enter more than five houses. Entries can consist of any stage of new construction – available building lot, under construction, or a completed home. ACTION NEWS FEBRUARY 2016 EDITION Page 15 Brainstorming at Leadership Session Creates Three New Task Forces For SIBA leadership, the New Year was kicked-off by a Leadership Orientation. The 2016 board of directors, and several members not on the board, took advantage of a great opportunity to discuss the future and well-being of the Association. The session was facilitated by Lynn Miller- Pease, and the event was hosted by First Security Bank. After a few exercises opened effective dialogue, the group began to discuss SIBA benefits and how to improve them further, as members may need them in various ways. The final exercise had each member identify one thing they want SIBA to continue, and one thing they would have SIBA discontinue. In all, the items were grouped into three categories, and assigned to volunteers willing to discuss them further. The three categories are Community Engagement, Membership Development, and Com- municating SIBA Values. Some of the groups are already meeting and continue to work toward improvements for all members. All members are welcome and encouraged to participate or send input. Page 26 FEBRUARY 2016 EDITION ACTION NEWS Builders workshop offered valuable insights 52 SIBA Members gathered at Tropicana on January 12th for a semi- nar that was full of valuable information. The first portion was led by Shannon Frank, Kahn Dees Donovan and Kahn where builders were informed of construction law essentials, warranties and mechanic’s liens. In the second portion, Joshua Gessling of KDDK gave an employment law update. Joshua covered discipline and termination, HR tips and wages. The final portion of the seminar switched gears to cover information on the Millennial Generation. Patti Lodato and Scott Lank of Wall 4 Associates, provided members with an overview of how to understand Millennial work ethic, how to relate to them and how to listen to their wants and needs when it comes to building and owning a home.
