Oliver * Full-time panel members iii PREFACE This is the sixty-seventh volume of issuances (1–508) of the Nuclear Regulatory Commission and its Atomic Safety and Licensing Boards, Administrative Law Judges, and Office Directors. It covers the period from January 1, 2008, to June 30, 2008. Atomic Safety and Licensing Boards are authorized by Section 191 of the Atomic Energy Act of 1954. These Boards, comprised of three members, conduct adjudicatory hearings on applications to construct and operate nuclear power plants and related facilities and issue initial decisions which, subject to internal review and appellate procedures, become the final Commission action with respect to those applications. Boards are drawn from the Atomic Safety and Licensing Board Panel, comprised of lawyers, nuclear physicists and engineers, environmentalists, chemists, and economists. The Atomic Energy Commission (AEC) first established Licensing Boards in 1962 and the Panel in 1967. Between 1969 and 1990, the AEC authorized Atomic Safety and Licensing Appeal Boards to exercise the authority and perform the review functions which would otherwise have been exercised and performed by the Commission in facility licensing proceedings. In 1972, that Commission created an Appeal Panel, from which were drawn the Appeal Boards assigned to each licensing proceeding. The functions performed by both Appeal Boards and Licensing Boards were transferred from the AEC to the Nuclear Regulatory Commission by the Energy Reorganization Act of 1974. Appeal Boards represented the final level in the administrative adjudicatory process to which parties could appeal. Parties, however, were permitted to seek discretionary Commission review of certain board rulings. The Commission also could decide to review, on its own motion, various decisions or actions of Appeal Boards. On June 29, 1990, however, the Commission voted to abolish the Atomic Safety and Licensing Appeal Panel, and the Panel ceased to exist as of June 30, 1991. Since then, the Commission itself reviews Licensing Board and other adjudicatory decisions, as a matter of discretion. See 56 Fed. 29 & 403 (1991). The Commission also has Administrative Law Judges appointed pursuant to the Administrative Procedure Act, who preside over proceedings as directed by the Commission. The hardbound edition of the Nuclear Regulatory Commission Issuances is a final compilation of the monthly issuances. It includes all of the legal precedents for the agency within a six-month period. Any opinions, decisions, denials, memoranda and orders of the Commission inadvertently omitted from the monthly softbounds and any corrections submitted by the NRC legal staff to the printed softbound issuances are contained in the hardbound edition. Cross references in the text and indexes are to the NRCI page numbers which are the same as the page numbers in this publication.     No Nukes Study You don’t need to be a nuclear physicist to understand that nuclear weapons and nuclear power are both bad for our species and bad for the planet. It’s not exactly rocket science to understand our need to move away from both nuclear energy and fossil fuels and toward a safe, sustainable, and democratic energy system based on solar, wind, and other renewable resources. However, given the powerful economic interests, often called the “Merchants of Death,” which profit from United States nuclear weapons and the rest of the U.S. war machine and which exert an undue and undemocratic influence on U.S. policy through making us accept the nuclear/fossil fuel complex, it is wise to arm oneself with a better understanding of nuclear and sustainable energy issues. The literature is vast, both published and on the web. Here is a listing of some of the most important internet resources, most of which have additional links. Atomic Archive. This site explores the complex history surrounding the invention of the atomic bomb. Includes a good section on the history of the Cold War. http://www.atomicarchive.com/index.shtml Fiat Pax is a project to provide information to university students, faculty, and the public regarding the militarization of science and the university, focusing on the University of California and its ties to the military enterprise, but also examples of the larger military- industrial-academic complex. http://www.fiatpax.net/index.html Greenpece International. http://www.greenpeace.org/international/en/campaigns/nuclear/ Mothers for Peace, in San Luis Obispo, is a non-profit organization concerned with the local dangers involving the Diablo Canyon Nuclear Power Plant, and with the dangers of nuclear power, weapons and waste on national and global levels.

Tontodonato ABSTRACT The model used as the basis for regulation of human radiation exposures in the United States has been a source of controversy for decades because human health consequences have not been determined with statistically meaningful certainty for the dose levels allowed for radiation workers and the general public. This dissertation evaluates the evolution of the science and regulation of radiation health effects in the United States since the early 1900s using actor-network theory and the concept of co- production of science and social order. This approach elucidated the ordering instruments that operated at the nexus of the social and the natural in making institutions, identities, discourses, and representations, and the sociotechnical imaginaries animating the use of those instruments, that culminated in a regulatory system centered on the linear no-threshold dose-response model and the As Low As Reasonably Achievable philosophy. The science of radiation health effects evolved in parallel with the development of radiation-related technologies and the associated regulatory system.

(22 cartons and 1 document box) ABSTRACT Carol Bernstein Ferry and the late W. H. (Ping) Ferry were social change philanthropists who gave away a substantial part of their personal wealth to progressive social change groups, activities, and activists concentrating generally in the areas of war, racism, poverty, and injustice. The Ferrys were also board members of the DJB Foundation, established by Carol’s first husband, Daniel J. Bernstein, which focused its giving in similar areas. The papers, 1971-1996, document the individuals, organizations, and activities the Ferrys supported with their donations. ACCESS This collection is open to the public without restriction. Ferry Finding Aid - page 2 HISTORY Carol Bernstein Ferry was born Carol Underwood in 1924 in upstate New York and grew up in Portland, Maine. She attended a private girls’ school and graduated from Wells College, a small woman’s college near Auburn, New York, in 1945. She moved to New York City in 1946 and worked as a copy editor and proofreader, eventually freelancing in that capacity for McGraw- Hill.
